BASANT, J.\n                         - - - - - - - - - - - - - - - - - - - -\n                        Crl.R.P.No.  3197 of   2006\n                         -  - - - -  - - - - - - - - - - - - - - -\n              Dated this the  11th day of   September, 2006\n\n\n                                     O R D E R\n<\/pre>\n<p id=\"p_1\">       This revision   petition is directed against a concurrent verdict<\/p>\n<p>of  guilty, conviction and sentence in a prosecution under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a><\/p>\n<p>of the N.I. Act.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       2.     The cheque is  for an amount of Rs. 60,000\/-.   It bears the<\/p>\n<p>date 18.4.2002.       The petitioner now faces a sentence of S.I. for a<\/p>\n<p>period of six months.  There is also a direction    to pay   an   amount<\/p>\n<p>of Rs. 62,000\/- as compensation and in default to undergo S.I. for a<\/p>\n<p>further period of three months.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">       3.     The   signature in the cheque is admitted.   The  notice of<\/p>\n<p>demand,   though     duly     received   and   acknowledged,     did   not<\/p>\n<p>admittedly evoke any response.   The complainant examined himself<\/p>\n<p>as PW1 and  proved  Exts.P1 to P4.    The  accused  did not adduce<\/p>\n<p>any defence evidence.   Except to broadly and vaguely contend that<\/p>\n<p>the   cheque   was  not  issued     for    the  due  discharge  of    any  legally<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.R.P.No.  3197 of   2006                     2<\/span><\/p>\n<p>enforcible debt\/liability,  no specific or definite defence was even taken up.<\/p>\n<p id=\"p_5\">       4.    The courts below, in these circumstances,   concurrently came to<\/p>\n<p>the conclusion that   the  complainant   has   succeeded   in   establishing  all<\/p>\n<p>ingredients of   the  offence punishable   under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> of the N.I.   Act.<\/p>\n<p>Accordingly they   proceeded to pass the  impugned  concurrent judgments.<\/p>\n<p id=\"p_6\">       5.     Called upon to explain  the nature of the   challenge  which the<\/p>\n<p>petitioner wants to mount against the impugned concurrent judgments, the<\/p>\n<p>learned counsel for the petitioner only prays that leniency may be shown on<\/p>\n<p>the   question   of   sentence.       In   the   absence   of   challenge   on   any   specific<\/p>\n<p>ground against the verdict of guilty and conviction, I am satisfied that it is<\/p>\n<p>not necessary for me to advert to   facts in any greater detail in this order.<\/p>\n<p>I   am   satisfied   that   the   verdict   of   guilty   and   conviction   are   absolutely<\/p>\n<p>justified and  unexceptionable.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">       5.   Coming to the  question of sentence,           I am satisfied that   the<\/p>\n<p>prayer   for   leniency   can   be   accepted.           I   have   already   adverted   to   the<\/p>\n<p>principles governing imposition of sentence in a prosecution under <a href=\"\/doc\/1823824\/\" id=\"a_2\">Section<\/p>\n<p>138<\/a> of the N.I. Act in the decision in <a href=\"\/doc\/163658\/\" id=\"a_3\">Anilkumar  v.  Shammy<\/a>   (2002 (3)<\/p>\n<p>KLT 852).    I  am not satisfied that there are any compelling reasons which<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.R.P.No.  3197 of   2006                        3<\/span><\/p>\n<p>would justify or warrant imposition of any deterrent substantive sentence of<\/p>\n<p>imprisonment on the petitioner.  Leniency can be shown on the question of<\/p>\n<p>sentence.   But it will have to be zealously  ensured that  the complainant,<\/p>\n<p>who     has   been   compelled   to   wait   for   about   four   years   and   to   fight   two<\/p>\n<p>rounds   of   unnecessary   legal   battle     for   the   redressal   of     his   genuine<\/p>\n<p>grievances   is adequately  and justly    compensated.        The challenge  can<\/p>\n<p>succeed only  to the above extent.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">         6.  In the nature of the relief which I propose to grant, I am satisfied<\/p>\n<p>that     it   is   not   necessary   to     wait   for   issue     and   return   of   notice   to   the<\/p>\n<p>respondent.\n<\/p>\n<p id=\"p_11\">\n<p id=\"p_12\">         7.  In the result:\n<\/p>\n<p id=\"p_13\">\n<p id=\"p_14\">        (a)  This revision petition is allowed in part.\n<\/p>\n<p id=\"p_15\">\n<p id=\"p_16\">        (b)   The impugned verdict of guilty and conviction of the petitioner<\/p>\n<p>under <a href=\"\/doc\/1823824\/\" id=\"a_4\">Section 138<\/a> of the N.I. Act  are upheld.\n<\/p>\n<p id=\"p_17\">\n<p id=\"p_18\">        )     But   the   sentence   imposed   is   modified   and   reduced.     In<\/p>\n<p>supersession of the  sentence imposed on the petitioner by the courts below,<\/p>\n<p>he is sentenced  to undergo imprisonment  till rising of court.  He is further<\/p>\n<p>directed   under <a href=\"\/doc\/640437\/\" id=\"a_5\">Section 357(3)<\/a> Cr.P.C. to pay an  amount   of Rs.66,000\/-<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">Crl.R.P.No.  3197 of   2006                 4<\/span><\/p>\n<p>(Rupees   sixty   six   thousand   only)     as   compensation     and   in   default   to<\/p>\n<p>undergo S.I. for a period of two months.    If realised the entire amount shall<\/p>\n<p>be released to the complainant.\n<\/p>\n<p id=\"p_19\">\n<p id=\"p_20\">       8.   The petitioner shall appear   before the learned Magistrate on or<\/p>\n<p>before 16.11.2006 to serve the modified sentence hereby imposed.       The<\/p>\n<p>sentence shall not be executed till that date.    If the petitioner does   not so<\/p>\n<p>appear, the learned Magistrate shall thereafter   proceed to take  necessary<\/p>\n<p>steps  to execute the modified sentence hereby imposed.<\/p>\n<p id=\"p_21\">                                                         (R.
