Justice ANTONY DOMINIC\n\n Dated :28\/05\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n              --------------------------------------------------\n                  W.P.(C) NO.14519 OF 2010 (L)\n              --------------------------------------------------\n              Dated this the 28th day of May, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p id=\"p_1\">       Petitioner is a Deputy Director in the Department of Tourism.<\/p>\n<p>He claimed promotion to the post of Joint Director. According to<\/p>\n<p>the petitioner, he is qualified and is eligible. It is contended that a<\/p>\n<p>vacancy arose on 19.4.2001 and that the DPC is going to be held<\/p>\n<p>and the 3rd respondent who is unqualified is going to be<\/p>\n<p>considered for promotion. It is with this grievance the writ petition<\/p>\n<p>is filed.\n<\/p>\n<p id=\"p_1\">       2.    On behalf of the 3rd respondent Senior Counsel<\/p>\n<p>submitted that the qualifications for the post of Joint Director<\/p>\n<p>inter alia requires one year training which can be acquired only by<\/p>\n<p>deputation. It is stated that in 2008-2009, while all the candidates<\/p>\n<p>in the feeder category of Deputy Director were eligible to be<\/p>\n<p>deputed, two senior employees including the 3rd respondent were<\/p>\n<p>not relieved in the exigencies of service. It is stated that the<\/p>\n<p>petitioner was accordingly deputed for training and that he<\/p>\n<p>completed the training. It is also stated that the 3rd respondent<\/p>\n<p>was deputed for training in the year 2009-2010 and                  has<\/p>\n<p>WPC.No. 14519\/2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  :2 :<\/span><\/p>\n<p>successfully completed the training.\n<\/p>\n<p id=\"p_2\">     3. According to the learned Sr. counsel when the vacancy<\/p>\n<p>arose apprehending that the 3rd respondent will be excluded from<\/p>\n<p>consideration,    he filed WP(c).NO.11144\/2010 before this court<\/p>\n<p>and an interim order was obtained, directing that his case shall<\/p>\n<p>also be considered when other cases are taken up for<\/p>\n<p>consideration. It is stated that it was pursuant to that direction of<\/p>\n<p>this court, when DPC was held his claim was considered and he<\/p>\n<p>was included in the select list, which was also published.<\/p>\n<p id=\"p_3\">     4. Evidently, the submission made by the 3rd respondent<\/p>\n<p>reveals that he was asserting his eligibility to be considered and<\/p>\n<p>obtained an order from this court in WP(c)No.11144\/2010.<\/p>\n<p>requiring the respondents to consider his case also for promotion.<\/p>\n<p>In such circumstances if the petitioner has a case that the 3rd<\/p>\n<p>respondent is ineligible, the remedy available to the petitioner is<\/p>\n<p>to get himself impleaded in the writ petition filed by the 3rd<\/p>\n<p>respondent and seek to get the order passed by this court<\/p>\n<p>vacated, rather than filing other writ petition seeking conflicting<\/p>\n<p>orders.\n<\/p>\n<p id=\"p_4\">WPC.No. 14519\/2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              :3 :<\/span><\/p>\n<p>     Therefore, leaving it open to the petitioner to seek<\/p>\n<p>appropriate orders in WP(C).No.11144\/2010 and without<\/p>\n<p>expressing anything on the merits of the contentions raised, this<\/p>\n<p>writ petition is dismissed.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">                                       (ANTONY DOMINIC)<br \/>\n                                             JUDGE<br \/>\nvi\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Ponnappan.C.K vs State Of Kerala Represented By The on 28 May, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 14519 of 2010(L) 1.
