     Petitioner is the wife of one late K.M. Anto. Petitioner has<\/p>\n
approached this Court seeking payment of monthly pension due<\/p>\n
to the petitioner’s husband together with arrears and the amount<\/p>\n
due to him as Provident Fund with statutory interest as also Staff<\/p>\n
Welfare Fund.        She also seeks payment of DCRG and<\/p>\n
Commuted Value of Pension due to her husband. She further<\/p>\n
seeks payment of arrears of family pension and interest at 12 per<\/p>\n
cent on the delayed payment of retiral benefits, as also family<\/p>\n
pension due to her.\n<\/p>\n
     2.     A Statement has been filed on behalf of the<\/p>\n
respondents, wherein it is stated as follows:<\/p>\n
               “2. It is submitted that Sri. K.M. Anto,<\/p>\n
        Painter, Regional Workshop, Mavelikkara was<\/p>\n
        on unauthorized absence from 04.11.1991. Due<\/p>\n
        to his unauthorized absence, he was proceeded<\/p>\n
        and awarded with punishment of compulsory<\/p>\n

        retirement vide order dated 12.04.1996 (Ext.P1).<\/p>\n
        He has not submitted P.F. Closure application,<\/p>\n
        which is a mandatory requirement for final<\/p>\n
        settlement of his Provident Fund. He expired on<\/p>\n
        03.07.1999.     His legal heir has also not<\/p>\n
        submitted P.F. Closure application.      After 9<\/p>\n
        years, his wife approached this Honourable<\/p>\n
        Court praying for immediate payment of P.F.<\/p>\n
        Closure amount with interest. It is submitted<\/p>\n
        that P.F. closure application and connected<\/p>\n
        documents were not submitted either by the<\/p>\n
        employee or by the legal heir till date. Even<\/p>\n
        though the petitioner was directed to produce the<\/p>\n
        P.F.   Closure    application   and    connected<\/p>\n
        document4s, the same was not produced till date,<\/p>\n
        which is mandatory requirement as per Rule 15<\/p>\n
        (4) of the G.P.F. Rules. Hence this matter is<\/p>\n
        pending.\n<\/p><\/blockquote>\n
              3. It is submitted that the DCRG due to<\/p>\n
        Smt. Thankamma Anto, Painter will be released<\/p>\n
        within two weeks.    The family pension to the<\/p>\n
        petitioner has been sanctioned with effect from<\/p>\n
        03.07.1999 and she is availing family pension<\/p>\n
        from Chalakudy Unit. The rest of the claims if<\/p>\n

         any will be settled on verification of the<\/p>\n
         records.”<\/p><\/blockquote>\n

      3. I heard the learned counsel for the petitioner and also<\/p>\n
the learned standing counsel appearing for the respondent<\/p>\n
Corporation.   As far as DCRG is concerned, recording the<\/p>\n
Statement, there will be a direction to the first respondent to pay<\/p>\n
the amount representing DCRG due to the petitioner in<\/p>\n
accordance with law within two weeks from the date of receipt<\/p>\n
of a copy of this Judgment. As far as PF closure application is<\/p>\n
concerned, counsel for petitioner submits that actually the<\/p>\n
petitioner had given all the documents, but the petitioner is<\/p>\n
willing to submit the application seeking payment of Provident<\/p>\n
Fund.    If the petitioner submits application for closure of<\/p>\n
Provident Fund, the amount due to the petitioner as Provident<\/p>\n
Fund will be paid to her by the first respondent in accordance<\/p>\n
with law within a period of one month from the date of<\/p>\n
submission of the application. The amount due to the petitioner<\/p>\n
as Staff Welfare Fund will be paid to the petitioner by the first<\/p>\n
respondent within one month from the date of receipt of a copy<\/p>\n

of this Judgment. Regarding monthly pension together with<\/p>\n
arrears, if the petitioner files a representation before the first<\/p>\n
respondent, the first respondent will consider and take a decision<\/p>\n
thereon within two months of receipt of the representation. The<\/p>\n
amount due to petitioner as Commuted Value of Pension will<\/p>\n
also be paid within a period of two months from the date of<\/p>\n
receipt of a copy of this Judgment by the first respondent.<\/p>\n
Regarding arrears of family pension, if the petitioner moves a<\/p>\n
representation before the first respondent, the first respondent<\/p>\n
will consider and take a decision thereon in accordance with law<\/p>\n
within two months from the date of receipt of                  the<\/p>\n
representation.\n<\/p>\n
