DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 24\/11\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\tRule.\n<\/p>\n<p id=\"p_1\">Learned Additional Public Prosecutor waives service of notice of Rule<br \/>\non behalf of the Respondent-State of Gujarat.\n<\/p>\n<p id=\"p_2\">2.\tThe<br \/>\npresent application has been filed by the applicant-accused under<br \/>\n<a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of Criminal Procedure Code for regular bail after filing<br \/>\nof the charge-sheet.\n<\/p>\n<p id=\"p_3\">3.\t\tThe<br \/>\napplicant-accused is charged with having committed offences<br \/>\nunder <a href=\"\/doc\/329571\/\" id=\"a_1\">Sections 392<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_2\">114<\/a> of the Indian Penal Code, for which, FIR<br \/>\nbeing I-C.R.No.31\/2010 has been lodged at Dahej Police Station,<br \/>\nDistrict : Bharuch.\n<\/p>\n<p id=\"p_4\">4.\t\tLearned<br \/>\ncounsel for  the applicant referred to the FIR and submitted that<br \/>\nconsidering the nature of offences and the fact that the charge-sheet<br \/>\nis filed and other co-accused have been released on bail, the present<br \/>\napplication may be allowed.\n<\/p>\n<p id=\"p_5\">5.\t\tLearned<br \/>\nA.P.P. resisted the present application.\n<\/p>\n<p id=\"p_6\">6.\t\tHaving<br \/>\nheard learned counsel appearing for the applicant-accused and learned<br \/>\nA.P.P. for the State and having considered the nature of offences,<br \/>\nrole attributed and also considering the fact that the charge sheet<br \/>\nhas now been filed and other co-accused have been released on bail,<br \/>\nthe present application deserves to be allowed.\n<\/p>\n<p id=\"p_7\">7.\t\tAccordingly,<br \/>\npresent application stands allowed. The applicant is ordered to be<br \/>\nreleased on regular bail in connection with FIR being<br \/>\nI-C.R.No.31\/2010 has been lodged at Dahej Police Station, District :<br \/>\nBharuch h on his executing a bond of Rs. 5,000\/- (Rupees Five<br \/>\nThousand Only) with one solvent surety of the like amount to the<br \/>\nsatisfaction of the lower Court and subject to the conditions that he<br \/>\nshall:\n<\/p>\n<p id=\"p_8\">(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p id=\"p_9\">(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p id=\"p_10\">(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_11\">(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers;\n<\/p>\n<p id=\"p_12\">(e)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court;\n<\/p>\n<p id=\"p_13\">(f)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week;\n<\/p>\n<p id=\"p_14\">(g)\tmark<br \/>\nhis presence before concerned Police Station 1st day of<br \/>\nevery calender month between 11:00 AM and 2:00 PM for three months<br \/>\nonly;\n<\/p>\n<p id=\"p_15\">(h)\tnot<br \/>\nenter into the local limits of Dahej Police Station without prior<br \/>\npermission of this Court for a period of six months, but for marking<br \/>\npresence and for attending the Court in connection with this case, he<br \/>\nwill be free to enter the limits for a period to that extent<br \/>\nnecessary and will leave the limits soon thereafter;\n<\/p>\n<p id=\"p_16\">8.\t\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p id=\"p_17\">9\t\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p id=\"p_18\">10.\t\tRule<br \/>\nis made absolute to the aforesaid extent.
