On 04.03.2009 a Notice u\/s. 57(1) of the<br \/>\nGujarat Panchayats Act, 1993 (for short, &#8220;the Act&#8221;)<br \/>\nwas issued by respondent no.2 to the petitioner inter alia alleging<br \/>\nthat the petitioner had not followed the guidelines prescribed under<br \/>\nthe S.G.R.Y. Scheme and that  he had not removed the encroachments<br \/>\nupon the Government lands and that he had paid wages from the funds<br \/>\nof the Gram Panchayat to persons who were Members of the Panchayat.<br \/>\nThe petitioner replied to the said Notice vide reply dated<br \/>\n23.06.2009.\n<\/p>\n<p id=\"p_2\">3.\tHowever,<br \/>\nvide impugned order dated 12\/15.02.2010, respondent no.2 directed the<br \/>\nremoval of the petitioner from the post of Sarpanch of the Gram<br \/>\nPanchayat, in exercise of powers u\/s.57(1) of the said Act. Being<br \/>\naggrieved by the said order, the petitioner preferred an appeal<br \/>\nbefore respondent no.1.  However, the said appeal came to be rejected<br \/>\nvide impugned order dated 20.07.2010.  Hence, this petition.\n<\/p>\n<p id=\"p_3\">4.\tMr.\n<\/p>\n<p id=\"p_4\">B.T. Rao, learned counsel for the petitioner, contended that the<br \/>\nauthorities below have not appreciated the provisions of the Act in<br \/>\nits proper perspective and have passed the impugned orders in a<br \/>\ncompletely mechanical manner. He has submitted that the impugned<br \/>\norders have been passed due to political vendetta.\n<\/p>\n<p id=\"p_5\">4.1\tLearned<br \/>\ncounsel further contended that the petitioner has not committed any<br \/>\nmisconduct while discharging his duties nor has abused his powers. He<br \/>\nsubmitted that the petitioner has not misappropriated any funds of<br \/>\nthe Gram Panchayat and has always acted in accordance with the<br \/>\nprovisions of the Act. Hence, the impugned orders passed by the<br \/>\nauthorities below is perverse and against the provisions of law and<br \/>\npassed under political pressure.\n<\/p>\n<p id=\"p_6\">4.2\tLearned<br \/>\ncounsel has relied upon a decision of this Court in the case of<br \/>\n<a href=\"\/doc\/551380\/\" id=\"a_1\">Kamlaben Patel v. State of Gujarat<\/a>, 2001(1)<br \/>\nG.L.H. 109, wherein, it has been held that for the purpose of<br \/>\nremoval elected representatives cannot be treated like Government<br \/>\nservants as their services are controlled at the pleasure of the<br \/>\nPresident or Governor under <a href=\"\/doc\/1977659\/\" id=\"a_1\">Article 319<\/a> of the Constitution. Similar<br \/>\nview has been taken in another decision of this Court in the case of<br \/>\n<a href=\"\/doc\/1572725\/\" id=\"a_2\">Kanakbhai Padhar v. State of Gujarat<\/a>, 2002 (3) G.L.H. 739,<br \/>\nwherein, it has been held that before removing an elected<br \/>\nrepresentative, the authority must consider whether there is a<br \/>\ngenuine ground available for removal and whether such a person is<br \/>\ncommitting persistent defaults in the discharge of his duties as<br \/>\nrequired u\/s. 57(1) of the Act.\n<\/p>\n<p id=\"p_7\">5.\tHeard<br \/>\nlearned counsel for the petitioner and perused the documents on<br \/>\nrecord. After considering the reply filed by the petitioner and other<br \/>\nevidence available on record, the respondent-authority found that<br \/>\nmaterials which could be used under the S.G.R.Y. scheme had not been<br \/>\nused and that the projects under the said scheme were not completed<br \/>\nwithin the stipulated period. It was also found that the persons who<br \/>\nwere employed for work were not paid in cash or coupons, which was<br \/>\nthe requirement under the scheme. It was also found that the benefits<br \/>\nof the scheme were not extended to all the labourers who were<br \/>\nentitled to receive the said benefits. Another serious irregularity<br \/>\nwhich was found was that payments were made to Members of the Gram<br \/>\nPanchayat towards the labour work.\n<\/p>\n<p id=\"p_8\">6.\tThe<br \/>\ncharges include misappropriation of the funds of the Gram Panchayat<br \/>\nand failure in the implementation of the scheme meant for the people<br \/>\nof the Village. All the above charges that stood proved against the<br \/>\npetitioner are of a very serious nature. Looking to the seriousness<br \/>\nof the charges that stood proved against the petitioner, I am of the<br \/>\nopinion that the authority below was completely justified in removing<br \/>\nthe petitioner from the post of Sarpanch by exercising powers<br \/>\nu\/s.57(1) of the Act.\n<\/p>\n<p id=\"p_9\">7.\tIt<br \/>\nappears from the record that the petitioner had not demanded the copy<br \/>\nof the Report though a reference regarding the same was made in the<br \/>\nNotice. Therefore, it is now not open to the petitioner to take the<br \/>\ndefence that he was not supplied with the copy of the same.\n<\/p>\n<p id=\"p_10\">8.\tThe<br \/>\ndecisions relied upon by the learned counsel for the petitioner,<br \/>\nthough good law, will not apply to the facts of the present case<br \/>\nsince, in this case, the charges that stood proved against the<br \/>\npetitioner are serious in nature and therefore, the competent<br \/>\nauthority has powers under the Act to pass an order directing removal<br \/>\nof the petitioner from the post of Sarpanch. The authorities below<br \/>\nhave rightly exercised the powers under the said Act. Hence, the said<br \/>\ndecisions will not apply on the facts of the present case.\n<\/p>\n<p id=\"p_11\">9.\tIn<br \/>\nview of the above discussion, I am of the view that the authorities<br \/>\nbelow have not committed any error while passing the impugned orders.<br \/>\nI am in complete agreement with the concurrent findings recorded by<br \/>\nthe authorities below and hence, find no reasons to interfere with<br \/>\nthe same.\n<\/p>\n<p id=\"p_12\">10.\tFor<br \/>\nthe foregoing reasons, the petition is summarily rejected.\n<\/p>\n<p id=\"p_13\">[K.\n<\/p>\n<p id=\"p_14\">S.
