Verma, Advocate.\n       Respondents by Shri Rajeshwar Rao, Advocate.<\/pre>\n<p>       This is an appeal on behalf of the appellant\/plaintiff<br \/>\nagainst the order dated 15.10.09 whereby the trail Court<br \/>\nhas rejected the application filed by the appellant\/plaintiff<br \/>\nunder Order 39 rule 1 and 2 CPC.\n<\/p>\n<p>       The appellant\/plaintiff is running coaching classes<br \/>\nfor    IIT-JEE\/AIEEE\/PMT          by    the    name    MOMENTUM<br \/>\nCoaching Classes. This name MOMENTUM along with the<br \/>\nlogo is registered as a trade mark in favour of the<br \/>\nappellant\/plaintiff through the Trade Marks Registry.\n<\/p>\n<p>       There is no dispute in the present case prior to the<br \/>\nregistration of the Trade Mark by the present appellant<br \/>\nunder Section 23(2) Rule 62(1) of Trade Marks Act, 1999,<br \/>\nboth i.e. plaintiff as well as the defendant were using the<br \/>\nsame trade mark. Subsequently, the appellant\/plaintiff got<br \/>\nregistration of Trade Mark and thereafter a suit was filed<br \/>\nthat since the appellant\/plaintiff has got the registration<br \/>\ntherefore, the respondent\/defendant cannot be permitted<br \/>\nto    use   the   trade    mark    of    the   plaintiff.   Injunction<br \/>\napplication was filed which was also rejected.\n<\/p>\n<p>       The appellant heavily relied upon the judgment<br \/>\npassed by the Apex Court in AIR 2005 SC 1999 Dhariwal<br \/>\nIndustries        Ltd. And another Vs. M\/s. M.S.S. Food<br \/>\nProducts and on this basis it is submitted that the claim<br \/>\nfor grant of injunction can be made in respect of<br \/>\nunregistered trade mark also. There is no dispute to the<br \/>\npreposition and to the ratio laid down by the Apex Court<br \/>\nbut the question in the present case is that if prior to<br \/>\n registration of trade mark by the appellant\/plaintiff, the<br \/>\nsame trade mark was used by the respondent and at that<br \/>\ntime, no one got the registration of its trade mark. The<br \/>\nregistration of the trade mark was subsequently obtained<br \/>\nin the year 2005 by the plaintiff and prior to 2005, both<br \/>\nplaintiff and the defendant were using the same trade<br \/>\nmark then on the basis of the aforesaid facts, the<br \/>\napplicability of Section 34 of the Trade Marks Act, 1999<br \/>\nbeing a saving clause, save for the vested rights and<br \/>\naccordingly reads as under:-\n<\/p>\n<blockquote><p>     &#8220;34.      Saving for vested rights. Nothing in<br \/>\n     this Act shall entitle the proprietor or a<br \/>\n     registered user of registered trade mark to<br \/>\n     interfere with or restrain the use by any<br \/>\n     person of a trade mark identical with or<br \/>\n     nearly resembling it in relation to goods or<br \/>\n     services in relation to which that person or a<br \/>\n     predecessor in title of his has continuously<br \/>\n     used that trade mark from a date prior-\n<\/p><\/blockquote>\n<blockquote><p>     (a)       to the use of the first-mentioned trade<br \/>\n     mark in relation to those goods or services<br \/>\n     be the proprietor or a predecessor in title oh<br \/>\n     his; or<\/p>\n<\/blockquote>\n<blockquote><p>     (b)       to the date of registration of the first-<br \/>\n     mentioned trade mark in respect of those<br \/>\n     goods or services in the name of the<br \/>\n     proprietor of a predecessor in title of his;\n<\/p><\/blockquote>\n<blockquote><p>     whichever is the earlier, and the Registrar<br \/>\n     shall not refuse (on such use being proved)<br \/>\n     to register the second mentioned trade mark<br \/>\n       by reason only of the registration of the first<br \/>\n      mentioned trade mark.&#8221;<\/p><\/blockquote>\n<p>      It is to be seen that the Apex Court in case of<br \/>\nDhariwal Industries            Ltd. (supra) has not taken into<br \/>\naccount Section 34 of the Trade Mark Act, 1999 and has<br \/>\ntaken into account Section 135, 27 and 29 of the said Act.<br \/>\nPrima facie it appears that Section 34 starts with &#8220;Saving<br \/>\nfor vested rights&#8221; with the words &#8220;Nothing in this Act shall<br \/>\nentitle the proprietor entitle the proprietor or a registered<br \/>\nuser of registered trade mark to interfere with or restrain the<br \/>\nuse by any person of a trade mark identical with or nearly<br \/>\nresembling it in relation to goods or services in relation to<br \/>\nwhich that person or a predecessor in title of his has<br \/>\ncontinuously used that trade mark from a date prior-\n<\/p>\n<blockquote><p>      (a)       to the use of the first-mentioned trade<br \/>\n      mark in relation to those goods or services<br \/>\n      be the proprietor or a predecessor in title oh<br \/>\n      his; or<\/p>\n<\/blockquote>\n<blockquote><p>      (b)       to the date of registration of the first-<br \/>\n      mentioned trade mark in respect of those<br \/>\n      goods or services in the name of the<br \/>\n      proprietor of a predecessor in title of his;\n<\/p><\/blockquote>\n<p>whichever is the earlier, and the Registrar shall not refuse (on<br \/>\nsuch use being proved) to register the second mentioned trade<br \/>\nmark by reason only of the registration of the first mentioned<br \/>\ntrade mark.&#8221;\n<\/p>\n<p>      It is to be seen that in case of Dhariwal Industries<br \/>\n(supra), the question before the Court was involved with<br \/>\nregard to use of Trade Mark by unregistered dealers. In<br \/>\nthe present case, the question is that when before<br \/>\nregistration both the parties were using the same Trade<br \/>\n Mark and the appellant\/plaintiff got registration thereafter<br \/>\nof the said trade mark then the Apex Court has no<br \/>\noccasion eventually to consider the effect of Section 34<br \/>\nof    the   Act   which   has   already   been     reproduced<br \/>\nhereinabove. Therefore, at this stage, it is doubtful that<br \/>\nthe case of Dhariwal (supra) as such applies in the facts<br \/>\nand circumstance of the present case.\n<\/p>\n<p>       On the basis of the aforesaid saving clause and also<br \/>\nkeeping in view the facts that in case of Dhariwal<br \/>\nIndustries (supra), the Apex Court has not taken into<br \/>\nconsideration Section 34 of the Act, I am of the view that<br \/>\nprima facie it appears that Section 34 applies in favour of<br \/>\nthe defendant and accordingly, the trial Court was<br \/>\njustified in rejecting the application for injunction and no<br \/>\ncase for interference is made out.\n<\/p>\n<p>       However, I direct the trial Court to decide the suit<br \/>\nwithin a period of 8 months from the date the certified<br \/>\ncopy of this order is submitted.\n<\/p>\n<p>       The parties shall not seek unnecessary adjournment.<br \/>\nAccordingly, the appeal stands disposed of.\n<\/p>\n<p>                                                 (R.K.
