Respondents\n\n\n        Petition filed under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India for  the\nissuance of Writ of Mandamus as stated therein.\n\nFor Petitioner :  Mr.N.  Kannadasan\n\nFor Respondent 1-3 :  Mrs.N.G.  Kalaiselvi,\n                Special Govt.  Pleader\n\nRespondent-4 :  Mr.M.  Jagadeesan\n                - - -\n\n:O R D E R\n<\/pre>\n<p id=\"p_1\">        Heard the  learned  counsels  appearing for the parties.  In this writ<br \/>\npetition,  the  petitioner  has  prayed  for  issuing  a  writ  directing  the<br \/>\nrespondents  to forbear from proceeding with the verification of the community<br \/>\nstatus of the petitioner.\n<\/p>\n<p id=\"p_1\">        2.  A community certificate was issued in favour of the petitioner  on<br \/>\n18.1.1984 by  the  Tahsildar,  Madurai.    Subsequently  on  the basis of such<br \/>\ncommunity certificate, the petitioner was appointed as Stenographer under Life<br \/>\nInsurance Corporation, the respondent  No.4.    It  has  been  stated  in  the<br \/>\npetition  that  the  petitioner\u2019s  father,  who  was a resident of Tirunelveli<br \/>\nDistrict, was employed  under  Railways  on  the  basis  that  he  belongs  to<br \/>\nKattunaicken  community, which was considered as Scheduled Tribe in the entire<br \/>\nState of Tamil Nadu.  The petitioner\u2019s father entered into service in  August,<br \/>\n1951.   The  petitioner  was  born in Madurai district and as such he obtained<br \/>\ncommunity certificate from the Revenue authorities in Madurai district.    The<br \/>\nquestion  having  been  raised  by  the employer before the Revenue Divisional<br \/>\nOfficer, Tirunelveli, an enquiry was  conducted  by  such  Revenue  Divisional<br \/>\nOfficer,  who  submitted  his report dated 21.1.1995 addressed to the District<br \/>\nCollector, Tirunelveli stating that the  petitioner  belongs  to  Kattunaicken<\/p>\n<p>community.   Keeping  in view the aforesaid aspects, the petitioner prays that<br \/>\nthere is no further necessity to  enquire  into  the  matter  afresh  and  the<br \/>\npetitioner is being unnecessarily harassed.\n<\/p>\n<p id=\"p_2\">        3.   The  learned  counsel for the petitioner has placed reliance upon<br \/>\nthe decisions reported in 1998 LW 105 (S.P.  SAKTHI DEVI v.  THE COLLECTOR  OF<br \/>\nSALEM, SALEM AND  3  OTHERS)  and  2002(1)  CTC  403 (Dr.Ve.  MANOHAR Vs.  THE<br \/>\nDISTRICT COLLECTOR, SIVAGANGAI DISTRICT AND ANOTHER).  The assertion that  the<br \/>\npetitioner\u2019s   father  was  employed  on  the  footing  that  he  belonged  to<br \/>\nKattunaicken community way-back in 1951 is  not  denied.    The  materials  on<br \/>\nrecord  and also the subsequent correspondence from the railway authorities to<br \/>\nthe  Revenue  Divisional  Officer,  Tirunelveli  district  indicate  that  the<br \/>\npetitioner\u2019s father was employed under Railways as he belonged to Kattunaicken<br \/>\ncommunity.\n<\/p>\n<p id=\"p_3\">        4.   In the counter-affidavit filed on behalf of the State it has been<br \/>\nindicated that since objections had been received from  the  Association,  the<br \/>\nquestion had been raised and the enquiry was conducted.\n<\/p>\n<p id=\"p_4\">        5.  After going through the materials on record and the averments made<br \/>\nin the petition and the counter, I am of the view that the question raised now<br \/>\nis  covered  by two decisions cited by the learned counsel for the petitioner.<br \/>\nIt is obvious that the petitioner is being  subjected  to  repeated  enquiries<br \/>\nwithout valid justification.  This conclusion is strengthened by the fact that<br \/>\nabout  half  century back, the father of the petitioner was considered to be a<br \/>\nmember of Kattunaicken community.\n<\/p>\n<p id=\"p_5\">        6.  For the aforesaid reasons, the writ petition is allowed.
