Justice T.R.RAMACHANDRAN NAIR\n\n Dated :07\/12\/2009\n\n O R D E R\n                T.R RAMACHANDRAN NAIR,J.\n                      -------------------------\n                  W.P ( C) No.33573 of 2009\n                      --------------------------\n             Dated this the 7th December,2009\n\n                        J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The petitioner herein was appointed as Part-time<\/p>\n<p>Hindi Teacher by the 5th respondent             from 6.6.2007<\/p>\n<p>against the promotion vacancy of Sri.A.Satheesan as per<\/p>\n<p>Ext.P1 order. Bu the approval of the said appointment<\/p>\n<p>was declined as per Ext.P2 on the ground that protected<\/p>\n<p>hands are available.       The contention raised by the<\/p>\n<p>petitioner is that there was no list of Junior Hindi (Part-<\/p>\n<p>time) Protected Teachers available at that point of time.<\/p>\n<p>Ext.P2 communication is relied upon in this regard. Even<\/p>\n<p>though an appeal was filed before the Director of Public<\/p>\n<p>Instruction, that was rejected by Ext.P3.<\/p>\n<p id=\"p_1\">      2.   Later, when a vacancy of Upper Primary School<\/p>\n<p>Assistant arose in the school, the Manager appointed a<\/p>\n<p>Protected Teacher namely Sri.P.V Pradeepan as per Ext.P4<\/p>\n<p>order. The petitioner has thereafter filed Ext.P5 revision<\/p>\n<p>petition before the Government and accordingly seeks for<\/p>\n<p>a direction to the Government to take a decision on Ext.P5<\/p>\n<p>within a time frame. Reliance is placed on Ext.P6 judgment<\/p>\n<p>W.P ( C) No.33573 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               2<\/span><\/p>\n<p>of this Court in W.P (C) No.4623 of 2009 in support of her<\/p>\n<p>pleas.\n<\/p>\n<p id=\"p_2\">      3.    Heard the learned Government Pleader          for<\/p>\n<p>respondents 1 to 4, also.\n<\/p>\n<p id=\"p_3\">      3.
