Heard learned counsel for the petitioner<\/p>\n<p>                      and the counsel for the Indian Oil Corporation<\/p>\n<p>                      Limited (hereinafter referred to as the &#8220;Corporation&#8221;),<\/p>\n<p>                      who has prayed for time to seek instruction and to<\/p>\n<p>                      file counter affidavit in the matter. Considering the<\/p>\n<p>                      nature of the order which this Court is proposing to<\/p>\n<p>                      pass, prayer to file counter affidavit is being refused.<\/p>\n<p id=\"p_4\">                               2. Petitioner, who served as Senior Manager,<\/p>\n<p>                      (L.P.G.-Ops.), Bihar State Office of the Corporation,<\/p>\n<p>                      is   aggrieved   by   the   suspension    order   dated<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                   -2-<\/span><\/p>\n<p>29.3.2010, Annexure-1, issued in contemplation of a<\/p>\n<p>departmental proceeding. The charge-sheet in the<\/p>\n<p>light of the suspension order was not served on the<\/p>\n<p>petitioner   within     a   reasonable   time.   i.e.   until<\/p>\n<p>28.06.2010.    Petitioner      submitted    representation<\/p>\n<p>dated   29.06.2010,         Annexure-3     requesting    the<\/p>\n<p>authorities to revoke the suspension order issued in<\/p>\n<p>contemplation of the departmental proceeding on the<\/p>\n<p>ground that the charge-sheet has not been served on<\/p>\n<p>the petitioner inspite of passage of reasonable time.<\/p>\n<p>The representation of         the petitioner has been<\/p>\n<p>rejected under orders dated 14.09.2010, Annexure-<\/p>\n<p>4, perusal whereof does not indicate any reason as to<\/p>\n<p>why the charge-sheet has not been served on the<\/p>\n<p>petitioner till the date of the order rejecting his<\/p>\n<p>representation.\n<\/p>\n<p id=\"p_5\">        3. For the failure of the authorities not to<\/p>\n<p>indicate reason for not issuing the charge-sheet even<\/p>\n<p>after passage of reasonable time of the issue of the<\/p>\n<p>suspension order, I set aside the order rejecting the<\/p>\n<p>representation of the petitioner dated 14.09.2010,<\/p>\n<p>Annexure-4 and remit back the matter to the<\/p>\n<p>authorities of the Corporation to revisit the request<\/p>\n<p>of the petitioner to revoke his suspension and if the<\/p>\n<p>authorities are not inclined to revoke the suspension<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                           -3-<\/span><\/p>\n<p>         or to serve the memo of charge within a reasonable<\/p>\n<p>         time not exceeding one month from the date of<\/p>\n<p>         receipt of this order then to indicate reason(s) for<\/p>\n<p>         failure to serve the charge-sheet by passing fresh<\/p>\n<p>         order in the matter within the same time.
