    Petitioner is the plaintiff in O.S.205 of 2007 on<\/p>\n
the file of Munsiff Court, Hosdurg.   Suit is filed for<\/p>\n
a  declaration   that   revenue  recovery   proceedings<\/p>\n
initiated by second respondent in RR(ST)22\/2007-2008 is<\/p>\n
not binding  on the suit property and for an injunction<\/p>\n
restraining respondents from attaching the property or<\/p>\n
movables in the house.   Respondents\/defendants in the<\/p>\n
written statement raised a contention that suit is not<\/p>\n
properly valued and court fee paid is not sufficient.<\/p>\n
Issue No.4 was framed on the said contention.   Learned<\/p>\n
Munsiff, as per order dated 9.4.2008, following the<\/p>\n
Division Bench decision of this court in Sreekumaran V.<\/p>\n
State of Kerala<\/a> (1996(2) KLT 21), directed petitioner<\/p>\n
to pay the court fee, after valuing the property at<\/p>\n
Rs.4,34,720\/-, being the amount claimed in the notice<\/p>\n
served under the revenue recovery proceedings.   It is<\/p>\n
challenged in this petition.\n<\/p>\n
    2.    Learned  counsel   appearing  for  petitioner<\/p>\n
pointed  out  that  revenue  recovery  proceedings  was<\/p>\n
WP(C) 17486\/2008             2<\/span><\/p>\n
initiated     against  4th respondent, the  assignor  of<\/p>\n
petitioner as distinct from the facts of the case in<\/p>\n
Sreekumaran’s case(supra) and there was no demand for<\/p>\n
tax as against the petitioner and therefore learned<\/p>\n
Munsiff was not justified in directing payment of court<\/p>\n
fee, on the amount demanded in the notice.<\/p>\n
     3.       Petitioner  has paid  court  fee  of   only<\/p>\n
Rs.1000\/-, valuing the relief as provided under Section<\/p>\n
25(d) (i) of Kerala Court Fees and Suit Valuation Act<\/p>\n
(in short ‘the Act’). As rightly found by the learned<\/p>\n
Munsiff, when the decree sought for is a declaration<\/p>\n
that respondents 1 to 3 are not entitled to proceed<\/p>\n
against the plaint schedule property, the suit should<\/p>\n
have been valued as provided under Section 25(d)(i) of<\/p>\n
the Act and to that extent, Ext.P3 order is perfectly<\/p>\n
correct.\n<\/p>\n
     4.    But as long as petitioner is not the defaulter<\/p>\n
and the amount is not claimed from the petitioner and<\/p>\n
no relief is sought as against the liability of fourth<\/p>\n
respondent, there is no justification in directing<\/p>\n
payment of court fee on the basis of the amount<\/p>\n
demanded from 4th respondent.\n<\/p>\n
\n
     5.     When the question of valuation and court<\/p>\n
fee to be paid is to be decided what is to be<\/p>\n
WP(C) 17486\/2008            3<\/span><\/p>\n
looked into is the substance of the relief prayed<\/p>\n
for by the plaintiff. When the declaration sought<\/p>\n
for is that plaintiff has no liability to pay any<\/p>\n
amount which is demanded under the revenue recovery<\/p>\n
proceedings      and   a   consequential  decree   for<\/p>\n
permanent prohibitory injunction restraining the<\/p>\n
authorities       from  proceeding  further  with  the<\/p>\n
revenue recovery proceedings, it is a case where<\/p>\n
Plaintiff is seeking a relief in respect of a<\/p>\n
liability which is a fixed amount.     In such a case,<\/p>\n
suit is to be valued under Section 25(d)(i) of the<\/p>\n
Kerala Courts Fees and Suit Valuation Act for the<\/p>\n
amount demanded in the notice issued under revenue<\/p>\n
recovery proceedings.      But that cannot be applied<\/p>\n
to a case where plaintiff is not a defaulter and he<\/p>\n
is not seeking a decree     restraining realisation of<\/p>\n
the amount demanded under the revenue recovery<\/p>\n
proceedings from the defaulter but only contended<\/p>\n
that his      property cannot be proceeded against as<\/p>\n
it does not belong to the defaulter.        In such a<\/p>\n
case, plaintiff cannot be directed to value the<\/p>\n
suit for the amount demanded under the revenue<\/p>\n
recovery proceedings from the defaulter.     It may be<\/p>\n

that the actual market value of the property be<\/p>\n
less than Rs.25,000\/-.     It is possible that the<\/p>\n
arrears of the salestax or any other tax for<\/p>\n
realisation of which proceedings were initiated<\/p>\n
under the Revenue Recovery Act<\/a> against the property<\/p>\n
may exceed even five lakhs.   A suit  filed in such<\/p>\n
a case by a person, who is not a defaulter and who<\/p>\n
is not personally liable to pay the amount demanded<\/p>\n
under the revenue recovery proceedings,   seeking a<\/p>\n
prayer     that  his property cannot  be   proceeded<\/p>\n
against for the liability    due from another,    he<\/p>\n
cannot be compelled to value the property for the<\/p>\n
amount      demanded under  the   revenue   recovery<\/p>\n
proceedings from the defaulter.  He need only value<\/p>\n
the   suit for the value of the property as provided<\/p>\n
under section 25(d)(i) of Kerala Courts Fees and<\/p>\n
Suit Valuation Act.     The facts of Sreekumaran’s<\/p>\n
case (supra) shows that the prayer in the suit was<\/p>\n
for a declaration that revenue recovery proceedings<\/p>\n
initiated by the defendant is illegal, erroneous<\/p>\n
and unsustainable and also for a declaration that<\/p>\n
plaintiff has no liability to pay any amount and<\/p>\n
the liability of the plaintiff is only to pay the<\/p>\n

amount due to the second defendant upto a fixed<\/p>\n
period.      In such circumstance, the Division Bench<\/p>\n
held that       suit is to be valued for the amount<\/p>\n
demanded under the revenue recovery proceedings, as<\/p>\n
the amount demanded is a specified amount.<\/p>\n
       Instead,   learned Munsiff should have directed to<\/p>\n
value the plaint for the value of the property and pay<\/p>\n
court fee accordingly.    To that extent, Ext.P3 order is<\/p>\n
modified.        Petitioner  is  directed  to  value  the<\/p>\n
property on the value of the plaint schedule property<\/p>\n
and pay court fee as provided under Section 25(d)(i)<\/a> of<\/p>\n
the Act.\n<\/p>\n
