MOHANAN, J\n                         ----------------------\n                   Crl.R.P.No.2179 OF 2010\n                   -----------------------------------\n           Dated this the 3rd day of August, 2010\n\n\n                              O R D E R\n<\/pre>\n<p id=\"p_1\">      The accused in a prosecution for an offence u\/s.138 of<\/p>\n<p><a href=\"\/doc\/1132672\/\" id=\"a_1\">Negotiable Instruments Act<\/a> is the revision petitioner, as he is<\/p>\n<p>aggrieved by the order of conviction and sentence imposed by<\/p>\n<p>the courts below.\n<\/p>\n<p id=\"p_1\">      2. The case of the complainant is that, the accused\/revision<\/p>\n<p>petitioner, towards the discharge of a debt due to the<\/p>\n<p>complainant, issued a cheque dated 2.6.1996 for a sum           of<\/p>\n<p>Rs.1,50,000\/-, which when presented for encashment was<\/p>\n<p>dishonoured, due to the reason that there was no sufficient fund<\/p>\n<p>in the account maintained by the accused and the cheque amount<\/p>\n<p>was not repaid in spite of a formal demand notice and thus the<\/p>\n<p>revision petitioner has committed the offence punishable under<\/p>\n<p><a href=\"\/doc\/1823824\/\" id=\"a_1\">section 138<\/a> of Negotiable Instruments Act. With the said<\/p>\n<p>allegation, the complainant approached Judicial First Class<\/p>\n<p>Magistrate Court, Chavakkad, by filing a formal complaint, upon<\/p>\n<p>which cognizance was taken u\/s.138 of Negotiable instruments<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.R.P. No.2179\/10               2<\/span><\/p>\n<p>Act and instituted C.C.No.312\/1996 of Judicial First Class<\/p>\n<p>Magistrate Court, Chavakkad.        During the trial of the case,<\/p>\n<p>complainant himself was examined as PW1 and Exts.P1 to P10<\/p>\n<p>were marked.        From the side of defence Dws.1 to 4 were<\/p>\n<p>examined and produced Ext.D1 to D7.          On the basis of the<\/p>\n<p>available materials and evidence on record, the trial court has<\/p>\n<p>found that the cheque in question was issued by the revision<\/p>\n<p>petitioner\/accused for the purpose of discharging her debt due to<\/p>\n<p>the complainant.      Thus accordingly, the court held that the<\/p>\n<p>complainant        has  established   the   case     against   the<\/p>\n<p>accused\/revision petitioner and consequently found that the<\/p>\n<p>accused is guilty and thus convicted him u\/s.138 of <a href=\"\/doc\/1132672\/\" id=\"a_2\">Negotiable<\/p>\n<p>Instruments Act<\/a>. On such conviction, the trial court sentenced the<\/p>\n<p>accused\/revision petitioner to undergo simple imprisonment for<\/p>\n<p>one months and also sentenced to pay fine of Rs.5,000\/-. The<\/p>\n<p>default sentence is fixed as one month imprisonment.<\/p>\n<p id=\"p_2\">      3. In appeal at the instance of revision petitioner\/ accused,<\/p>\n<p>by judgment dated 29.7.2003 in Criminal Appeal No.40\/01, the<\/p>\n<p>court of III Additional Sessions Judge (Adhoc) Fast Track Court &#8211; I,<\/p>\n<p>Mavelikkara, while confirming the conviction, the sentence is<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.R.P. No.2179\/10              3<\/span><\/p>\n<p>modified and reduced the same to simple imprisonment for a<\/p>\n<p>term of one month and the petitioner is further directed to pay a<\/p>\n<p>compensation of Rs.50,000\/- to the complainant and also fixed<\/p>\n<p>the default sentence as simple imprisonment for one month. It is<\/p>\n<p>the above conviction and sentence, challenged in this revision<\/p>\n<p>petition.\n<\/p>\n<p id=\"p_3\">      4.     I have head the learned counsel appearing for the<\/p>\n<p>revision petitioner and also perused the judgments of the courts<\/p>\n<p>below.\n<\/p>\n<p id=\"p_4\">       5.   Reiterating the stand taken by the accused\/revision<\/p>\n<p>petitioner during the trial and appeal, submitted that the<\/p>\n<p>complainant has not established the transaction and also the<\/p>\n<p>execution and issuance of the cheque.        The counsel for the<\/p>\n<p>revision petitioner further submitted that the courts below has<\/p>\n<p>committed wrong in convicting the revision petitioner. But no<\/p>\n<p>case is made out to interfere with the concurrent findings of the<\/p>\n<p>trial court as well as the lower appellate court. Therefore, I find<\/p>\n<p>no merit in the revision petition and accordingly the conviction<\/p>\n<p>recorded by the courts below against the revision petitioner<\/p>\n<p>u\/s.138 of <a href=\"\/doc\/1132672\/\" id=\"a_3\">Negotiable Instruments Act<\/a>, is approved.<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">Crl.R.P. No.2179\/10             4<\/span><\/p>\n<p id=\"p_5\">      6.     As this court is not inclined to interfere with the<\/p>\n<p>conviction recorded by the court below, learned counsel for the<\/p>\n<p>revision petitioner submitted that the sentence of imprisonment<\/p>\n<p>ordered by the court below is highly unreasonable and exorbitant<\/p>\n<p>and breathing time may be granted to the petitioner to pay the<\/p>\n<p>amount. Having regard to the facts and circumstances involved<\/p>\n<p>in the case, I am of the view that the said submission can be<\/p>\n<p>considered favourably.\n<\/p>\n<p id=\"p_6\">      7.    As per the records and as per the findings of courts<\/p>\n<p>below, which approved by this court,       the cheque is dated<\/p>\n<p>2.6.1996 for an amount of Rs.1,50,000\/- which belongs to the<\/p>\n<p>complainant       and thus the said amount is with the revision<\/p>\n<p>petitioner for the last fourteen years. Learned counsel for the<\/p>\n<p>revision petitioner submitted that the parties are relatives and<\/p>\n<p>the entire dispute has been settled But there is no evidence or<\/p>\n<p>materials to accept the above contention. The apex court in the<\/p>\n<p>decision reported in <a href=\"\/doc\/1594211\/\" id=\"a_4\">Damodar S. Prabhu V. Sayed Babalal H.<\/p>\n<p>(JT<\/a> 2010(4) SC 457) has held that in the case of dishonour of<\/p>\n<p>cheques, the compensatory aspect of the remedy should be given<\/p>\n<p>priority over the punitive aspects.     However, considering the<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">Crl.R.P. No.2179\/10                5<\/span><\/p>\n<p>above facts and settled legal position of law, the sentence of<\/p>\n<p>imprisonment ordered by court below can be reduced and some<\/p>\n<p>time can be granted for payment but subjected slight<\/p>\n<p>enhancement of the amount.\n<\/p>\n<p id=\"p_7\">      In the result, this revision petition is disposed of confirming<\/p>\n<p>the      the conviction against revision petitioner u\/s.138 of<\/p>\n<p><a href=\"\/doc\/1132672\/\" id=\"a_5\">Negotiable Instrument Act<\/a>, as recorded by the courts below.<\/p>\n<p>Accordingly the sentence of imprisonment ordered by court below<\/p>\n<p>is modified and reduced to one day simple imprisonment, ie., till<\/p>\n<p>rising of court. The revision petitioner is further directed to pay a<\/p>\n<p>sum of Rs.2,00,000\/- as compensation to the complainant within<\/p>\n<p>three month from today u\/s.357(3) <a href=\"\/doc\/445276\/\" id=\"a_6\">Cr.P.C<\/a> and in case of any<\/p>\n<p>failure in paying the amount within the above stipulated time, he<\/p>\n<p>is directed to undergo simple imprisonment for a period of three<\/p>\n<p>months. Accordingly the revision petitioner is directed to appear<\/p>\n<p>before the trial court on 3.11.2010 to receive the sentence and<\/p>\n<p>pay the above compensation amount. The revision petitioner is<\/p>\n<p>free to pay compensation either directly to the complainant or by<\/p>\n<p>remitting the same in the trial court, whichever subject to the<\/p>\n<p>satisfaction of the learned Magistrate. In case of any failure on<\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">Crl.R.P. No.2179\/10                6<\/span><\/p>\n<p>the part of the revision petitioner in appearing before the court<\/p>\n<p>below on the above date and making the payment, the trial court<\/p>\n<p>is free to take coercive steps to secure the presence of the<\/p>\n<p>petitioner and to execute the sentence and for realisation of the<\/p>\n<p>compensation amount.\n<\/p>\n<p id=\"p_8\">      This criminal revision petition is disposed of accordingly.<\/p>\n<p id=\"p_9\">                                         V.K.
