Justice P.R.RAMACHANDRA MENON\n\n Dated :02\/06\/2010\n\n O R D E R\n                  P.R.RAMACHANDRA MENON, J\n                     --------------------------------------------\n                      WP(C) NO. 17026 OF 2010\n                     --------------------------------------------\n               Dated this the 2nd day of June, 2010\n\n                                 JUDGMENT\n<\/pre>\n<p id=\"p_1\">       Being aggrieved of Ext.P1 order imposing penalty upon the<\/p>\n<p>petitioner, the petitioner has preferred Ext.P2 appeal; which is stated as<\/p>\n<p>finally heard by the appellate authority on 23.04.2010, but the final orders<\/p>\n<p>are still to be passed.\n<\/p>\n<p id=\"p_1\">       2.     In respect of the Ext.P7 assessment order, the petitioner has<\/p>\n<p>preferred Ext.P8 appeal, along with Ext.P9 petition for stay, which are also<\/p>\n<p>pending consideration before the 3rd respondent.<\/p>\n<p id=\"p_2\">       3.     The grievance of the petitioner is that, without any regard to<\/p>\n<p>the pendency of the above proceedings, coercive steps being taken by the<\/p>\n<p>4th and 5th respondents as borne by Exts.P4 and P11 notices issued under<\/p>\n<p>the Kerala Revenue Recovery Act; which course is under challenge in this<\/p>\n<p>Writ Petition.\n<\/p>\n<p id=\"p_3\">       2.     Heard the learned Government Pleader as well.<\/p>\n<p id=\"p_4\">       3.     Considering the facts and circumstances, the 3rd respondent<\/p>\n<p>is directed to pass final orders on Ext.P2 appeal, which is stated as heard<\/p>\n<p>on 23.04.2010, as expeditiously as possible, at any rate, within one month<\/p>\n<p>from the date of receipt of a copy of this judgment. Similarly, the said<\/p>\n<p>respondent is also directed to consider and pass appropriate orders on<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                     2<\/span><br \/>\nWP(C) No. 17026\/2010<\/p>\n<p>Ext.P9 I.A. for stay, within one month from the date of receipt of a copy of<\/p>\n<p>this judgment.
