1.                Leave granted.\n<\/p>\n
2.                This appeal arises out of an order passed by the High <\/p>\n
Court of Gujarat at Ahmedabad whereby  conviction  of the <\/p>\n
appellants   for   offences   punishable   under   Sections   325, <\/p>\n
506(2), 333, 342 and 114 IPC has been affirmed and the –\n<\/p>\n
                                            1<\/span><\/p>\n
sentence   reduced   to   imprisonment   for   a   period   of   1= <\/p>\n
years.\n<\/p>\n
3.    When   the   special   leave   petition   came   up   for <\/p>\n
admission,   this   Court   by   its   order   dated   1st  August,   2011 <\/p>\n
issued   notice   to   the   respondents   only   on   the   question   of <\/p>\n
sentence. We are not, therefore, examining the validity of <\/p>\n
the   order   of   conviction   which   both   the   Courts   below   have <\/p>\n
passed on a proper appreciation of the evidence on record.\n<\/p>\n
The only question on which we have heard learned counsel <\/p>\n
for   the   parties   is   whether   the   sentence   awarded   to   the <\/p>\n
appellants needs to be reduced and, if so, to what extent.\n<\/p>\n
4.      The   genesis   of   the   case   of   the   appellants   lies   in   an <\/p>\n
incident  that  took place  on  7th  September,  2003  at  village <\/p>\n
Chitrod   in   the   District   of   Kutch,   State   of   Gujarat.   The <\/p>\n
complainant in the case was, during the relevant period, a <\/p>\n
Constable   posted   at   Chitrod   outpost   of   Police   Station <\/p>\n
Bhimasar. The prosecution case is that at about 10.30 a.m. <\/p>\n
on   7th  September,   2003   when   the   complainant   was   on <\/p>\n
patrol   duty,   he   found   one   Babubhai   quarrelling   in   public <\/p>\n
place with one Hussain Ibrahim Siddi, accused no.1.  The –\n<\/p>\n

constable appears to have accosted the quarrelling duo and <\/p>\n
asked   them   as   to   why   they   were   disturbing   peace   and <\/p>\n
ordered them to accompany him to the police station. This <\/p>\n
appears   to   have   infuriated   Hussain   Ibrahim   Siddi   who <\/p>\n
caught   hold   of   the   Constable   from   his   collar   and   pushed <\/p>\n
him. In the meantime the son, wife and mother of Hussain <\/p>\n
Ibrahim  Siddi  also  appear   to   have  joined   Hussain  Ibrahim <\/p>\n
Siddi,   exchanged   hot   words   with   constable   and   prevented <\/p>\n
him from taking Hussain Ibrahim Siddi to the Police Station.\n<\/p>\n
It   was   on   those   allegations   that   Hussain   Ibrahim   and   the <\/p>\n
appellants   were   tried   together   for   the   offences   mentioned <\/p>\n
earlier.\n<\/p>\n
5.     At the trial the prosecution  examined as many as 13 <\/p>\n
witnesses   to   support   its   case.   The   depositions   of   these <\/p>\n
witnesses were found reliable by the Trial Court resulting in <\/p>\n
the   conviction   of   Hussain   Ibrahim   for   the   offence <\/p>\n
punishable under Section 325 and sentence of five years RI <\/p>\n
besides   a   fine   of   Rs.500\/-.   In   default   he   was   directed   to <\/p>\n
undergo   a   further   sentence   of   six   months.   He   was   also <\/p>\n

convicted under Section 506(2) of the IPC and sentenced to <\/p>\n
–\n<\/p>\n
undergo imprisonment for a period of five years and a fine <\/p>\n
of Rs.500\/- and in default to undergo further imprisonment <\/p>\n
for a period of six months. Hussain Ibrahim was in addition <\/p>\n
convicted and sentenced to imprisonment for five years and <\/p>\n
a   fine   of   Rs.500\/-   under   Section   333   and   in   default   to <\/p>\n
undergo further imprisonment of six months. Imprisonment <\/p>\n
for a period of one year and a fine of Rs.100\/- was awarded <\/p>\n
to   him   under   Section   342   of   the   IPC   and   in   default   to <\/p>\n
undergo further imprisonment for a period of one month.\n<\/p>\n
6.    In so far as the appellants Hussain Siddi, Malubai wife <\/p>\n
of Ibrahim Siddi and Hawabai wife of Hussain Ibrahim are <\/p>\n
concerned, the Trial Court found them also to be guilty of <\/p>\n
offences   punishable   under   Sections   333   of   the   IPC   and <\/p>\n
sentenced   them   to   undergo   simple   imprisonment   for   a <\/p>\n
period   of   three   years   and   a   fine   of   Rs.200\/-.   Malubai <\/p>\n
accused no.3 and appellant before us was also in addition <\/p>\n
convicted   and   sentenced   to   undergo   imprisonment   for   a <\/p>\n
period of three years under Section 506(2) IPC apart from <\/p>\n

a fine of Rs.500\/-.   In default of payment of fine she was <\/p>\n
sentenced to undergo six months further imprisonment.\n<\/p>\n

7.    Aggrieved   by   the   orders   of   conviction   and   sentence <\/p>\n
the appellants preferred an appeal before the High Court of <\/p>\n
Gujarat   at   Ahmedabad   who   has   while   upholding   the <\/p>\n
conviction of the appellants reduced the sentence awarded <\/p>\n
to all of them to 1= years instead of three years.\n<\/p>\n
7.    It is common ground that the appellants, two of whom <\/p>\n
happen   to   be   females   had   not   physically   assaulted   the <\/p>\n
constable.  Even appellant no.1 is not alleged to have used <\/p>\n
any force against the constable in the incident in question.\n<\/p>\n
The incident itself is nearly ten years old by now. Keeping in <\/p>\n
view   all   these   circumstances   and   the   fact   that   Hussain <\/p>\n
Ibrahim Siddi accused no.1 who was mainly responsible for <\/p>\n
the   grievous   injury   caused   to   the   constable   has   already <\/p>\n
served the sentence awarded to him, we are of the opinion <\/p>\n
that   interest   of   justice   would   be   sufficiently   served   if   the <\/p>\n
sentence awarded to the appellants is modified and reduced <\/p>\n
to the sentence already undergone by them.\n<\/p>\n

8.    We   order   accordingly.   The   appellants   shall   be   set   at <\/p>\n
liberty   forthwith   unless   required   in   any   other   case.     The <\/p>\n
appeal is allowed to the above extent.\n<\/p>\n
