No.5830\/2010-C\n                ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n          Dated this the 23rd day of February, 2010\n\n                      J U D G M E N T\n<\/pre>\n<p id=\"p_1\">    The petitioner herein is the owner and in possession of<\/p>\n<p>a Eicher lorry bearing Registration No.KL-40-B-364.      On<\/p>\n<p>12\/01\/2010, the said vehicle was intercepted by the Sub<\/p>\n<p>Inspector  of  Police  and   was  seized  alleging  illicit<\/p>\n<p>transportation of river sand.     It is the case of the<\/p>\n<p>petitioner   that   the   said   vehicle   was   used   for<\/p>\n<p>transportation of ordinary sand purchased from one Shri<\/p>\n<p>Sojan, Vengoor, Angamaly as per Ext.P2 Cash Memorandum in<\/p>\n<p>Form &#8216;P&#8217; and he had not transported river sand.<\/p>\n<p id=\"p_1\">    2.    The  petitioner  made  a  request  to  the  first<\/p>\n<p>respondent for interim custody of the vehicle in the light<\/p>\n<p>of the decision of this Court in <a href=\"\/doc\/422175\/\" id=\"a_1\">Subramanian v. State of<\/p>\n<p>Kerala<\/a> [2009 (1) KLT 77).   Ext.P3 is the copy of the said<\/p>\n<p>request.  Aggrieved by the delay in disposal of the said<\/p>\n<p>application, the petitioner has filed this writ petition.<\/p>\n<p id=\"p_2\">    3.   Heard learned counsel for the petitioner and the<\/p>\n<p>learned Government Pleader.\n<\/p>\n<p id=\"p_3\">    4.   There will be a direction to the first respondent<\/p>\n<p>to take a decision on Ext.P3 within a period of seven days<\/p>\n<p>from the date of production of a copy of this judgment, in<\/p>\n<p>the light of the well settled principles laid down by this<\/p>\n<p>W.P.(C). No.5830\/2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              -:2:-<\/span><\/p>\n<p>Court    in    various decisions   and, on such  terms   and<\/p>\n<p>conditions which he deems fit to impose.     The matter will<\/p>\n<p>be considered in accordance with law.      There will be a<\/p>\n<p>further direction to the first respondent to pass final<\/p>\n<p>orders within a period of two months from the date of<\/p>\n<p>receipt of a copy of this judgment with notice to the<\/p>\n<p>petitioner and after considering the pleas raised by the<\/p>\n<p>petitioner, on merits.\n<\/p>\n<p id=\"p_4\">     The writ petition is disposed of as above.
