This is 1\/3rd of the<br \/>\nminimum wage payable to a daily wager employed by State Government.\n<\/p>\n<p id=\"p_3\">  Learned<br \/>\nAssistant Government Pleader Mr. Nirag Pathak waives service of Rule<br \/>\nfor the opponent-State.\n<\/p>\n<p id=\"p_4\">3.\tLearned<br \/>\nAssistant Government Pleader Mr.Pathak filed affidavit-in-replies on<br \/>\nbehalf of respondent No.2 in Civil Application No.11445 of 2010 in<br \/>\nSpecial Civil Application No.17106 of 2007,  by one Mr. N.C.<br \/>\nAndharia, Joint Commissioner of Commercial Tax, Division-I and<br \/>\nanother by one Mr. B.M. Dave, Joint Commissioner of Commercial Tax,<br \/>\nDivision-II.  There is no reply to the aforesaid averments made in<br \/>\npara 7 about working for six hours, six days a week. What is stated<br \/>\nin para 7 of the affidavit of Mr. B.M. Dave, is that:\n<\/p>\n<p id=\"p_5\"> I<br \/>\nstate and submit that the applicants herein are the part timers and<br \/>\nthe services are taken to meet with the daily work like cleaning,<br \/>\nwaterman, etc in the opponent no.2 department. The applicants are not<br \/>\nappointed against any regular sanctioned post nor they are appointed<br \/>\nagainst any sanctioned ad-hoc post of the department. Further, it is<br \/>\nstated that the applicants are not even covered under the terms of<br \/>\ndaily wagers and therefore, any provision laid down by the government<br \/>\nin the same respect shall not apply in the case of the present<br \/>\napplicants.\n<\/p>\n<p id=\"p_6\">4.\tThere<br \/>\ncannot be a licence to any person to exploit a person who, under<br \/>\ncompulsion, is required to take up a job, more so by the Government.\n<\/p>\n<p id=\"p_7\">5.\tIn<br \/>\nview of the aforesaid position, this Court has no reason not to<br \/>\ndirect payment as is directed by judgment of the Division Bench of<br \/>\nthis Court (Coram: Hon&#8217;ble the Chief Justice Mr. S.J. Mukhopadhaya<br \/>\nand Hon&#8217;ble Mr. Justice Akil Kureshi) in  Special Civil Application<br \/>\nNo.2492 of 2009 dated 26.8.2010, wherein it is specifically stated in<br \/>\npara 3 that, <\/p>\n<p> It<br \/>\nwill be evident that the State Government in its different<br \/>\nestablishments engaged these persons. Instead of daily wage<br \/>\nengagement they go for fixed pay engagement, and on completion of<br \/>\ncertain years, they are taken in the regular establishment and<br \/>\nappointed in the regular scale of pay fixed, as per the<br \/>\nrecommendations of the Pay Commission.\n<\/p>\n<p id=\"p_8\">In<br \/>\nthat, minimum amount payable is Rs.1500\/- to Class-IV, which is now<br \/>\nrevised to Rs.3500\/-.\n<\/p>\n<p id=\"p_9\">6.\tThe<br \/>\nopponent authorities are directed to pay the applicants- original<br \/>\npetitioners at the rate of Rs.3500\/- per month, starting from the<br \/>\nsalary of the month of October,2010 payable in the month of November<br \/>\n2010.\n<\/p>\n<p id=\"p_10\">\tWith<br \/>\nthe aforesaid directions, this Civil Application is disposed of.
