Ramachandran Nair, J.\n                   - - - - - - - - - - - - - - - - - - - - - - - -\n                      W.P.(C) No. 31520 of 2010-L\n                   - - - - -- - - - - - - - - - - - - - - - - - - - -\n              Dated this the 13th day of October, 2010.\n\n                                 JUDGMENT\n<\/pre>\n<p id=\"p_1\">       This writ petition is filed challenging rejection of nomination of the<\/p>\n<p>petitioner to Ward No.8 of Velom Grama Panchayat.\n<\/p>\n<p id=\"p_1\">       2. Heard learned counsel for the petitioner and learned Standing<\/p>\n<p>Council for the Election Commission.\n<\/p>\n<p id=\"p_2\">       3. Learned counsel for the petitioner submitted that the rejection is<\/p>\n<p>arbitrary and illegal and therefore this Court has jurisdiction to entertain the<\/p>\n<p>matter, even at the intermediate stage of the election process. It is pointed<\/p>\n<p>out that there are no disputed questions of fact and no adjudication on those<\/p>\n<p>aspects is necessary with regard to the points raised in the writ petition. It is<\/p>\n<p>further pointed out that if there is a patent illegality, this Court can interfere<\/p>\n<p>at the intermediate stage of the process.\n<\/p>\n<p id=\"p_3\">       4. Learned Standing Counsel for the Election Commission submitted<\/p>\n<p>that in the light of the express bar contained in <a href=\"\/doc\/718864\/\" id=\"a_1\">Article 243-O<\/a> of the<\/p>\n<p>Constitution of India, this Court cannot go into the validity of the action<\/p>\n<p>taken by the Returning Officer in rejecting the nomination. Reliance is also<\/p>\n<p>placed on the decision of a Division Bench of this Court in <a href=\"\/doc\/560904\/\" id=\"a_1\">Returning<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">wpc 31520\/2010                         2<\/span><\/p>\n<p>Officer v. Chamiyar<\/a> (2006 (2) KLT 878).\n<\/p>\n<p id=\"p_4\">      5. <a href=\"\/doc\/718864\/\" id=\"a_2\">Article 243-O<\/a> bars the interference by courts in election matters.<\/p>\n<p>Sub <a href=\"\/doc\/237570\/\" id=\"a_3\">article (b)<\/a> thereof, provides that &#8220;no election to any Panchayat shall be<\/p>\n<p>called in question except      by   an election petition presented to such<\/p>\n<p>authority and in such manner as is provided for by or under any Law made<\/p>\n<p>by the Legislature of a State.&#8221; In the light of the non-obstante clause<\/p>\n<p>therein, evidently the jurisdiction of this Court under <a href=\"\/doc\/1712542\/\" id=\"a_4\">Article 226<\/a> of the<\/p>\n<p>Constitution will be barred. This legal position has been reiterated in a<\/p>\n<p>number of decisions by the Apex Court and this Court. In Chamiyar&#8217;s case<\/p>\n<p>(2006 (2) KLT 878), the very same question was considered and the only<\/p>\n<p>remedy available to the petitioner is to file an election petition before the<\/p>\n<p>Munsiff&#8217;s Court and not to invoke the jurisdiction of this Court, at this<\/p>\n<p>stage.\n<\/p>\n<p id=\"p_5\">      Therefore, the writ petition is dismissed leaving open the remedy of<\/p>\n<p>the petitioner to file an election petition in terms of the provisions of the<\/p>\n<p>Panchayat Raj Act after the declaration of results of the election is over.
