The Panchayat Sewak, Gram Panchayat Raj Jhahuri Distt.-\n         Madhubani\n                                             -----------\n<\/pre>\n<p id=\"p_1\">5.   19.10.2011             Heard learned counsel for the petitioners and<\/p>\n<p>                  the State.\n<\/p>\n<p id=\"p_1\">                            Counter affidavit has been filed on behalf of<\/p>\n<p>                  respondent nos. 4 to 6. No counter affidavit has been<\/p>\n<p>                  filed on behalf of the Commissioner, Darbhanga<\/p>\n<p>                  Division, respondent no. 2.\n<\/p>\n<p id=\"p_2\">                            It is submitted that the petitioners were<\/p>\n<p>                  working      as an Anganwari Sewika and Sahayika in<\/p>\n<p>                  Jhahuri Panchayat Mallahi Tolla Centre No. 137. They<\/p>\n<p>                  were terminated by the order of the District Magistrate<\/p>\n<p>                  dated 26.10.2009 as communicated to them on<\/p>\n<p>                  5.11.2009.     The petitioners were also heard by the<\/p>\n<p>                  District Magistrate. In C.W.J.C. No. 18074 of 2009<\/p>\n<p>                  preferred by the petitioners, on an objection by the<\/p>\n<p>                  State to the remedy of appeal available before the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                   2<\/span><\/p>\n<p>Commissioner of the Division, the application was<\/p>\n<p>disposed with directions to avail the alternative remedy<\/p>\n<p>along with additional observation that if they seek<\/p>\n<p>interim relief, the latter application was required to be<\/p>\n<p>disposed off within a period of two weeks as distinct<\/p>\n<p>from the disposal of the appeal itself.<\/p>\n<p id=\"p_3\">        It is submitted that the petitioners filed such<\/p>\n<p>Appeal on 25.5.2010 numbered as 63 of 2010 and<\/p>\n<p>further sought stay of process for further appointment.<\/p>\n<p>The Commissioner however has not passed any orders<\/p>\n<p>on the stay application even while the respondents are<\/p>\n<p>proceeding ahead for fresh selection in pursuance of<\/p>\n<p>an   advertisement    published    on     19.5.2010.   The<\/p>\n<p>submission therefore is that the application for interim<\/p>\n<p>relief cannot be rendered infructuous by refusing to<\/p>\n<p>decide the same and then perhaps urge that in the<\/p>\n<p>changed circumstances and fresh appointments made,<\/p>\n<p>their grievance had become infructuous.<\/p>\n<p id=\"p_4\">        The counter affidavit on behalf of respondent<\/p>\n<p>nos. 4 to 6 dealing with the assertions with regard to<\/p>\n<p>the pendency of the appeal and the interim application<\/p>\n<p>states that they are matters of record and need no<\/p>\n<p>comment.\n<\/p>\n<p id=\"p_5\">        The writ petition was filed nearly one year<\/p>\n<p>three months ago but no counter affidavit has been<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               3<\/span><\/p>\n<p>           filed by the Commissioner.     Counsel for the State is<\/p>\n<p>           unable to assist the Court as to what has happened to<\/p>\n<p>           the Appeal or the application for interim relief. On<\/p>\n<p>           10.6.2010 this Court had passed interim orders for<\/p>\n<p>           two posts to be kept vacant till the disposal of the writ<\/p>\n<p>           application or the Appeal filed by the petitioners.<\/p>\n<p id=\"p_6\">                   Since the Commissioner failed to assist the<\/p>\n<p>           Court by placing on record either that the application<\/p>\n<p>           for interim relief has been disposed or that the Appeal<\/p>\n<p>           itself has been disposed, the interim order dated<\/p>\n<p>           10.6.2010 is made absolute to the extent till the<\/p>\n<p>           Appeal is not decided, the posts on which the<\/p>\n<p>           petitioners were working shall be kept vacant to be<\/p>\n<p>           filled up in accordance with law subject to the final<\/p>\n<p>           order in Appeal.\n<\/p>\n<p id=\"p_7\">                   It is now for the Commissioner to decide how<\/p>\n<p>           soon he would like to dispose the Appeal.<\/p>\n<p id=\"p_8\">                   It shall be obligatory for the petitioners to<\/p>\n<p>           place this order before the Commissioner within a<\/p>\n<p>           maximum period of two weeks from today failing which<\/p>\n<p>           the writ application shall be deemed to have been<\/p>\n<p>           dismissed and the Commissioner shall be under no<\/p>\n<p>           further obligation.\n<\/p>\n<p id=\"p_9\">                     The writ application stands disposed.<\/p>\n<pre id=\"pre_1\">P.
