HEMA, J\n                           ----------------------\n                       B.A.No.4382 OF 2010\n                    -----------------------------------\n             Dated this the 23rd day of July, 2010\n\n                               O R D E R\n<\/pre>\n<p id=\"p_1\">      This petition is for bail.\n<\/p>\n<p id=\"p_1\">      2. The alleged offences are under <a href=\"\/doc\/1053937\/\" id=\"a_1\">sections 466<\/a>, <a href=\"\/doc\/556166\/\" id=\"a_1\">468<\/a>, <a href=\"\/doc\/1466184\/\" id=\"a_2\">471<\/a><\/p>\n<p>and <a href=\"\/doc\/37788\/\" id=\"a_3\">34<\/a> IPC and <a href=\"\/doc\/686157\/\" id=\"a_4\">section 12(b)<\/a> of Passport Act.              According to<\/p>\n<p>prosecution, first and second accused are associates.              First<\/p>\n<p>accused lost his passport from abroad. He approached second<\/p>\n<p>accused for arranging another passport. Second accused<\/p>\n<p>approached third accused who is a travel agent. Fourth accused<\/p>\n<p>is an employee in the travel agency.            Fifth and sixth accused<\/p>\n<p>forged certain documents for using the same as genuine and<\/p>\n<p>handed over the same to third accused.               Fourth accused on<\/p>\n<p>knowing that documents are forged, prepared an application<\/p>\n<p>incorporating false details for the purpose of issuance of passport.<\/p>\n<p>In respect of this transaction, second accused had paid<\/p>\n<p>Rs.25,000\/- to third accused. Passport was issued in the name of<\/p>\n<p>first accused based on forged documents and all accused in<\/p>\n<p>furtherance of common intention committed the offences, stated<\/p>\n<p>above.\n<\/p>\n<p id=\"p_2\"><span class=\"hidden_text\" id=\"span_1\">B.A. No.4382\/10                   2<\/span><\/p>\n<p id=\"p_3\">      3. Learned counsel for petitioner submitted that petitioner<\/p>\n<p>is a woman, who is only an employee of third accused. She has<\/p>\n<p>no role in the alleged forgery. In her capacity as an employee,<\/p>\n<p>she only filled up the application form which was handed over to<\/p>\n<p>her with certain documents. There is no allegation that she had<\/p>\n<p>taken any money or gratification from any person in the<\/p>\n<p>transaction. There is no case that petitioner herself forged the<\/p>\n<p>relevant documents in this case. Petitioner was arrested on<\/p>\n<p>8.7.2010 and she was in custody for the past 15 days.<\/p>\n<p id=\"p_4\">      4.     Learned public prosecutor submitted that main<\/p>\n<p>allegations are against 3rd, 5th and 6th accused.       He has no<\/p>\n<p>objection in extending benefit of proviso to Sec.437 <a href=\"\/doc\/445276\/\" id=\"a_5\">Cr.P.C<\/a>. to<\/p>\n<p>petitioner, taking into account her limited role in the offence. On<\/p>\n<p>hearing both sides, I am satisfied that bail can be granted to<\/p>\n<p>petitioner on conditions. Hence the following order is passed:<\/p>\n<blockquote id=\"blockquote_1\"><p>             Petitioner shall be released on bail on her<\/p>\n<p>             executing a bond for Rs.25,000\/- with two solvent<\/p>\n<p>             sureties each for the like amount to the<\/p>\n<p>             satisfaction of   the  learned   Magistrate,   on<\/p>\n<p>             following conditions:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p><span class=\"hidden_text\" id=\"span_1\">B.A. No.4382\/10                   3<\/span><\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_2\"><p>               1)   Petitioner   shall   report   before    the<br \/>\n                  investigating officer as and when directed.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_3\"><p>               2) Petitioner shall not influence or intimidate<br \/>\n                  the witnesses or tamper with evidence.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_4\"><p>               3) In case petitioner is involved in other crime<br \/>\n                  of similar nature, the bail is liable to be<br \/>\n                  cancelled.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>\n      This petition is allowed.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\">\n<\/blockquote>\n<blockquote id=\"blockquote_7\"><p>                                             K.
