Justice T.R.RAMACHANDRAN NAIR\n\n Dated :17\/02\/2009\n\n O R D E R\n               T.R.RAMACHANDRAN NAIR,J.\n                      -------------------------\n                  W.P ( C) No.3376 of 2009\n                      --------------------------\n             Dated this the 17th February,2009\n\n                        J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      Petitioner was having registration with Employment<\/p>\n<p>Exchange Kollam early as from 6.7.1976. Exhibit-P2<\/p>\n<p>shows that she has renewed her registration from time to<\/p>\n<p>time.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      2.    For the post of Part-time Sweeper, the 1st<\/p>\n<p>respondent gave requisition to the Employment Exchange<\/p>\n<p>Kollam    for advising candidates and the name of the<\/p>\n<p>petitioner was sponsored.      According to the petitioner,<\/p>\n<p>after the interview, the 1st respondent finalized the list as<\/p>\n<p>per Exhibit-P4. But her name has been omitted. Exhibit-<\/p>\n<p>P4 is under challenge in this writ petition on the ground<\/p>\n<p>that many of the persons selected are junior to the<\/p>\n<p>petitioner both age wise as well as the date of<\/p>\n<p>employment registration.\n<\/p>\n<p id=\"p_3\">      3.    Learned government Pleader, on instructions,<\/p>\n<p>submitted that selection is made on the basis of the<\/p>\n<p>guidelines and allotment of marks alone.         It is not an<\/p>\n<p>W.P ( C) No.3376 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 2<\/span><\/p>\n<p>arbitrary selection that is made. Therefore, the contention<\/p>\n<p>that both seniority and the date of employment registration<\/p>\n<p>will be considered in the selection cannot be accepted.<\/p>\n<p id=\"p_4\">      4.     In that view of the matter, there is nothing<\/p>\n<p>wrong in Exhibit-P4 list finalized by the 1st respondent.<\/p>\n<p>Learned counsel for the petitioner submitted that the<\/p>\n<p>petitioner is already aged 49 and she may not get much<\/p>\n<p>chance to get any appointment before attaining the age of<\/p>\n<p id=\"p_5\">50.     The claim of the petitioner for sponsoring in other<\/p>\n<p>vacancies will be considered in accordance with her<\/p>\n<p>seniority and date of registration by the Employment<\/p>\n<p>Officer concerned.
