Whether if any license fee of Tehbazari is due against the appellant.\n2.     Whether the applicant was issued allotment letter for Particular place newly allotted sied to the\n       applicant.\n3.     Whether the applicant was issued possession slip in respect of newly allotted site.\n4.     Whether the applicant was issued Tehbazari identify card in respect of newly allotted tehbazari\n       site.\n5.     Any other relevant documents in respect of Tehbazari of the applicant may kindly be provided.\n\nThe PIO's reply.\n        \"Applicant may be requested to submit the photocopy of the document indicated vide point no.\n1,2,3,4 in his RTI application. So, the same could be verified in this office &amp; reply could be given to the\nappellant accordingly\".\n\nGround of the First Appeal:\n     Dissatisfied information had been provided by the PIO.\n\nOrder of the FAA:\n      No order had been passed by FAA.\n\nGround of the Second Appeal:\n     Dissatisfied information had been provided and no any order had been passed by the FAA.\nIncorrect and incomplete information had been supplied by the PIO after Ist Appeal.\n .\n<\/pre>\n<p id=\"p_1\">Relevant Facts emerging during Hearing:\n<\/p>\n<p id=\"p_1\">The following were present:\n<\/p>\n<p id=\"p_2\">Appellant : Mr. Jag Mohan;\n<\/p>\n<p id=\"p_3\">Respondent : Mr. Dalip Singh, Public Information Officer &amp; Assistant Commissioner;<br \/>\nThe RTI was received on 23\/03\/2009 vide id no. 399. The then PIO &amp; AC Mr. Madan Mohan on<br \/>\n21\/04\/2009 claims to have sent a letter to the appellant asking that a photocopy of the document regarding<br \/>\nhis tehbazari should be submitted so that reply could be given. The Appellant states he has never received<br \/>\nthis letter and no evidence has been shown to prove that this letter was sent.\n<\/p>\n<p id=\"p_4\">The information has been provided on 13\/08\/2009 with the order of the FAA, along which the<br \/>\ninformation has been provided. It is apparent that no clarification or information was required by the<br \/>\nappellant to provide the information.\n<\/p>\n<p id=\"p_5\">The Appellant claims that he is being harassed by MCD officer and not allowed to conduct his hocking in<br \/>\nthe place allotted to him. The Commission desires that MCD look into this grievance and redress it. The<br \/>\nPIO assures the Commission that he will personally investigate the matter and try and redress the<br \/>\ngrievance of harassment. The PIO is directed to send a report after this to the Commission before 15<br \/>\nJanuary 2010.\n<\/p>\n<p id=\"p_6\">The PIO states that the responsibility of not providing the information rests with Mr. Ahok Kumar, Rent<br \/>\nCollector and Mr. P. Bose, Licensing Inspector.\n<\/p>\n<p id=\"p_7\">Decision:\n<\/p>\n<p id=\"p_8\">The Appeal is allowed.\n<\/p>\n<p id=\"p_9\">        The information has been provided.\n<\/p>\n<p id=\"p_10\">The issue before the Commission is of not supplying the complete, required information by the<br \/>\ndeemed PIOs Mr. Ahok Kumar, Rent Collector and Mr. P. Bose, Licensing Inspector within 30<br \/>\ndays as required by the law.\n<\/p>\n<p id=\"p_11\">From the facts before the Commission it is apparent that the deemed PIOs Mr. Ahok Kumar, Rent<br \/>\nCollector and Mr. P. Bose, Licensing Inspector are guilty of not furnishing information within the time<br \/>\nspecified under sub-section (1) of Section 7 by not replying within 30 days, as per the requirement of the<br \/>\n<a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>.\n<\/p>\n<p id=\"p_12\">It appears that the deemed PIOs actions attract the penal provisions of <a href=\"\/doc\/1369783\/\" id=\"a_1\">Section 20<\/a> (1). A showcause<br \/>\nnotice is being issued to them, and they are directed give their reasons to the Commission to show cause<br \/>\nwhy penalty should not be levied on them.\n<\/p>\n<p id=\"p_13\">They will present themselves before the Commission at the above address on 18 January 2010 at 02.30pm<br \/>\nalongwith their written submissions showing cause why penalty should not be imposed on them as<br \/>\nmandated under <a href=\"\/doc\/1369783\/\" id=\"a_2\">Section 20<\/a> (1).\n<\/p>\n<p id=\"p_14\">This decision is announced in open chamber.\n<\/p>\n<p id=\"p_15\">Notice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per <a href=\"\/doc\/383252\/\" id=\"a_3\">Section 7(6)<\/a> of RTI Act.\n<\/p>\n<p id=\"p_16\">                                                                                                      Shailesh Gandhi<br \/>\n                                                                                            Information Commissioner<br \/>\n                                                                                                    18 December 2009<\/p>\n<p>(In any correspondence on this decision, mention the complete decision number.)
