Justice M.SASIDHARAN NAMBIAR\n\n Dated :02\/01\/2007\n\n O R D E R\n                     M.SASIDHARAN NAMBIAR, J.\n\n        ...........................................\n\n                       W.P.(C)No.176 OF 2007\n\n       ............................................\n\n           DATED THIS THE 2nd DAY OF JANUARY, 2007\n\n\n\n                                JUDGMENT\n<\/pre>\n<p id=\"p_1\">      Petitioner   is   the   plaintiff   and   respondent   is   the<\/p>\n<p>defendant   in   O.S.48   of   2001   on   the   file   of   Sub   Court,<\/p>\n<p>Manjeri.   Under   Ext.P6   order,   the   exparte   decree   as<\/p>\n<p>against defendants 1 to 3 were set aside by learned Sub<\/p>\n<p>Judge.   Ext.P6   order   is   challenged   in   this   petition<\/p>\n<p>filed under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of Constitution of India.   The<\/p>\n<p>contention of petitioner was that Ext.P3 judgment shows<\/p>\n<p>that defendants 1 to 3 were not set exparte and it is a<\/p>\n<p>judgment   on   merit   and   therefore   the   decree   should   not<\/p>\n<p>have   been   set   aside   under   Order   IX   Rule   13   of   Code   of<\/p>\n<p>Civil Procedure. It was also contended that even if the<\/p>\n<p>decree   was  exparte,  there  are  no  sufficient  grounds  to<\/p>\n<p>set   aside   the   decree   as   the   medical   certificate<\/p>\n<p>produced   by    petitioner  shows  that  first  defendant  was<\/p>\n<p>laid up only for seven days.\n<\/p>\n<p id=\"p_1\">      2.   Learned   counsel   appearing   for   the   petitioner<\/p>\n<p>was heard.\n<\/p>\n<p id=\"p_2\">      3. Ext.P3 judgment itself shows that when the case<\/p>\n<p>was   included   in   the   special   list   and   taken   up   for<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WP(C)176\/2007                      2<\/span><\/p>\n<p>evidence,   an   application   for   adjournment   was   moved   by<\/p>\n<p>the   defendants   1   to   3   on   the   ground   that   first<\/p>\n<p>defendant   was   laid   up.   Learned   Munsiff   refused   the<\/p>\n<p>adjournment   sought   for.     Thereafter   learned   counsel<\/p>\n<p>appearing   for   defendants   1   to   3   reported   no<\/p>\n<p>instructions.     Defendants   1   to   3   were   not   present   at<\/p>\n<p>the time of trial. Though technically defendants 1 to 3<\/p>\n<p>were not set exparte by a specific order by learned Sub<\/p>\n<p>Judge, in fact defendants 1 to 3 were exparte and they<\/p>\n<p>did   not   participate   in   the   trial   at   all.     In   such<\/p>\n<p>circumstances,   learned   Sub   Judge   under   Ext.P6   order<\/p>\n<p>rightly found that decree as against defendants 1 to 3<\/p>\n<p>was   exparte   decree   and   therefore   it   can   be   set   aside<\/p>\n<p>under Order IX Rule 13 as against defendants 1 to 3 if<\/p>\n<p>sufficient cause for their absence was  shown.\n<\/p>\n<p id=\"p_3\">     4.   The   specific   case   of     defendants   1   to   3   was<\/p>\n<p>that  first defendant was contesting the suit and first<\/p>\n<p>defendant   was   laid   up   when   the   decree   was   passed.   The<\/p>\n<p>illness was supported by a medical certificate.  Though<\/p>\n<p>adjournment   was   sought   for   on   the   ground   of   illness,<\/p>\n<p>learned   Sub   Judge   was   not   satisfied     with   the   grounds<\/p>\n<p>and   hence   adjournment   was   refused.   But   that   is   not   a<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WP(C)176\/2007                       3<\/span><\/p>\n<p>reason to hold that first respondent\/defendant was laid<\/p>\n<p>up.     Learned   Sub   Judge   appreciating   the   facts   in   the<\/p>\n<p>proper   perspective   found   that   first   defendant   was   laid<\/p>\n<p>up   and   hence   could   not   appear   or   contest   the   case.   In<\/p>\n<p>such   circumstances,   exparte   decree   was   set   aside   under<\/p>\n<p>Ext.P6   order.     I   do   not   find   any   reason   to   interfere<\/p>\n<p>with   that   order,   in   exercise   of   the   extra   ordinary<\/p>\n<p>jurisdiction   of   this   court   under   <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article   227<\/a>   of<\/p>\n<p>Constitution   of   India.
