Secretary, &#8230; on 20 July, 2010<\/div>\n<pre id=\"pre_1\">                                                                   Court No. 20\n                    Writ Petition No. 6632 (M\/B) of 2010\n\nSanjai Bajpai                                                      Petitioner\n                                       Vs\nState of U.P and others                                            Opp. Parties\n\nHon'ble Raj Mani Chauhan, J.\n<\/pre>\n<p id=\"p_1\">Hon&#8217;ble Virendra Kumar DIXIT,J.\n<\/p>\n<p id=\"p_1\">       Heard learned counsel for the petitioner, learned A.G.A and perused the<br \/>\ndocuments available on record.\n<\/p>\n<p id=\"p_2\">       This petition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India has been<br \/>\nfiled by the petitioner for quashing the impugned FIR, registered at case crime<br \/>\n393 of 2010, under <a href=\"\/doc\/619940\/\" id=\"a_1\">Sections 363<\/a>, <a href=\"\/doc\/796352\/\" id=\"a_2\">366<\/a> I.P.C., Police Station Gola, District Kheri<br \/>\nand also for direction to the opposite parties not to arrest the petitioner in<br \/>\npursuance to the said impugned FIR.\n<\/p>\n<p id=\"p_3\">       The submission of learned counsel for the petitioner is that the petitioner<br \/>\nand so called prosecutrix Shalu Pandey being major entered into marriage on<br \/>\n29.03.2010 in Arya Samaj Meston Road, Kanpur and since then they are living<br \/>\ntogether as husband and wife.         They got their marriage registered on<br \/>\n29.06.2010 in the office of the Registrar, Hindu Marriage, Kanpur Nagar.<br \/>\nTheir marriage certificate as well as registration certificate have been filed<br \/>\nby the petitioner as annexure Nos 2 and 3 to the writ petition. A major girl is<br \/>\nfree to marry with any person she likes, in view of the law laid down by the<br \/>\nHon&#8217;ble Apex Court in the case of Lata Singh Vs. State of U.P. &amp; Anr.<br \/>\nreported in 2006 (5) ALJ 357. The Chief Medical Officer, Kanpur Nagar has<br \/>\nopined the age of prosecutrix as 19 years. She being major entered into<br \/>\nmarriage with petitioner Sanjai Bajpai. Therefore, no offence under <a href=\"\/doc\/619940\/\" id=\"a_3\">Sections<br \/>\n363<\/a>, <a href=\"\/doc\/796352\/\" id=\"a_4\">366<\/a> I.P.C. is made out against the petitioner. He, therefore, need interim<br \/>\nprotection during investigation.\n<\/p>\n<p id=\"p_4\">       The prosecutrix Shalu Pandey, who is identified by Sri Naveen<br \/>\nSinha, learned counsel for the petitioner, is present before this Court and<br \/>\nstates that her date of birth is 28.10.1988. She also states that she had<br \/>\nvoluntarily married with petitioner Sanjai Bajpai.\n<\/p>\n<p id=\"p_5\">       Learned A.G.A. opposed the petition.\n<\/p>\n<p id=\"p_6\">       Considered the submissions of learned counsel for the petitioner and<br \/>\nlearned A.G.A.\n<\/p>\n<p id=\"p_7\">       Issue notice to opposite party No. 4 to file counter affidavit within four<br \/>\nweeks.
