Justice K.HEMA\n\n Dated :09\/07\/2010\n\n O R D E R\n                                K.HEMA, J\n                           -----------------------\n                        B.A No.3357 OF 2010\n                       --------------------------------\n                 Dated this the 9th day of July 2010\n\n                                  ORDER\n<\/pre>\n<p id=\"p_1\">             This petition is for anticipatory bail.\n<\/p>\n<p id=\"p_1\">      2. The alleged offences are under Sections 406, 420 r\/w<\/p>\n<p>120(B) of <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a>. According to prosecution, petitioner (A2) and first<\/p>\n<p>accused approached several persons and made them believed by<\/p>\n<p>making false representations that if they were to give money, it<\/p>\n<p>would be invested in a business and huge profit will be raised and<\/p>\n<p>paid to them etc. Thus, they induced several persons pay huge<\/p>\n<p>amounts to the accused. They also issued receipts. But, accused<\/p>\n<p>did not act as promised and the money which was collected from<\/p>\n<p>various persons was also not returned. Thereby, all those persons<\/p>\n<p>were cheated by petitioners in furtherance of common intention.<\/p>\n<p>Several crimes were registered against the accused on complaints<\/p>\n<p>of different persons. This is one such complaint.<\/p>\n<p id=\"p_2\">      3. Learned counsel for petitioner submitted that petitioner<\/p>\n<p>is the second accused and he has not issued any receipts to de<\/p>\n<p>facto complainant and petitioner&#8217;s custodial interrogation is not<\/p>\n<p>necessary in this case.\n<\/p>\n<p id=\"p_3\">      4.   This petition is strongly opposed. Learned Public<\/p>\n<p>Prosecutor submitted that           21 cases are already registered<\/p>\n<p>against petitioner for similar crimes. Several persons are cheated<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A No.3357 OF 2010                2<\/span><\/p>\n<p>by petitioner and first accused. Receipts were also issued for<\/p>\n<p>having received money and investigation is in progress and<\/p>\n<p>petitioner&#8217;s custodial interrogation is necessary to ascertain<\/p>\n<p>several facts relating to the offence. This is not a fit case to grant<\/p>\n<p>anticipatory bail.\n<\/p>\n<p id=\"p_4\">      5. On hearing both sides,        I find that the complicity of<\/p>\n<p>petitioner in the offence can be better revealed by custodial<\/p>\n<p>interrogation and it is necessary that he is subjected to custodial<\/p>\n<p>interrogation. Considering the serious nature of allegations made.<\/p>\n<p>I do not think that this is a fit case to grant anticipatory bail.<\/p>\n<p>Petitioner is implicated in several cases instituted by different<\/p>\n<p>persons for having acted in similar manner and cheating the<\/p>\n<p>various    persons.
