KURIAKOSE, J.\n                    ----------------------------------\n                    W.P.(C) NO. 10166 of 2008\n                    ----------------------------------\n             Dated this the 4th       day of April , 2008\n\n                              JUDGMENT\n<\/pre>\n<p>      Sri.P.V.Kunikhikrishnan opposes the prayers in this writ petition.<\/p>\n<p>He drew my attention to the judgment of this court in         <a href=\"\/doc\/1066044\/\">Sayeesh<\/p>\n<p>Kumar v. State of Kerala<\/a> (2005 (4) KLT 1027) and submits that<\/p>\n<p>even the Government does not have power to allow zonal exemption.<\/p>\n<p>Per contra, Sri.Babu S.Nair drew my attention to the judgment of this<\/p>\n<p>court in Franchis v. Chalakkudy Municipality (1999(3) KLT 560).<\/p>\n<p>He also drew my attention to the judgment of the Division Bench of<\/p>\n<p>this Court in <a href=\"\/doc\/1115418\/\">Padmini v. State of Kerala<\/a> (1999 (3) KLT 465) and<\/p>\n<p>also the judgment of the Supreme Court in          <a href=\"\/doc\/1755100\/\">Raju Jethmalani &amp;<\/p>\n<p>others v. State of Maharashtra &amp; others<\/a> ( 2005 (11) SCC 222).<\/p>\n<p>The development plan has not been implemented in the Corporation<\/p>\n<p>though the same had been in existence for several decades, so<\/p>\n<p>submits the learned counsel.     It is seen from Ext.P1 that apart from<\/p>\n<p>the ground that if the permit is declined for zoning violation in terms<\/p>\n<p>of the sanctioned DTP scheme the ground that the NOC from the<\/p>\n<p>Public Works Department has not been produced is also raised.<\/p>\n<p>Sri.Babu S.Nair, the learned counsel for the petitioner submits that the<\/p>\n<p><span class=\"hidden_text\">WPC No.10166\/2008                    2<\/span><\/p>\n<p>petitioner will be able to produce NOC from            the Public Works<\/p>\n<p>Department if time is given.\n<\/p>\n<p>      2. Under the above circumstances, following the view taken by<\/p>\n<p>me in     writ petitions raising similar grounds, I dispose of this writ<\/p>\n<p>petition in the following terms;\n<\/p>\n<p>      i).  Ext.P1 is quashed and the petitioner is permitted to file an<\/p>\n<p>affidavit before the respondent Corporation stating unconditionally that<\/p>\n<p>they will not claim any compensation for the construction put up by<\/p>\n<p>them in the event of any notification under Section 4 (1) of the Land<\/p>\n<p>Acquisition Act being promulgated for acquisition of any portion of the<\/p>\n<p>petitioner&#8217;s   property for industrial or any other purposes within a<\/p>\n<p>period of one year from the date of filing the affidavit.<\/p>\n<p>      ii).  The petitioner will produce NOC from the Public Works<\/p>\n<p>Department.\n<\/p>\n<p>      Iii). If both the conditions are complied with, the Corporation<\/p>\n<p>will reconsider the plan and grant approval to the same if the plan is<\/p>\n<p>otherwise in order.\n<\/p>\n<p>                                                PIUS C.
