BASANT, J.\n\n                      - - - - - - - - - - - - - - - - - - - - - -\n\n                        B.A.No.  1237  of   2008\n\n                      - - - - - - - - - - - - - - - - - - - - - -\n\n                 Dated this the 4th day of  March, 2008\n\n\n                                   O R D E R\n<\/pre>\n<p id=\"p_1\">       Application for anticipatory bail.  The petitioner, a woman,<\/p>\n<p>faces   allegations   in   a   crime   registered   alleging     offences<\/p>\n<p>punishable,   inter   alia,   under   <a href=\"\/doc\/1326844\/\" id=\"a_1\">Section   409<\/a>   I.P.C.     The   petitioner<\/p>\n<p>was   the   Secretary   of   a   Milk     Co-operative   Society.         While<\/p>\n<p>discharging   the   duties   as   such   Secretary   of   the   Society,   she   is<\/p>\n<p>alleged   to   have   committed   the   offence   of   misappropriation,<\/p>\n<p>breach of trust and falsification of documents of the society.  The<\/p>\n<p>crime   has   been   registered   on   the   basis   of   a   private   complaint<\/p>\n<p>filed by the Hon. Secretary of the society, who had taken charge<\/p>\n<p>after the petitioner was kept under suspension.  Specific instances<\/p>\n<p>of culpable indiscretion are alleged against the petitioner as also<\/p>\n<p>two   other   employees   of   the   society.     The   complaint   was<\/p>\n<p>forwarded   under   <a href=\"\/doc\/99487\/\" id=\"a_1\">Section   156(3)<\/a>   Cr.P.C.   to   the   police.<\/p>\n<p>Investigation is in progress.  The petitioner apprehends imminent<\/p>\n<p>arrest.\n<\/p>\n<p id=\"p_1\">\nB.A.No.  1237  of   2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                             2<\/span><\/p>\n<p id=\"p_2\">       2.     The   learned   counsel   for   the   petitioner   submits   that   the<\/p>\n<p>petitioner  is innocent.  False and vexatious allegations are being raised<\/p>\n<p>against   the   petitioner.     She   is   not   guilty   of   any   misappropriation   or<\/p>\n<p>other culpable indiscretion.   She is not in any way responsible for the<\/p>\n<p>culpable   indiscretion   of   the   co-accused.     In   these   circumstances   it   is<\/p>\n<p>prayed that anticipatory bail may be granted to the petitioner.<\/p>\n<p id=\"p_3\">       3.   The learned Prosecutor opposes the application.   He submits<\/p>\n<p>that the  complaint gives the graphic  details of various acts of culpable<\/p>\n<p>indiscretion on the part of the petitioner.  He has placed before me the<\/p>\n<p>case diary for my perusal.   The Investigating Officer heavily relies on<\/p>\n<p>the   admissions   made   by   the   petitioner   in   a   letter   submitted   to   the<\/p>\n<p>President, copy of which is available in the case diary.   In such letter<\/p>\n<p>she owns the responsibility for the indiscretion and undertakes that the<\/p>\n<p>amounts shall be repaid.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">         4. Having considered all the relevant inputs and the submissions<\/p>\n<p>of   the   learned   counsel   for   the   petitioner,     I   am   unable   to   find   any<\/p>\n<p>features   in  this   case,  which   would   justify   the  invocation   of   the   extra<\/p>\n<p>ordinary equitable discretion under <a href=\"\/doc\/1783708\/\" id=\"a_2\">section 438<\/a> Cr.P.C. in favour of the<\/p>\n<p>B.A.No.  1237  of   2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                3<\/span><\/p>\n<p>petitioner.       This     I   agree   with   the   learned   Prosecutor,     is   a   fit   case<\/p>\n<p>where the petitioner  must resort to the ordinary and normal procedure<\/p>\n<p>of appearing before the Investigator or the learned Magistrate having<\/p>\n<p>jurisdiction and then seek regular bail in the  ordinary course.<\/p>\n<p id=\"p_6\">       5.   This application   is accordingly dismissed.     I may however<\/p>\n<p>hasten   to   observe   that   if   the   petitioner   appears   before   the   learned<\/p>\n<p>Magistrate  and  applies  for  bail  after  giving  sufficient  prior  notice<\/p>\n<p>to  the  Prosecutor  in charge of the case,   the  learned Magistrate must<\/p>\n<p>proceed   to   pass   orders   on   merits,   in   accordance   with   law   and<\/p>\n<p>expeditiously.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">                                                             (R.
