BHAVADASAN, JJ.\n                    -------------------------------------------\n                     W.P(C).No.24102 OF 2010\n                    -------------------------------------------\n             Dated this the 1st day of December, 2010\n\n\n                               JUDGMENT\n<\/pre>\n<p id=\"p_1\">Thottathil B.Radhakrishnan, J.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      Petitioner&#8217;s lands were acquired under the provisions of the<\/p>\n<p><a href=\"\/doc\/7832\/\" id=\"a_1\">Land Acquisition Act<\/a> for public purpose, to wit, need of the<\/p>\n<p>Guruvayoor Devaswom to have further land for the purpose of a<\/p>\n<p>CBSE school under one of its trusts. The plea of the petitioner<\/p>\n<p>now is against the acquisition proceedings on the premise that in<\/p>\n<p>the acquisition, while he is being given land value only at the<\/p>\n<p>1999 rate, the beneficiaries of Ext.P8 review petition order are<\/p>\n<p>likely to get the market price at the point of time of<\/p>\n<p>dispossession.    As of now, the acquisition is completed and<\/p>\n<p>award has been passed.            Obviously therefore, the acquisition<\/p>\n<p>cannot be challenged.           At the request of the petitioner, a<\/p>\n<p>reference has also been made to the court.                      This means all<\/p>\n<p>matters relating to the claim for enhancement of compensation<\/p>\n<p>have to be agitated before that court. The petitioner further<\/p>\n<p>WPC.24102\/10<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                  2<\/span><\/p>\n<p>point out that dissatisfied by Ext.P8, the beneficiaries therein<\/p>\n<p>had taken up the matter to the Apex Court and Ext.P16 order of<\/p>\n<p>the Apex Court contains a direction that the case of the<\/p>\n<p>petitioners therein be considered by a committee. That direction<\/p>\n<p>was made by the Apex court on the submission by the writ<\/p>\n<p>petitioners   therein   that  the   Guruvayoor     Devaswom     has<\/p>\n<p>constituted a committee to look into the grievances of the land<\/p>\n<p>owners whose lands have been acquired. If the petitioner is<\/p>\n<p>entitled to have his claim looked into again by that committee<\/p>\n<p>and if he has made appropriate application for such purpose or if<\/p>\n<p>any application by him is likely to be considered by that<\/p>\n<p>committee, that could be done in accordance with law. However,<\/p>\n<p>the petitioner having appropriate remedy by prosecuting the<\/p>\n<p>land acquisition reference stated to have been also made, we do<\/p>\n<p>not find any ground to entertain this writ petition and grant any<\/p>\n<p>relief, it having been found that a writ petition against an<\/p>\n<p>acquisition proceedings will not lie after issuance of the award.<\/p>\n<p>It is clarified that the claim of the petitioner, if any, that he is<\/p>\n<p>also entitled to the benefits, if any, of the direction of the Apex<\/p>\n<p>WPC.24102\/10<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                3<\/span><\/p>\n<p>Court is a matter which he may urge before the reference court<\/p>\n<p>to be decided in accordance with law. We leave open the<\/p>\n<p>contentions of the Guruvayoor Devaswom, the petitioner and the<\/p>\n<p>State in the LAR.
