No.27560 of 2010\n                  KANHAIYA SINGH, SON OF LATE RAM NARAYAN SINGH\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p id=\"p_1\">2.   16.08.2010              Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p id=\"p_1\">                             The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under Sections 25(1-B)A and 26 of the <a href=\"\/doc\/1934415\/\" id=\"a_1\">Arms Act<\/a>.<\/p>\n<p id=\"p_2\">                             Considering that the petitioner is in custody since<\/p>\n<p>                  10.3.2010 for recovery of one country made pistol with one<\/p>\n<p>                  cartridge, let the petitioner above named, be released on bail on<\/p>\n<p>                  furnishing bail bond of Rs. 5,000\/- (Five thousand) with two<\/p>\n<p>                  sureties of the like amount each to the satisfaction of Chief<\/p>\n<p>                  Judicial Magistrate, Begusarai, in Teghra P.S. Case No. 46 of<\/p>\n<p>                  2010 (G.R. No. 748 of 2010) subject to the following conditions:<\/p>\n<p id=\"p_3\">                  (i)That one of the bailors will be a close relative of the petitioner<\/p>\n<p>                  who will give an affidavit giving genealogy as to how he is<\/p>\n<p>                  related with the petitioner and the other shall be the brother\/wife<\/p>\n<p>                  of the petitioner. The bailor will undertake to furnish information<\/p>\n<p>                  to the Court about any change in address of the petitioner.<\/p>\n<p id=\"p_4\">                  (ii)That the bailor shall also state on affidavit that he will inform<\/p>\n<p>                  the court concerned if the petitioner is implicated in any other<\/p>\n<p>                  case of similar nature after his release in the present case and<\/p>\n<p>                  thereafter the court below will be at liberty to initiate the<\/p>\n<p>                  proceeding for cancellation of bail on the ground of misuse.<\/p>\n<p id=\"p_5\">                  (iii)That the petitioner will give an undertaking that he will<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             2<\/span><\/p>\n<p>        receive the police papers on the given date and be present on<\/p>\n<p>        date fixed for charge and if he fails to do so on two given dates<\/p>\n<p>        and delays the trial in any manner, his bail will be liable to be<\/p>\n<p>        cancelled for reasons of misuse. (iv)That the petitioner will be<\/p>\n<p>        well represented on each date and if he fails to do so on two<\/p>\n<p>        consecutive dates, his bail will be liable to be cancelled.<\/p>\n<p id=\"p_6\">                   In view of the antecedents of the petitioner, the<\/p>\n<p>        petitioner is directed to appear before the Superintendent of<\/p>\n<p>        Police, Begusarai, within fifteen days of his release with a copy<\/p>\n<p>        of this order and thereafter every two weeks for the next one<\/p>\n<p>        year. The conduct of the petitioner will be kept under watch in<\/p>\n<p>        this period by the Superintendent of Police concerned and if it is<\/p>\n<p>        found wanting in any respect, a report shall be made to the<\/p>\n<p>        court concerned by him to initiate a proceeding for cancellation<\/p>\n<p>        of bail for reasons of misuse of bail.
