Justice C.N.RAMACHANDRAN NAIR\n\n Dated :23\/11\/2007\n\n O R D E R\n                      C.N.RAMACHANDRAN NAIR, J.\n\n                      -----------------------------------\n\n              Contempt of Court Case No. 1660 of 2007\n\n                        --------------------------------\n\n             Dated, this the 23rd day of November, 2007\n\n\n                                J U D G M E N T\n<\/pre>\n<p id=\"p_1\">       Heard   learned   counsel   for   petitioner   and   learned   standing<\/p>\n<p>counsel for respondents.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       2.     The   contempt   of   court   case   is  filed   on   the   ground   that<\/p>\n<p>tax is recovered in violation of the stay order granted by this Court<\/p>\n<p>through   Annexure   A3   judgment.     Learned   standing   counsel<\/p>\n<p>submitted that recovery is made  in garnishee proceedings prior to<\/p>\n<p>the   judgment.         I   do   not   think   the   prayer   for   refund   can   be<\/p>\n<p>entertained in contempt proceedings.   In any case, since petitioner<\/p>\n<p>is a State Government undertaking, the assessment of which is set<\/p>\n<p>aside and remanded for reconsideration by the officer, there will be<\/p>\n<p>direction   to   the   officer   to   revise   the   assessment   in   terms   of<\/p>\n<p>tribunal&#8217;s   order,   within   a   period   of   three   weeks   from   the   date   of<\/p>\n<p>production   of   a   copy   of   this   judgment.
