     In this Writ Petition filed under Article 226<\/a> of<\/p>\n
the Constitution of India, the petitioners who are<\/p>\n
tenants challenge Ext.P5 order of the District<\/p>\n
Court dismissing a revision which they had filed<\/p>\n
under section 14 of Act 2 of 1965 against Ext.P4<\/p>\n
order passed by the Principal Munsiff’s Court in<\/p>\n
execution of Ext.P1 order of eviction which was<\/p>\n
passed by a Division Bench of this Court to which<\/p>\n
one among us [PCK(J)] was party. Exts.P4 and P5<\/p>\n
are challenged on various grounds raised in this<\/p>\n
Writ Petition and Sri.P.I.Davis, the learned counsel<\/p>\n
W. P. C. No.6152 of 2010        -2-<\/span><\/p>\n
      for the Writ Petitioners would draw our attention<\/p>\n
      to the last sentence in paragraph 3 of Ext.P3<\/p>\n
      which is judgment in R.P.1221\/09 filed by these<\/p>\n
      petitioners      themselves  seeking    review   of<\/p>\n
      judgment in Writ Petition No.34571\/09. According<\/p>\n
      to Mr.Davis it was relying solely on the submission<\/p>\n
      made by the learned counsel for the respondents<\/p>\n
      that the respondents have obtained exemption<\/p>\n
      orders from the Government regarding the<\/p>\n
      proposed re-construction that we passed Ext.P3<\/p>\n
      dismissing the RP. Mr.Davis would draw our<\/p>\n
      attention to Ext.P6 replies received by one of the<\/p>\n
      petitioners to certain questions which he had put<\/p>\n
      to the local authority and submit that the<\/p>\n
      submission made on behalf of the landlord in<\/p>\n
      Ext.P3 that the landlord has secured exemption<\/p>\n

      orders was an absolutely incorrect submission.<\/p>\n
             2. As requested by us, Mr.Davis placed<\/p>\n
      before us the questions which were submitted<\/p>\n
      under the Right to Information Act<\/a> to the Public<\/p>\n
      Information Officer of the local authority. Question<\/p>\n
      No.C is as to whether any building permit was<\/p>\n
      granted to the landlords and if so, the number and<\/p>\n
      date of the permit. Question ‘C’ is answered in<\/p>\n
      Ext.P6 by answer No.C which is as follows:-<\/p>\n
                  “No. No permission has been
\n             granted    from   this   office   to
\n             Smt.Asmath and her children for
\n             construction of shop building in the
\n             above said land.”<\/p><\/blockquote>\n
\n
             3. Mr.Davis would submit that the building<\/p>\n
      rules have been made applicable to the local area<\/p>\n
      in question and therefore, the carrying out of the<\/p>\n
      reconstruction proposed in the Rent Control<\/p>\n
      Proceedings has become impossible considering<\/p>\n

      the smallness of the plot shown in the plan Ext.A1<\/p>\n
      submitted to the Rent Control Court. It will not be<\/p>\n
      possible      for these  landlords  to   put    up<\/p>\n
      constructions in the adjacent plot also in view of<\/p>\n
      the order passed by the Land Tribunal in S.M.<\/p>\n
      Proceedings No.80\/82. Though it is true that the<\/p>\n
      landlords have preferred an appeal under section<\/p>\n
      102 of the Land Reforms Act against the order of<\/p>\n
      the Land Tribunal, the chances are more that the<\/p>\n
      Appellate Tribunal will confirm the order of the<\/p>\n
      Land Tribunal.\n<\/p>\n
             4. All the submissions of Mr.Davis were<\/p>\n
      resisted by Smt.Prabha R. Menon, the learned<\/p>\n
      counsel for the respondents\/landlords. Drawing<\/p>\n
      our attention to Ext.P1 Smt.Prabha submitted that<\/p>\n
      the tenants were aware at the time when this<\/p>\n

      court passed Ext.P1, of the commencement of the<\/p>\n
      building rules in the Panchayath in question.<\/p>\n
      Nevertheless, the tenants agreed to suffer the<\/p>\n
      order of eviction under section 11(4)(iv)<\/a> provided<\/p>\n
      they are given the right of re-induction as<\/p>\n
      contemplated by the third proviso to clause 4 of<\/p>\n
      sub section 4<\/a> of section 11<\/a>. Ext.P1 having attained<\/p>\n
      finality, it is not open to the petitioners to raise<\/p>\n
      contentions like the present one before this Court<\/p>\n
      indirectly. It was on the basis of Ext.A1 that the<\/p>\n
      authorities under the Rent Control statute passed<\/p>\n
      the order of eviction which was confirmed in<\/p>\n
      Ext.P1. Under Ext.P1, it is the obligation of the<\/p>\n
      respondents to carry out the reconstruction and if<\/p>\n
      for any reason the respondents do not carry out<\/p>\n
      the reconstruction the respondents will be bound<\/p>\n

      to suffer any order which the Rent Control Court<\/p>\n
      and the higher authorities under the statute may<\/p>\n
      pass in terms of the third proviso to section 11(4)<\/a><\/p>\n
      (iv). The land will also be there and if it comes to<\/p>\n
      that the authorities under the statutes are<\/p>\n
      empowered even to permit the evicted tenants to<\/p>\n
      put up temporary construction.         Ext.P3 was<\/p>\n
      challenged before the Supreme Court also. But<\/p>\n
      the Supreme Court did not grant special leave for<\/p>\n
      challenging Ext.P3. Thus, Ext.P3 has also attained<\/p>\n
      finality at the hands of the Supreme Court. In<\/p>\n
      view of the judgment of the Supreme Court<\/p>\n
      confirming Ext.P3 also, the petitioners are not<\/p>\n
      entitled to raise the contentions presently raised.<\/p>\n
             5. We have very anxiously considered the<\/p>\n
      rival submissions addressed at the Bar. It is the<\/p>\n

      supervisory jurisdiction of this Court under Article<\/p>\n
      227<\/a> which has been invoked by the petitioners.<\/p>\n
      Supervisory jurisdiction under Article 227<\/a> is a<\/p>\n
      visitorial jurisdiction. It is not invoked for<\/p>\n
      correcting each and every wrong order that is<\/p>\n
      passed      by    a Subordinate     Court.   Visitorial<\/p>\n
      jurisdiction is invoked only when it can be stated<\/p>\n
      that the order passed by the Subordinate Court is<\/p>\n
      per se illegal in the sense that it offends a direct<\/p>\n
      statutory provision or a binding judicial precedent.<\/p>\n
      It can be invoked also when it can be stated that<\/p>\n
      it results in failure of justice or gross injustice to<\/p>\n
      one of the parties to the litigation. It may also be<\/p>\n
      possible to invoke supervisory jurisdiction when it<\/p>\n
      is possible to say that the order challenged is so<\/p>\n
      wholly unreasonable in the sense that the same<\/p>\n

      can be branded as a perverse one so that such an<\/p>\n
      order will not be authored by anybody having<\/p>\n
      reasonable learning and training in law. Gauging<\/p>\n
      the orders challenged in these proceedings by the<\/p>\n
      parametres which are applicable for the invocation<\/p>\n
      of the supervisory jurisdiction under Article 227<\/a>,<\/p>\n
      we are unable to say that there is warrant in this<\/p>\n
      case for invocation of that jurisdiction on Ext.P3<\/p>\n
      which is confirmed by the Supreme Court also. It<\/p>\n
      is an order of eviction under section 11(4)(iv)<\/a><\/p>\n
      which     has    been passed  in  favour   of  the<\/p>\n
      respondents. On the terms of Ext.P1 and the<\/p>\n
      orders of the Rent Control Court and the Appellate<\/p>\n
      Authority which were confirmed under Ext.P1, the<\/p>\n
      respondents are bound to carry out the re-<\/p>\n
      construction within the time limit. If they do not<\/p>\n

      carry    out    reconstruction and   re-induct  the<\/p>\n
      petitioner into the building, the Rent Control Court<\/p>\n
      will have every power to ensure that the<\/p>\n
      petitioners are re-inducted at least to the site on<\/p>\n
      which the buildings stood. If it comes to that, that<\/p>\n
      court will have the power to permit the petitioners<\/p>\n
      to put up constructions subject to reasonable<\/p>\n
      terms which may be fixed. The challenge against<\/p>\n
      Exts.P4 and P5 has necessarily to fail and we<\/p>\n
      dismiss this Writ Petition.\n<\/p>\n
