The petitioner has also prayed for<br \/>\n\tthe direction to the respondent authorities not to take coercive<br \/>\n\tstep in pursuance of the notice dated 05.01.2010 issued under Rule<br \/>\n\t118 of the Bombay Land Revenue Rules.\n<\/p>\n<p id=\"p_1\">This<br \/>\n\tCourt has issued notice on 02.03.2010. Pursuant to the notice, Mr.<br \/>\n\tRashesh Rindani, learned Assistant Government Pleader appears and<br \/>\n\taffidavit-in-reply is filed on behalf of the respondents.  Along<br \/>\n\twith the reply, several documents are placed on record.  The<br \/>\n\tpetitioner has also filed rejoinder.\n<\/p>\n<p id=\"p_2\">Heard<br \/>\n\tMr. Rajesh K. Shah, learned advocate appearing for the petitioner<br \/>\n\tand Mr. Rashesh Rindani, learned Assistant Government Pleader<br \/>\n\tappearing for the respondents.\n<\/p>\n<p id=\"p_3\">The<br \/>\n\tshort point involved in this petition is that the notices as well as<br \/>\n\tthe final order passed by the respondent No.1 on 28.05.2002 were not<br \/>\n\treceived by the petitioner.  They came to know about this order only<br \/>\n\twhen the notice dated 05.01.2010 was issued by the Deputy Collector<br \/>\n\tand thereafter, the petitioner made an application on 08.02.2010<br \/>\n\tasking for the Challan for the purpose of filing appeal against the<br \/>\n\torder of the Deputy Collector.  The said application was rejected by<br \/>\n\tthe Deputy Collector on 15.02.2010 on the ground that appeal is to<br \/>\n\tbe filed within 60\/90 days and since that period is over, the<br \/>\n\trequest cannot be accepted.  The petitioner thereafter filed the<br \/>\n\tpresent petition before this Court.\n<\/p>\n<p id=\"p_4\">In<br \/>\n\tthe affidavit-in-reply, xerox copy from the dispatch register is<br \/>\n\tproduced wherein it is clearly stated that notice was issued by<br \/>\n\tordinary post.  Even the order was also issued under the ordinary<br \/>\n\tpost.  Mr. R. K. Shah, learned advocate appearing for the petitioner<br \/>\n\trelied on the provisions contained in Rule 7 (4) of the Bombay Stamp<br \/>\n\t(Department of Market Value of Property) Rules, 1984 which says that<br \/>\n\tthe notice or order to the person concerned must be sent by Regd.<br \/>\n\tPost with acknowledgement.  Admittedly, neither the notice nor the<br \/>\n\torder was served by Regd. Post.  He has, therefore, submitted that<br \/>\n\tthere was no service at all and even if it is assumed that the<br \/>\n\tnotice was sent, it was not by Regd. Post and hence, there is no<br \/>\n\tvalid service of the notice or order.\n<\/p>\n<p id=\"p_5\">Considering<br \/>\n\tthe above submissions of the petitioner, the Court is of the view<br \/>\n\tthat the petitioner has rightly challenged the action of the<br \/>\n\trespondents before this Court.  Hence, in the interest of justice,<br \/>\n\tthe petitioner deserves to have an opportunity of challenging the<br \/>\n\torder of the Deputy Collector before the Chief Controlling Revenue<br \/>\n\tAuthority.  The request made by the petitioner was earlier rejected<br \/>\n\twhich is improper and hence, the said communication dated 15.02.2010<br \/>\n\tis hereby quashed and set aside and the petitioner is permitted to<br \/>\n\tchallenge the order dated 28.05.2002 of the Deputy Collector before<br \/>\n\tthe Chief Controlling Revenue Authority by way of appeal.  For this<br \/>\n\tpurpose, the petitioner is liable to make payment of requisite<br \/>\n\tamount before his appeal is entertained on merits.  However, the<br \/>\n\taction is now to be challenged after more than 8 years.  The<br \/>\n\tpetitioner is directed to deposit 50% of the deficit stamp duty by<br \/>\n\tway of deposit for the purpose of consideration of his appeal on<br \/>\n\tmerits.  Accordingly, the petitioner is hereby permitted to file an<br \/>\n\tappeal before the Chief Controlling Revenue Authority along with the<br \/>\n\tdeposit of 50% of the stamp duty and on furnishing such appeal, the<br \/>\n\tChief Controlling Revenue Authority is hereby directed to decide the<br \/>\n\tsaid appeal in accordance with law. Since more than 8 years have<br \/>\n\talready been passed, the petitioner shall file such appeal within 15<br \/>\n\tdays from today and the Chief Controlling Revenue Authority shall<br \/>\n\tdecide the said appeal, without raising the issue regarding<br \/>\n\tlimitation, within six months from the date of receipt of such<br \/>\n\tappeal.\n<\/p>\n<p id=\"p_6\">With<br \/>\n\tthis direction and observation, this petition is accordingly<br \/>\n\tdisposed of without any order as to costs.\n<\/p>\n<p id=\"p_7\">\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p id=\"p_8\">\t\t\t\t\t\t\t\t[K.
