WADHWA\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p id=\"p_1\">     The appellant  claims for\tpromotion as Engineer-in-Chief on<br \/>\nthe basis  of a\t the basis  of a  Scheduled Tribe  Status. In the<br \/>\njudgment in  <a href=\"\/doc\/1620184\/\" id=\"a_1\">Major Yogendra  Narain Yadav  vs. State  of Bihar\t&amp;<br \/>\nOrs<\/a>., the  right of the person has been determined. In this case,<br \/>\nthe question  arises is:  whether the appellant really belongs to<br \/>\nScheduled Tribe?  With a  view to  find the  genuineness of   the<br \/>\nstatus as  Scheduled Tribes,  we had  directed the  petitioner to<br \/>\nfile geneology table of his family history. It is now admitted in<br \/>\nhis affidavit  that the\t family of  the\t appellant  hails    from<br \/>\nBilaspur, Madhya  Pradesh. Sabalpur\t\t\t Gopalganj<br \/>\n\t  Kurrudeg  District\t\t\t District<br \/>\n\t  in\t    presently<br \/>\n\t  Semdega   Jharsuguda<br \/>\n\t  in the    (Orissa)<br \/>\n\t  Ranchi<br \/>\n\t  District<br \/>\n\t  now Gumla<br \/>\n\t  District<br \/>\n     A reading\tof this\t family history\t indicates that\t his<br \/>\nclaim as  Scheduled Tribe  is not  only highly\tdoubtful but<br \/>\nbeyond comprehension  to believe  that he  eligible for\t the<br \/>\nsame. Under  the circumstances, we do not find any substance<br \/>\nto interfere  with the\torder of the High Court.
