DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">This<br \/>\n\tapplication is filed by the applicant \/ accused no.1 under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section<br \/>\n\t439<\/a> of the Code of Criminal Procedure in connection with First<br \/>\n\tInformation Report registered as I-C.R. No.84\/2010 with Mundra<br \/>\n\tPolice Station, Mundra, District Kutch for the offences punishable<br \/>\n\tunder <a href=\"\/doc\/1133601\/\" id=\"a_1\">Sections 325<\/a>, <a href=\"\/doc\/455468\/\" id=\"a_2\">307<\/a>, <a href=\"\/doc\/555306\/\" id=\"a_3\">504<\/a>, <a href=\"\/doc\/180217\/\" id=\"a_4\">506(2)<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_5\">114<\/a> of Indian Penal Code.\n<\/p>\n<p id=\"p_1\">Mr.\n<\/p>\n<p id=\"p_2\">\tS.V. Raju learned Senior Counsel submitted that the applicant is<br \/>\n\tarrested on 27.12.2010, that he was admitted in Ashirvad Hospital,<br \/>\n\tBhuj being a patient of chronic renal failure and has undergone<br \/>\n\tdialysis.  It is further submitted on 18.06.2008 coronary<br \/>\n\tangiography was done and on 16.09.2008 one of the kidneys of the<br \/>\n\tapplicant was transplanted at Civil Hospital, Ahmedabad and has<br \/>\n\tundergone dialysis almost for 174 times in the years 2008 and 2009.<br \/>\n\tIt is further submitted that the version of the complainant in the<br \/>\n\tFIR is full of lies and not supported during course of<br \/>\n\tinvestigation.  What is stated in the FIR about injuries caused by<br \/>\n\tinflicting a blow of sword is not confirmed and medical officer of<br \/>\n\tCommunity Health Centre, Mundra-Kutch who has noticed the injuries<br \/>\n\tonly mentions about the incisive wound on the left hand of the<br \/>\n\tcomplainant and nothing more was disclosed.  No any other injury was<br \/>\n\tnoticed.  However, the certificate issued by the Doctor of a private<br \/>\n\thospital cannot be relied at the stage of considering the case of<br \/>\n\tthe applicant for bail. On the contrary, it is submitted that the<br \/>\n\tinvestigation need to be carried out in a free and fair manner by<br \/>\n\tconsidering all relevant aspects.  It is also submitted that<br \/>\n\tconsidering various elements of the case coupled with the above<br \/>\n\taspect and only injury on the hand of the complainant, he may be<br \/>\n\tenlarged on bail.\n<\/p>\n<p id=\"p_3\">Mr.\n<\/p>\n<p id=\"p_4\">\tB.Y. Mankad learned Advocate for the complainant has opposed grant<br \/>\n\tof bail on the ground that the applicant herein has inflicted injury<br \/>\n\ton a witness of the case and he is involved in a serious crime<br \/>\n\tpunishable with severe punishment and ordinarily, this Court would<br \/>\n\tnot like to examine nature of injuries etc. at the stage of bail. It<br \/>\n\tis further submitted that the applicant herein was absconding and an<br \/>\n\tapplication was submitted by the Investigating Officer under <a href=\"\/doc\/1437597\/\" id=\"a_6\">Section<br \/>\n\t70<\/a> of the Criminal Procedure Code and warrant was also issued by the<br \/>\n\tauthority.  It is therefore, submitted that considering the overall<br \/>\n\tfacts and that the applicant herein is an influential and head<br \/>\n\tstrong person, he cannot be enlarged on bail.\n<\/p>\n<p id=\"p_5\">It<br \/>\n\tis further submitted that considering the conduct and behaviour of<br \/>\n\tthe applicant who has abused the process of law, he does not deserve<br \/>\n\tany relief by this Court. In view of the pendency of various cases<br \/>\n\twith different C.R.&#8217;s which reflect to the nature and character of<br \/>\n\tthe applicant who is not a law abiding citizen and therefore, he<br \/>\n\tdoes not deserve any relief.\n<\/p>\n<p id=\"p_6\">I<br \/>\n\thave heard learned APP   Mr. A.J. Desai, who submitted that<br \/>\n\tconsidering the overall facts and circumstances, the applicant does<br \/>\n\tnot deserve any bail.\n<\/p>\n<p id=\"p_7\">In<br \/>\n\tthe rejoinder, Mr. S.V. Raju learned Senior Counsel submits that out<br \/>\n\tof the four cases which was registered prior to 2001, the petitioner<br \/>\n\twas acquitted and the other cases are pertaining to <a href=\"\/doc\/555306\/\" id=\"a_7\">Section 504<\/a> and<br \/>\n\t<a href=\"\/doc\/180217\/\" id=\"a_8\">506(2)<\/a> IPC.\n<\/p>\n<p id=\"p_8\">Considering<br \/>\n\tthe overall facts and circumstances of the case and considering the<br \/>\n\tprinciples laid down by the Hon&#8217;ble Apex Court with regard to<br \/>\n\texercise of powers under <a href=\"\/doc\/1290514\/\" id=\"a_9\">Section 439<\/a> of the Criminal Procedure Code<br \/>\n\tin the case of <a href=\"\/doc\/1886518\/\" id=\"a_10\">Jayendra  Saraswathi Swamigal v. State of<br \/>\n\tTamilnadu<\/a> reported in (2005)2 SCC 13, I am<br \/>\n\tinclined to consider the case of the applicant on the ground that<br \/>\n\tthe applicant against whom the allegations are levelled, nature of<br \/>\n\tinjuries reflected from the Certificate dated 21.06.2010 issued by<br \/>\n\tthe Medical Officer, Class II show that it was on the left hand and<br \/>\n\tnot on the vital parts of the body and therefore, the injured was<br \/>\n\tdischarged from the hospital.  Besides, the applicant is available<br \/>\n\tfor trial and will co-operate with the investigation.  Besides,<br \/>\n\tconsidering the various elements as noticed earlier, by imposing<br \/>\n\tsuitable conditions the applicant is ordered to be enlarged on bail.\n<\/p>\n<p id=\"p_9\">Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p id=\"p_10\">In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith First Information Report registered as I-C.R. No.84\/2010 with<br \/>\n\tMundra Police Station, Mundra, District Kutch on executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) with one surety of the like<br \/>\n\tamount to the satisfaction of the Trial Court and subject to the<br \/>\n\tconditions that he shall;\n<\/p>\n<p id=\"p_11\">a)<br \/>\n\tnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p id=\"p_12\">b)<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_13\">c)<br \/>\n\tsurrender passport, if any, to the lower court within a week;\n<\/p>\n<p id=\"p_14\">d)<br \/>\n\tnot leave the State of Gujarat without prior permission of the<br \/>\n\tSessions Judge concerned;\n<\/p>\n<p id=\"p_15\">e)<br \/>\n\tmark presence at the concerned Police Station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p id=\"p_16\">f)<br \/>\n\tfurnish the present address of his residence to the Investigating<br \/>\n\tOfficer and also to the Court at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of this<br \/>\n\tCourt;\n<\/p>\n<p id=\"p_17\">g)<br \/>\n\tthe applicant shall not enter into the limits of Taluka Mundra and<br \/>\n\tTaluka Bhuj for a period of three months, except for marking<br \/>\n\tpresence or attending the trial.\n<\/p>\n<p id=\"p_18\">The<br \/>\n\tauthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p id=\"p_19\">If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p id=\"p_20\">Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p id=\"p_21\">At<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p id=\"p_22\">Rule<br \/>\n\tis made absolute to the aforesaid extent.
