GIRI, J.\n                  -------------------------------\n                    WP(C).No. 28012\/2008\n                 ---------------------------------\n        Dated this the    16th    day of October, 2008.\n\n                           JUDGMENT\n<\/pre>\n<p id=\"p_1\">     The petitioner claims to be the Muthavalli of Moonnakkal<\/p>\n<p>Juma-ath palli, a registered Wakf. According to the petitioner,<\/p>\n<p>as per the Wakf register one V.P.Kuhi Pocku is shown as the<\/p>\n<p>Muthavalli. Subsequently, the petitioner&#8217;s brother Hurair Kutty<\/p>\n<p>was recognised as Muthavalli. According to the petitioner, he<\/p>\n<p>later succeeded on the death of the Muthavalli. The petitioner<\/p>\n<p>submits that an election to the Wakf Board has been notified<\/p>\n<p>under <a href=\"\/doc\/1861274\/\" id=\"a_1\">section 14<\/a> of the Wakf Act. The Muthavallis of the Wakfs<\/p>\n<p>in the State constitute the electoral college. The petitioner&#8217;s<\/p>\n<p>grievance is that his name is not included in the voters list<\/p>\n<p>published by the first respondent. An objection submitted by<\/p>\n<p>him has not been considered, according to him.      But by Ext.P3,<\/p>\n<p>a non speaking order, the complaint has been rejected.        The<\/p>\n<p>same has been challenged.\n<\/p>\n<p id=\"p_1\">     2.   By order dated 25.9.2008,       I directed the Standing<\/p>\n<p>Counsel for the Wakf Board        to file a statement indicating<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC. 28012\/2008               2<\/span><\/p>\n<p>whether the order impugned in the writ petition can be the<\/p>\n<p>subject matter of an election dispute.      A statement has been<\/p>\n<p>filed. Para 1 of the same reads as follows:\n<\/p>\n<p id=\"p_2\">          &#8221;  In   the   above    case,  the   petitioner<\/p>\n<p>          challenges the order of the Returning Officer<\/p>\n<p>          declining the petitioner&#8217;s request to include<\/p>\n<p>          his name in the Electoral Roll of the Electoral<\/p>\n<p>          College of Muthawalli and the inclusion of the<\/p>\n<p>          name of the 4th respondent. It is submitted<\/p>\n<p>          that Rule 55 of the Kerala Wakf Rules<\/p>\n<p>          provides for redressal of election disputes.<\/p>\n<p id=\"p_3\">          The complaint of the petitioner      is to be<\/p>\n<p>          agitated as an election dispute in an Election<\/p>\n<p>          petition to be filed before the Wakf Tribunal<\/p>\n<p>          as per Rule 55 of the Kerala Wakf Rules.&#8221;\n<\/p>\n<p id=\"p_4\">      3. Election disputes are normally to be agitated only in the<\/p>\n<p>manner which is provided in the statute which governs the<\/p>\n<p>election.   Since   the Wakf Board which conducts election has<\/p>\n<p>itself accepted that the claim made by the petitioner or objection<\/p>\n<p>raised by him in relation to respondents 3 and 4 can be<\/p>\n<p>adjudicated as an election dispute in terms of Rule 55 of the<\/p>\n<p>Kerala Wakf Rules, I do not think it is appropriate to consider<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC. 28012\/2008             3<\/span><\/p>\n<p>the case of the petitioner on merits in proceedings under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article<\/p>\n<p>226<\/a> of the constitution. Accordingly recording the stand taken by<\/p>\n<p>the first respondent, the writ petition is disposed of holding that<\/p>\n<p>the dispute raised by the petitioner and the claim pursued by<\/p>\n<p>him is a matter which can be urged as election dispute under<\/p>\n<p>section 55 of the Kerala Wakf Rules.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">                                      V.
