By virtue<br \/>\n\tof the impugned judgment and order rendered by the learned trial<br \/>\n\tJudge, the appellant who was original accused in the aforesaid<br \/>\n\tsessions case came to be convicted for the offence punishable under<br \/>\n\t<a href=\"\/doc\/455468\/\" id=\"a_1\">Section 307<\/a> of the Indian Penal Code (&#8216;<a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a>&#8216;, for short) and was<br \/>\n\tsentenced to undergo rigorous imprisonment for 10 years and fine of<br \/>\n\tRs.1000\/-, in default to undergo further imprisonment for 6 months.<br \/>\n\tBeing aggrieved and dissatisfied with the impugned judgment and<br \/>\n\torder, the original accused preferred this appeal.\n<\/p>\n<p id=\"p_1\">The<br \/>\n\tprosecution case in nutshell is as under:-\n<\/p>\n<p id=\"p_2\">\t\tThe<br \/>\n\t\tincident occurred at about 2 a.m. during night hours on dated<br \/>\n\t\t11.11.2000 in the field of injured Girishbhai Harmanbhai situated<br \/>\n\t\tin the outskirts of village Garmala, Tal.Matar, Dist.Kheda. The<br \/>\n\t\tappellant-accused had mortgaged his land with  injured Girishbhai<br \/>\n\t\tand had borrowed money from Girishbhai. Subsequently, the accused<br \/>\n\t\thad repaid the money of Girishbhai. Still, however, the accused<br \/>\n\t\tused to demand Rs.100\/- from Girishbhai, to which Girishbhai<br \/>\n\t\trefused. Thereupon, at the time and place of the incident, the<br \/>\n\t\taccused inflicted blows of handle of diesel engine on the head of<br \/>\n\t\tGirishbhai. Girishbhai sustained serious bodily injuries and he was<br \/>\n\t\timmediately removed to the hospital. From the time he sustained<br \/>\n\t\tserious bodily injuries in his head, he became unconscious and he<br \/>\n\t\tregained consciousness after about 4 months. In connection with<br \/>\n\t\tthis offence, Vinubhai Harmanbhai, brother of injured Girishbhai<br \/>\n\t\tlodged First Information Report (&#8216;FIR&#8217;, for short) in Matar Police<br \/>\n\t\tStation. The FIR was registered and the police investigation was<br \/>\n\t\tcommenced, statements of material witnesses were recorded by the<br \/>\n\t\tpolice, clothes of the accused and of injured Girishbhai were<br \/>\n\t\trecovered by drawing panchnamas, weapon used in this offence i.e.<br \/>\n\t\tmetal handle of diesel engine was recovered at the instance of the<br \/>\n\t\taccused by drawing discovery panchnama, necessary muddamal articles<br \/>\n\t\twere sent to FSL for analysis, medical certificates of the injured\n<\/p>\n<p id=\"p_3\">\t\t&#8211; Girishbhai were obtained. After completion of the police<br \/>\n\t\tinvestigation, chargesheet came to be filed in the Court of learned<br \/>\n\t\tJMFC, Matar, for the offence punishable under <a href=\"\/doc\/455468\/\" id=\"a_2\">Section 307<\/a> of the<br \/>\n\t\tIPC. As the offence was exclusively triable by the Court of<br \/>\n\t\tSessions, learned Magistrate committed the case to the Court of<br \/>\n\t\tSessions at Nadiad.\n<\/p>\n<p id=\"p_4\">\t\tThe<br \/>\n\t\tlearned trial Judge framed charge against the accused at Exh.8 for<br \/>\n\t\tthe offence punishable under <a href=\"\/doc\/455468\/\" id=\"a_3\">Section 307<\/a> of the IPC, to which the<br \/>\n\t\taccused did not plead guilty and claimed to be tried. Thereupon,<br \/>\n\t\tthe prosecution adduced its oral and documentary evidence. After<br \/>\n\t\tthe completion of the evidence, the learned trial Judge recorded<br \/>\n\t\tfurther statement of the accused under <a href=\"\/doc\/767287\/\" id=\"a_4\">Section 313<\/a> of the Cr.P.C.<br \/>\n\t\tand the accused in his further statement denied generally all the<br \/>\n\t\tallegations levelled against him and stated that he was falsely<br \/>\n\t\timplicated in this case.\n<\/p>\n<p id=\"p_5\">\t\tAfter<br \/>\n\t\tappreciating the oral and documentary evidence adduced by the<br \/>\n\t\tprosecution and after considering the arguments advanced by both<br \/>\n\t\tthe sides, the learned trial Judge delivered the impugned judgment,<br \/>\n\t\twhereby he was pleased to convict the accused for the offence<br \/>\n\t\tpunishable under <a href=\"\/doc\/455468\/\" id=\"a_5\">Section 307<\/a> of the IPC and awarded sentence as<br \/>\n\t\thereinabove described, hence the appeal.\n<\/p>\n<p id=\"p_6\">During<br \/>\n\tthe course of arguments, learned advocate Mr.Borad for the appellant<br \/>\n\t  accused submitted that the impugned judgment delivered by the<br \/>\n\tlearned trial Judge is contrary to law and evidence  on record. That<br \/>\n\tas a matter of fact, the prosecution failed to prove its case beyond<br \/>\n\tany reasonable doubt against accused. It is submitted that the<br \/>\n\tpolice recorded statement of injured- Girishbhai after about belated<br \/>\n\tdelay of 4 months. That the entire prosecution case rests upon the<br \/>\n\tdepositions of injured-Girishbhai, first informant Vinubhai and<br \/>\n\tDakshaben, who happens to be the wife of injured Girishbhai. That<br \/>\n\tthe evidence adduced by all these three witnesses is full of<br \/>\n\tcontradictions and improvements. That the prosecution alleged that<br \/>\n\tafter committing the offence, the accused went to the house of<br \/>\n\tinjured Girishbhai and told his wife Dakshaben that he had killed<br \/>\n\tGirishbhai. That such story advanced by the prosecution is quite<br \/>\n\tunnatural and cannot be relied upon. That even considering the<br \/>\n\tocular evidence adduced by the prosecution and the medical evidence<br \/>\n\ton record, there are material contradictions between the two sets of<br \/>\n\tevidence. It is submitted that the medical evidence reveals that the<br \/>\n\tinjuries on the head of Girishbhai could have been caused by some<br \/>\n\tsharp cutting instrument, whereas the prosecution has come forward<br \/>\n\twith the case that the accused inflicted handle of diesel engine on<br \/>\n\tthe head of Girishbhai, which is admittedly not sharp cutting<br \/>\n\tinstrument, but, hard and blunt object. Therefore, it is submitted<br \/>\n\tthat the appeal be allowed and the conviction recorded by the<br \/>\n\tlearned trial Judge be set-aside and the appellant   accused be<br \/>\n\tacquitted.\n<\/p>\n<p id=\"p_7\">Learned<br \/>\n\tAPP Mr.Bhatt vehemently opposed this appeal and submitted that<br \/>\n\tconsidering the deposition of injured witness Girishbhai, the<br \/>\n\tprosecution successfully proved its case. That the deposition of<br \/>\n\tGirishbhai gets support from the testimonies of first informant<br \/>\n\tVinubhai and Dakshaben. That the medical evidence reveals that the<br \/>\n\tinjury sustained by Girishbhai was so severe that from the time he<br \/>\n\tsustained injury, till four months throughout his medical treatment,<br \/>\n\the remained unconscious and as per the medical opinion, the injuries<br \/>\n\twere sufficient in ordinary course of nature to cause death. It is<br \/>\n\tsubmitted that miraculously and due to timely treatment, Girishbhai<br \/>\n\tcould be saved. Therefore, it is submitted that the appeal be<br \/>\n\tdismissed.\n<\/p>\n<p id=\"p_8\">We<br \/>\n\thave given our thoughtful considerations to the submissions made on<br \/>\n\tbehalf of both the sides. Considering the deposition of injured<br \/>\n\tGirishbhai, Exh.45, he narrated the incident in his deposition and<br \/>\n\tclearly stated that during night hours, when he was in his field,<br \/>\n\tthe accused came to his field and inflicted blows of handle of<br \/>\n\tdiesel engine on his head. Before the trial Court as well as at the<br \/>\n\ttime of arguments before this Court on behalf of the appellant<br \/>\n\taccused it is submitted that the incident took place during night<br \/>\n\thours and admittedly, no electric light was on, and therefore, the<br \/>\n\tprosecution failed to establish the identity of the accused.<br \/>\n\tHowever, in the impugned judgment, the learned trial Judge rightly<br \/>\n\tobserved that it was a moonlit night and the accused was not unknown<br \/>\n\tto Girishbhai, because not only there was money transaction between<br \/>\n\tthe two in past, but, even the accused was working in the field of<br \/>\n\tGirishbhai. Considering the deposition of injured Girishbhai, the<br \/>\n\treasonings assigned by the learned trial Judge in his judgment about<br \/>\n\tthe identity of the accused, gets ample support. Further,<br \/>\n\tconsidering the deposition of Girishbhai, there was verbal exchanges<br \/>\n\tbetween himself and the accused before Girishbhai sustained<br \/>\n\tinjuries.\n<\/p>\n<p id=\"p_9\">Furthermore,<br \/>\n\t\tconsidering the deposition of witness Dakshaben Girishbhai, Exh.31,<br \/>\n\t\tshe stated that on the night when the incident occurred, she was at<br \/>\n\t\ther home and was sleeping, but, she heard noise on the roof of her<br \/>\n\t\thouse and thereupon she was awakened and when she came out of her<br \/>\n\t\thouse, she saw that the accused had come there and the accused told<br \/>\n\t\ther that he had killed Girishbhai. Hearing the noise, even brother<br \/>\n\t\tof Girishbhai, Vinubhai had come to the house of Dakshaben and when<br \/>\n\t\tthe accused told Dakshaben that he had killed Girishbhai, at that<br \/>\n\t\ttime witness Vinubhai was also there. Considering the deposition of<br \/>\n\t\twitness Vinubhai Harmanbhai, Exh.39, he stated that he is brother<br \/>\n\t\tof injured Girishbhai and that on the night of the incident, when<br \/>\n\t\the heard noise on the roof of the house of Girishbhai, he went to<br \/>\n\t\tthe house of Girishbhai and Girishbhai&#8217;s wife Dakshaben was there<br \/>\n\t\tand at that time the accused came near the house and the accused<br \/>\n\t\ttold Dakshaben that he had killed Girishbhai. He stated that<br \/>\n\t\tthereupon he himself and one Pradeepbhai went to the field of<br \/>\n\t\tGirishbhai and they saw Girishbhai lying in his field, in injured<br \/>\n\t\tposition.\n<\/p>\n<p id=\"p_10\">Under<br \/>\n\tsuch circumstances, considering the depositions of injured<br \/>\n\tGirishbhai, his wife Dakshaben and his brother first informant<br \/>\n\tVinubhai, we are of the opinion that the prosecution successfully<br \/>\n\tproved the involvement of the accused in this offence. Learned<br \/>\n\tadvocate Mr.Borad submitted that in her cross-examination, witness<br \/>\n\tDakshaben stated that on the night of the incident, accused had<br \/>\n\tnever come to her house. We are of the opinion that the deposition<br \/>\n\tof a witness is to be considered as a whole. The cross-examination<br \/>\n\tof Dakshaben made on behalf of the accused runs into pages. It is<br \/>\n\ttrue that Dakshaben stated that on the night of the incident,<br \/>\n\taccused did not come in her house. However, the material aspect is<br \/>\n\tthat when Dakshaben heard some noise on the roof of her house, she<br \/>\n\tcame out from her house and therefore, she saw the accused. Thus,<br \/>\n\tthe accused met her outside her house and at that place the accused<br \/>\n\ttold her that he had killed Girishbhai and at that time the first<br \/>\n\tinformant Vinubhai was present.\n<\/p>\n<p id=\"p_11\">Considering<br \/>\n\tthe medical evidence on record and especially looking to the<br \/>\n\tdeposition of Dr.Chandana, Exh.51, and the injury certificate,<br \/>\n\tExh.52, it transpires that in all seven injuries were sustained by<br \/>\n\tGirishbhai on his head. The injuries were on temporal region and<br \/>\n\tleft parietal occipital region, causing brain injury and avulsion<br \/>\n\tinjury on left ear. Considering the depositions of Dr.Suhas Vasudev,<br \/>\n\tExh.41, Dr.Amin, Exh.46 and Dr.Dinesh Chandana, Exh.51 and the<br \/>\n\tcertificates issued by them, it clearly transpires that serious head<br \/>\n\tinjuries were sustained by Girishbhai, resulting into partial<br \/>\n\tparalysis and deafness in left ear. Under such circumstances,<br \/>\n\tconsidering the medical evidence on record, we are of the opinion<br \/>\n\tthat the learned trial Judge rightly observed that the prosecution<br \/>\n\tsuccessfully proved the offence punishable under <a href=\"\/doc\/455468\/\" id=\"a_6\">Section 307<\/a> of the<br \/>\n\tIPC.\n<\/p>\n<p id=\"p_12\">Considering<br \/>\n\tthe FSL report and especially the serological report, Exh.65, it<br \/>\n\ttranspires that the blood group of injured Girishbhai is Group<br \/>\n\t B . The blood marks were found on the handle used as weapon by<br \/>\n\tthe accused, as well as on the pant of the accused, and the FSL<br \/>\n\treport revealed that the blood mark was  B  Group. Thus, the<br \/>\n\tcircumstantial evidence supports the ocular evidence adduced by the<br \/>\n\tprosecution.\n<\/p>\n<p id=\"p_13\">In<br \/>\n\tlight of the above discussions and considering the impugned judgment<br \/>\n\tdelivered by the learned trial Judge and re-appreciating the entire<br \/>\n\tevidence adduced by the prosecution before the trial Court, we are<br \/>\n\tof the opinion that the learned trial Judge did not err in coming to<br \/>\n\tthe conclusion that the prosecution proved its case beyond any<br \/>\n\treasonable doubt against the accused. Therefore, there is no reason<br \/>\n\twhatsoever for this Court to interfere with the impugned judgment<br \/>\n\tand order rendered by the learned trial Judge.\n<\/p>\n<p id=\"p_14\">\tFor<br \/>\n\tthe foregoing reasons, the appeal deserves to be dismissed.
