Justice M.SASIDHARAN NAMBIAR\n\n Dated :19\/09\/2008\n\n O R D E R\n                 M.SASIDHARAN NAMBIAR, J.\n                   ...........................................\n                 CRL.R.P.NO. 3234 OF 2008\n                  ............................................\n     DATED THIS THE         19th       DAY OF SEPTEMBER, 2008\n\n                                  ORDER\n<\/pre>\n<p id=\"p_1\">     Petitioner was convicted concurrently for the offence under<\/p>\n<p><a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> of N.I.Act. Learned Magistrate sentenced her to<\/p>\n<p>simple imprisonment for four months in addition to a<\/p>\n<p>compensation of Rs.1,58,000\/-.              In appeal, learned Sessions<\/p>\n<p>Judge modified the sentence to imprisonment till rising of court<\/p>\n<p>and a fine of Rs.1,50,000\/- and in default, simple imprisonment<\/p>\n<p>for three months. The revision is filed challenging the conviction<\/p>\n<p>and sentence.\n<\/p>\n<p id=\"p_1\">     2. Learned counsel appearing for petitioner was heard. The<\/p>\n<p>argument of learned counsel is that the cheque was not issued<\/p>\n<p>towards the repayment of an existing liability and courts below<\/p>\n<p>did not properly appreciate the evidence and in such<\/p>\n<p>circumstances, conviction and sentence is not sustainable. It<\/p>\n<p>was also argued that in any case the sentence awarded is<\/p>\n<p>excessive and considering the financial conditions of petitioner,<\/p>\n<p>reasonable time of six months is to be granted for payment of the<\/p>\n<p>fine amount.\n<\/p>\n<p id=\"p_2\">     3. The learned Magistrate and learned Sessions Judge, on<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRRP 3234\/2008                    2<\/span><\/p>\n<p>appreciation of evidence of first respondent as PW1 with Exts.P1<\/p>\n<p>to P8 found that Ext.P1 cheque was issued by petitioner towards<\/p>\n<p>discharge of     pre-existing liability and when the cheque was<\/p>\n<p>presented for encashment, it was dishonoured for want of<\/p>\n<p>sufficient funds. Petitioner, when questioned under <a href=\"\/doc\/767287\/\" id=\"a_1\">Section 313<\/a><\/p>\n<p>of Code of Criminal Procedure contended that she borrowed only<\/p>\n<p>Rs.25,000\/- and at that time issued a blank cheque and making<\/p>\n<p>use of the blank cheque, Ext.P1 cheque was created and got it<\/p>\n<p>dishonoured and complaint was filed and therefore she has not<\/p>\n<p>committed the offence.         Learned Magistrate and learned<\/p>\n<p>Sessions Judge found that there is no reason to disbelieve the<\/p>\n<p>evidence of PW1 and the case of petitioner that she had issued a<\/p>\n<p>blank cheque is not substantiated.\n<\/p>\n<p id=\"p_3\">      4. On going through the judgments of courts below, I do not<\/p>\n<p>find any reason to interfere with the factual findings of courts<\/p>\n<p>below that Ext.P1 cheque was issued towards discharge of<\/p>\n<p>existing liability.\n<\/p>\n<p id=\"p_4\">      5. The fact that Ext.P1 cheque was presented within the<\/p>\n<p>statutory period and it was dishonoured for want of sufficient<\/p>\n<p>funds and first respondent sent a notice demanding the amount<\/p>\n<p>covered by the cheque within the statutory period and petitioner<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRRP 3234\/2008                   3<\/span><\/p>\n<p>did not pay the amount in spite of the notice are conclusively<\/p>\n<p>proved by evidence. Therefore conviction of petitioner for the<\/p>\n<p>offence under <a href=\"\/doc\/1823824\/\" id=\"a_2\">Section 138<\/a> of N.I Act is perfectly correct and<\/p>\n<p>warrants no interference.\n<\/p>\n<p id=\"p_5\">       6. Then the only question is with regard to the sentence.<\/p>\n<p>Learned Sessions Judge modified the sentence to imprisonment<\/p>\n<p>till rising of court in addition to a fine of Rs.1,50,000\/- which<\/p>\n<p>exactly is the amount covered by the cheque. In such<\/p>\n<p>circumstances, I do not find any reason to interfere with the<\/p>\n<p>sentence also. Learned counsel then submitted that because of<\/p>\n<p>financial conditions petitioner may be granted six months time to<\/p>\n<p>pay the fine amount.
