SHRI SHASHI SEKHAR PRASAD SINGH, HEAD MASTER, MIDDLE\n     SCHOOL, ALABALPUR, FATUHA, PATNA\n  ............................................................CONTEMNORS\/OPPOSITE PARTIES\n                                *********\n<\/pre>\n<p id=\"p_1\"> 5   03\/11\/2010           Heard learned Counsel for the petitioner and the<\/p>\n<p>                  Opposite Parties.\n<\/p>\n<p id=\"p_1\">                          A   show    cause   has   been    filed   containing<\/p>\n<p>                  Annexure-A dated 02.09.2009 which has purportedly<\/p>\n<p>                  been passed in compliance of the order of this court.<\/p>\n<p id=\"p_2\">                          It appears that the petitioner is not satisfied with<\/p>\n<p>                  the order contained in Annexure-A as it indicates that if<\/p>\n<p>                  the petitioner is dissatisfied, he can place his case before<\/p>\n<p>                  the District Superintendent of Education, Patna along<\/p>\n<p>                  with the relevant documents, who will consider his case<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                           -2-<\/span><\/p>\n<p>        in accordance with the 1993 Rules for promotion.<\/p>\n<p id=\"p_3\">                  It is obvious that the option given to the<\/p>\n<p>        petitioner is not a satisfactory option, however, some sort<\/p>\n<p>        of reasonings has been mentioned in Annexure-A,<\/p>\n<p>        wherein it has been stated that the petitioner was only<\/p>\n<p>        entitled for promotion in accordance with the vacancies<\/p>\n<p>        and his position in the gradation list. This is the main<\/p>\n<p>        aspect which has to be considered. The fact that other<\/p>\n<p>        juniors   were   granted   promotion,    according   to   the<\/p>\n<p>        authorities, cannot be a criteria for grant of any further<\/p>\n<p>        promotion.
