Justice K.SURENDRA MOHAN\n\n Dated :02\/02\/2011\n\n O R D E R\n           R.BASANT &amp; K.SURENDRA MOHAN, JJ.\n                     ***********************\n                  W.P(C) No.33511 of 2010-L\n                  *****************************\n            Dated this the 2nd day of February, 2011\n\n                          JUDGMENT\n<\/pre>\n<p id=\"p_1\">BASANT, J.\n<\/p>\n<p id=\"p_1\">      The petitioner has come to this Court complaining of police<\/p>\n<p>harassment and issue of directions to respondents 1 to 5 to<\/p>\n<p>ensure that the police officials do not vex and harass him at the<\/p>\n<p>instance of the 6th respondent, a retired high ranking police<\/p>\n<p>official.\n<\/p>\n<p id=\"p_2\">      2.   According to the petitioner, the 6th respondent was<\/p>\n<p>guilty of committing criminal offences against the petitioner and<\/p>\n<p>his wife.   Prosecution was launched.     It ultimately ended in<\/p>\n<p>conviction. The conviction was upheld by all courts upto the<\/p>\n<p>Supreme Court. According to the petitioner, the 6th respondent,<\/p>\n<p>who is a very influential person, prevailed upon the Government<\/p>\n<p>to commute\/remit the punishment imposed to him. This obliged<\/p>\n<p>the petitioner to approach this Court and this Court set aside the<\/p>\n<p>order of remission granted in favour of the 6th respondent.<\/p>\n<p id=\"p_3\">      3.   Appeals were preferred against that order of the<\/p>\n<p>learned Single Judge by the 6th respondent as well as the State.<\/p>\n<p>According to the petitioner, the Bench which was hearing the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P(C) No.33511 of 2010-L        2<\/span><\/p>\n<p>appeal wanted to ascertain whether parties can settle their<\/p>\n<p>disputes and the petitioner can compound the offences alleged<\/p>\n<p>against the 6th respondent. The petitioner is not willing for any<\/p>\n<p>such composition, asserts the petitioner. The petitioner alleges<\/p>\n<p>that there was a concerted attempt to vex and harass the<\/p>\n<p>petitioner for the reason that the petitioner was not willing to<\/p>\n<p>compound the offences alleged against the 6th respondent. It is<\/p>\n<p>contended that succumbing to the influence wielded by the 6th<\/p>\n<p>respondent, the 4th and 5th respondents took the petitioner into<\/p>\n<p>custody and detained him at the Sakthikulangara Police Station.<\/p>\n<p>There, he was allegedly compelled to affix his signature on some<\/p>\n<p>blank sheets in a book. The petitioner aired an apprehension in<\/p>\n<p>the petition that such signatures are likely to be misused by the<\/p>\n<p>6th respondent to make it appear that the petitioner has settled<\/p>\n<p>the disputes and compounded the offences allegedly committed<\/p>\n<p>by the 6th respondent against him. It is, in these circumstances,<\/p>\n<p>that the petitioner came to this Court seeking issue of directions<\/p>\n<p>to the respondent police officers to desist from their attempt to<\/p>\n<p>vex and harass him.\n<\/p>\n<p id=\"p_4\">      4.    The     6th  respondent has    entered    appearance.<\/p>\n<p>According to the 6th respondent, the allegations are totally false.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P(C) No.33511 of 2010-L        3<\/span><\/p>\n<p>The 6th respondent submits that the appeals have been decided<\/p>\n<p>in favour of the 6th respondent and that there is no merit in the<\/p>\n<p>contention that the 6th respondent had made any attempt to<\/p>\n<p>obtain signatures of the petitioner in blank papers to enable him<\/p>\n<p>to use the same to succeed in the appeals, which were pending<\/p>\n<p>before the Division Bench.\n<\/p>\n<p id=\"p_5\">      5.    The     learned Government      Pleader   appears    for<\/p>\n<p>respondents 1 to 5. The learned Government Pleader submits<\/p>\n<p>that it is true that a complaint was received from one<\/p>\n<p>Krishnamma, allegedly a neighbour of the petitioner.          That<\/p>\n<p>complaint was registered as a petition. No crime was registered.<\/p>\n<p>The petitioner and the said Krishnamma were called to the police<\/p>\n<p>station. An attempt was made to ensure that the parties settle<\/p>\n<p>their disputes. They did not. Theirs was a civil dispute. Parties<\/p>\n<p>were directed to approach the civil court. The parties including<\/p>\n<p>the petitioner, were asked to affix their signatures in the petition<\/p>\n<p>registered.     The petitioner is relying upon that innocuous<\/p>\n<p>circumstance to raise false and untenable allegations against the<\/p>\n<p>6th respondent as also the other police officials.<\/p>\n<p id=\"p_6\">      6.    It is now evident that the signature was obtained in<\/p>\n<p>the petition register.    We do not think it necessary to delve<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">W.P(C) No.33511 of 2010-L       4<\/span><\/p>\n<p>deeper into the question as to whether it was a blank of the<\/p>\n<p>register or the signature was obtained after entries were made<\/p>\n<p>in the register. At any rate, we do not find any merit in the<\/p>\n<p>contention that signatures were obtained in order to enable the<\/p>\n<p>6th respondent to falsely claim that the dispute was settled and<\/p>\n<p>the offences were compounded by the petitioner.<\/p>\n<p id=\"p_7\">     7.     We are not, in these circumstances, persuaded to<\/p>\n<p>agree that any directions under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of<\/p>\n<p>India can, need or deserve to be issued.\n<\/p>\n<p id=\"p_8\">     8.
