No.12034 of 2011\n                                   BINOD KUMAR RAI\n                                            Versus\n                                  THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p id=\"p_1\">2.   28.04.2011.             Heard the learned counsels for the<\/p>\n<p>                   petitioner and the State.\n<\/p>\n<p id=\"p_1\">                             The petitioner being the member of<\/p>\n<p>                   the   Panchayat       Samiti    is    apprehending      his<\/p>\n<p>                   arrest in a case registered under <a href=\"\/doc\/1208971\/\" id=\"a_1\">Sections<\/p>\n<p>                   353<\/a>, <a href=\"\/doc\/1540253\/\" id=\"a_1\">326<\/a>, <a href=\"\/doc\/555306\/\" id=\"a_2\">504<\/a> and <a href=\"\/doc\/18766893\/\" id=\"a_3\">163<\/a> of the Indian Penal<\/p>\n<p>                   Code.\n<\/p>\n<p id=\"p_2\">                             The    accusation      is    that    when     the<\/p>\n<p>                   informant       being     the    Block        Development<\/p>\n<p>                   Officer     refused       to    give     no     objection<\/p>\n<p>                   certificate     for     construction     of    road    then<\/p>\n<p>                   the petitioner        misbehaved and threatened to<\/p>\n<p>                   kill and demanded Rs. 5,000\/- per month as<\/p>\n<p>                   extortion from the informant.<\/p>\n<p id=\"p_3\">                             It appears that for making available<\/p>\n<p>                   a land for construction of Community Hall,<\/p>\n<p>                   the petitioner requested the informant. The<\/p>\n<p>                   report of Karamchari was in favour of making<\/p>\n<p>                   available    the   land    in    question      which   was<\/p>\n<p>                   being maliciously delayed by the informant.<\/p>\n<p>                   It is further submitted that other employees<\/p>\n<p>                   have also complained against the informant<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                            2<\/span><\/p>\n<p>        before the learned Collector and the learned<\/p>\n<p>        Collector     has       also    taken     action      the<\/p>\n<p>        informant.\n<\/p>\n<p id=\"p_4\">                   Considering the background in which<\/p>\n<p>        the   present      case   has   been    lodged    clouds<\/p>\n<p>        bonafide      of       accusation       against       the<\/p>\n<p>        petitioner, let the petitioner, above named,<\/p>\n<p>        be released on bail in the event of arrest<\/p>\n<p>        or surrender before the learned court below<\/p>\n<p>        within a period of twelve weeks from today<\/p>\n<p>        in connection with Buxar(M) P.S. Case No. 49<\/p>\n<p>        of    2011    on       furnishing      bail   bond     of<\/p>\n<p>        Rs.10,000\/-(Ten Thousand) with two sureties<\/p>\n<p>        of the like amount each to the satisfaction<\/p>\n<p>        of the learned C.J.M. Buxar, subject to the<\/p>\n<p>        conditions as laid down under <a href=\"\/doc\/1692057\/\" id=\"a_4\">Section 438(2)<\/a><\/p>\n<p>        of the Code of Criminal Procedure.<\/p>\n<pre id=\"pre_1\">U.
