M. SAHAI)<\/p>\n<p>\tRULE.\n<\/p>\n<p id=\"p_1\">\t ORDER<br \/>\nIN CA No.5634 of 2011<\/p>\n<p>We<br \/>\n\thave heard Ms. Monali Bhatt, learned Assistant Government Pleader<br \/>\n\tfor the appellant.\n<\/p>\n<p id=\"p_2\">Learned<br \/>\n\tAssistant Government Pleader has urged that the respondent was<br \/>\n\ttransferred from Surat to Ahmedabad city by transfer order dated<br \/>\n\t07.09.2010. The respondent challenged the transfer order by filing<br \/>\n\twrit petition being Special Civil Application No.10856 of 2010.  The<br \/>\n\tlearned Single Judge by order dated 08.09.2010 issued notice and<br \/>\n\tstayed the transferred order by granting interim relief in terms of<br \/>\n\tparagraph 10 (C) (i) and (ii).  The appellants have filed their<br \/>\n\taffidavit-in-reply.  Paragraphs 7 &amp; 8 of the affidavit-in-reply<br \/>\n\tfiled by the appellants before the learned Single Judge is extracted<br \/>\n\tbelow :-\n<\/p>\n<p id=\"p_3\">&#8220;7.\tI<br \/>\nstate that petitioner was transferred to Ahmedabad City in public<br \/>\ninterest as the petitioner has failed to take appropriate steps to<br \/>\nstop activity relating to prohibition and theft of chemical which may<br \/>\nresult into hooch tragedy.\n<\/p>\n<p id=\"p_4\">8.\tI<br \/>\nstate that in the jurisdiction of the petitioner&#8217;s police station,<br \/>\nnamely, Kamrej Police Station, raid was carried out on 20.04.2010 and<br \/>\n28.08.2010 by Vigilance Squad whereby liquor worth Rs.1,51,020 was<br \/>\nfound and in the raid dated 28.08.2010, 1,14,420 liters of chemical<br \/>\nworth Rs.40,04,700\/- was recovered and over all value of the muddamal<br \/>\nwas found to the approximately Rs.65,32,100\/-.  It is clear that<br \/>\nwithin a short span of four month, when the petitioner was Police<br \/>\nInspector of Kamrej Police Station.  State Vigilance Squad carried<br \/>\nout two successful raids confiscating large amount of muddamal.  This<br \/>\nshows that the petitioner was not performing his duties properly and<br \/>\nanti-social activities were going on unabatedly in his jurisdiction<br \/>\nduring his tenure.  The encouragement provided by the petitioner to<br \/>\nthe criminals also cannot be ruled out.  Therefore, taking into<br \/>\nconsideration the above mentioned facts, the order of transfer was<br \/>\npassed and, therefore, I deny that transfer order was passed for the<br \/>\npolitical reasons and in defiance of the Government Circular or<br \/>\nResolution.  Raids were carried out by vigilance squad which shows<br \/>\npetitioner fails to perform his duty with due diligence and there was<br \/>\nnegligence on part of the petitioner.  A copy of the relevant<br \/>\nmaterials of the raid is annexed hereto and marked as Annexure R II<br \/>\nto this reply. &#8221;\n<\/p>\n<p id=\"p_5\">From<br \/>\n\tthe aforesaid, it is clear that the petitioner was transferred to<br \/>\n\tavoid hooch tragedy as raid was carried out by the Officers of State<br \/>\n\tVigilance Squad and huge quantity of liquor was found in the area of<br \/>\n\twhich the respondent was Police Inspector at Kamrej Police Station.<br \/>\n\tThe learned Single Judge by order dated 14.10.2010 issued rule and<br \/>\n\textended the interim relief on the ground that the children of the<br \/>\n\trespondent are studying and they should be permitted to complete<br \/>\n\ttheir studies in the current academic year of 2010 &#8211; 2011.\n<\/p>\n<p id=\"p_6\">It<br \/>\n\tis well settled by the Apex Court that transfer is incident of<br \/>\n\tservice and it is the discretion of the State Government to transfer<br \/>\n\tits employees from one place to the other in the interest of better<br \/>\n\tadministration as well as in public interest.  The transfer order<br \/>\n\tcould not be interfered unless there were allegations of malafides<br \/>\n\twhich were prima facie established before the learned Single<br \/>\n\tJudge.  In this view of the matter, the appellants are entitled for<br \/>\n\tinterim order.\n<\/p>\n<p id=\"p_7\">Rule,<br \/>\n\treturnable on 14.07.2011.\n<\/p>\n<p id=\"p_8\">Until<br \/>\n\tfurther orders of this Court, the effect and operation of the orders<br \/>\n\tdated 08.09.2010 and 14.10.2010 passed by the learned Single Judge<br \/>\n\tin Special Civil Application No.10856 of 2010 shall remain stayed.\n<\/p>\n<p id=\"p_9\">\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p id=\"p_10\">\t\t\t\t\t\t\t[V.
