DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\tThis<br \/>\napplication is filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.I-162 of 2010 with Chhani Police Station,  for the offences<br \/>\npunishable under <a href=\"\/doc\/38865\/\" id=\"a_1\">Sections 278<\/a>, <a href=\"\/doc\/663817\/\" id=\"a_2\">284<\/a>, <a href=\"\/doc\/1065895\/\" id=\"a_3\">287<\/a>, <a href=\"\/doc\/366823\/\" id=\"a_4\">337<\/a>, <a href=\"\/doc\/989759\/\" id=\"a_5\">114<\/a> etc. of<a href=\"\/doc\/1569253\/\" id=\"a_6\"> the Indian<br \/>\nPenal Code<\/a> and <a href=\"\/doc\/535894\/\" id=\"a_7\">Section 9(B)<\/a> of Explosives Act, 1884.\n<\/p>\n<p id=\"p_1\">2.\tLearned<br \/>\ncounsel appearing for the applicants submit that considering the<br \/>\nnature of evidence, role attributed to the applicants and punishment<br \/>\nprescribed, this application for bail may kindly be considered.\n<\/p>\n<p id=\"p_2\">3.\tHeard<br \/>\nlearned APP  for the respondent &#8211; State.\n<\/p>\n<p id=\"p_3\">4.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, nature of<br \/>\nallegations, role attributed to the accused and punishment prescribed<br \/>\nfor the alleged offences, I am inclined to enlarge the applicants on<br \/>\nbail.\n<\/p>\n<p id=\"p_4\">5.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicants are ordered to be released on bail in connection<br \/>\nwith first information report registered at CR No.I-162 of 2010 with<br \/>\nChhani Police Station, on executing bond of Rs.5,000\/- (Rupees Five<br \/>\nThousand only) each with one surety of the like amount to the<br \/>\nsatisfaction of the trial Court and subject to the conditions that<br \/>\nthey shall;\n<\/p>\n<p id=\"p_5\">not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p id=\"p_6\">not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_7\">surrender<br \/>\n\ttheir passport, if any, to the lower court within a week;\n<\/p>\n<p id=\"p_8\">not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p id=\"p_9\">mark<br \/>\n\ttheir presence at the concerned police station on the first Sunday<br \/>\n\tof every month between 10.00 a.m. and 3.00 p.m. till the trial<br \/>\n\tcommences;\n<\/p>\n<p id=\"p_10\">furnish<br \/>\n\tthe present address of residences to the I.O. and also to the Court<br \/>\n\tat the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p id=\"p_11\">6.\tThe<br \/>\nAuthorities will release the applicants only if they are not required<br \/>\nin connection with any other offence for the time being.\n<\/p>\n<p id=\"p_12\">7.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p id=\"p_13\">8.\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p id=\"p_14\">9.\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p id=\"p_15\">10.\tRule<br \/>\nis made absolute to the aforesaid extent.
