SAGHIR AHMAD, J.\n<\/p>\n<p id=\"p_1\">     The respondent  was appointed as a Lower Division Clerk<br \/>\non  November   15,  1969   in  the   Ministry  of   Defence.<br \/>\nSubsequently, in  the same Department, he was appointed as a<br \/>\nStore Keeper  on 27th  April, 1971  in the  Central Ordnance<br \/>\nDepot, Pune.  He got  the status  of quasi permanent on 27th<br \/>\nApril, 1974  and became\t permanent with effect from 1st May,<br \/>\n1974. The  respondent made  a request for his  transfer as a<br \/>\nStore\tKeeper\t in   the   Naval   Physical   Oceanographic<br \/>\nLaboratory(NPOL),   Cochin,    which   was    accepted\t  on<br \/>\ncompassionate  ground\tan  on\t 6th  June,   1977,  he\t was<br \/>\ntransferred to\tthat post,  but was  placed at the bottom of<br \/>\nthe seniority  list of\tstore Keepers there. on 22nd August,<br \/>\n1980, the  respondent was  promoted to\tthe post  of  Senior<br \/>\nStore Keeper.\n<\/p>\n<p id=\"p_2\">     On 15th  July, 1980, a new post of Senior Store Keeper,<br \/>\nGrade-I was  created as\t an intermediate  grade between\t the<br \/>\nposts of  Senior Store\tKeeper and Store Superintendent. One<br \/>\nA.K. Anujan,  who was the immediate senior of the respondent<br \/>\nin the\tGrade of  Senior Store\tKeeper was  promoted to this<br \/>\nintermediate post  of Senior  Store keeper, Grade- I on 31st<br \/>\nAugust, 1982.  The respondent  raised a claim that he should<br \/>\nhave been  promoted as\tSenior Store Keeper on 31st January,<br \/>\n1978 instead  of 22nd  February, 1980  and should  have been<br \/>\nfurther promoted  to the post of Senior Store Keeper, Grade-<br \/>\nI, on  31st August,  1982 along\t with his  next senior\tA.K.<br \/>\nAnujan. When  this claim was not entertained, the respondent<br \/>\napproached the\tKerala High  Court by  a Writ  Petition (No.<br \/>\nO.P. 10013  of 1982-J)\twhich was  allowed on  30.7.85 and a<br \/>\ndirection was  issued to  the present appellants to consider<br \/>\nthe claim of the respondent for ante-dating his promotion on<br \/>\nad hoc\tbasis by  applying the\tsame rules and principles on<br \/>\nwhich, his  immediate senior,  A.K. Anujan,  was promoted to<br \/>\nthe post of Senior Store Keeper, Grade-I.\n<\/p>\n<p id=\"p_3\">     In pursurance  of the  above judgment,  the case of the<br \/>\nrespondent  was\t  considered  by   the\tReview\tDepartmental<br \/>\nPromotion Committee  on 15th  October, 1985,  which was\t the<br \/>\nopinion that,  since the respondent had completed 3 years of<br \/>\nregular service\t as Store  keeper commencing  from 6th June,<br \/>\n14977, only  on 7th  June, 1980, he could not be promoted as<br \/>\nStore Keeper earlier than 1980. With regard to his promotion<br \/>\nto  the\t  post\tof   Senior  Store   Keeper,  Grade-I,\t the<br \/>\nDepartmental Promotion\tCommittee was of the view that since<br \/>\nunder the  Recruitment Rules, the respondent had completed 3<br \/>\nyears of regular service as Senior Store Keeper only on 23rd<br \/>\nAugust, 1983,  the respondent  could not  be considered\t for<br \/>\nthat post  as that post had, in the meantime, been taken out<br \/>\nof the\tpurview of  the Departmental Promotion Committee and<br \/>\nthe Recruitment and Promotion Rules with regard to that post<br \/>\nhad ceased to exist with effect from 7th November, 1981.\n<\/p>\n<p id=\"p_4\">     On the  basis  of\tthe  decision  of  the\tDepartmental<br \/>\nPromotion Committee,  the order dated 30th October, 1985 was<br \/>\npassed by  the\tappellants,  which  was\t challenged  by\t the<br \/>\nrespondent  before   the  Central  Administrative  Tribunal,<br \/>\nmadras Bench,  which by\t its judgment  dated 23rd  February,<br \/>\n1988,  has   allowed  the  claim  petition  and\t issued\t the<br \/>\nfollowing directions:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8221; (a)  The applicant&#8217;s  service  as<br \/>\n     Store Keeper  at Pune at least from<br \/>\n     1.5.1974  when   he  was\tmade   a<br \/>\n     permanent Store  Keeper  should  be<br \/>\n     reckoned as  qualifying service for<br \/>\n     the  purpose   of\teligibility  for<br \/>\n     promotion as Senior Store Keeper at<br \/>\n     NPOL, Cochin.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>     (b) The  Review DPC should consider<br \/>\n     the applicant for ad-hoc of regular<br \/>\n     promotion\tas   the  case\t may  be<br \/>\n     against  ad-hoc\/regular   vacancies<br \/>\n     between 31.1.78 and 22.8.80.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>     (c)   On\t the   basis\tof   the<br \/>\n     recommendations of\t the Review  DPC<br \/>\n     III, if  any, the\tapplicant should<br \/>\n     be promoted  as SSK   either on ad-<br \/>\n     hoc or  on regular\t basis by  ante-<br \/>\n     dating his promotion from 22.8.80.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>     (d) The respondents should identify<br \/>\n     the un-filled  posts of SSK-I  from<br \/>\n     1982  to\tdate  and  consider  the<br \/>\n     applicant for  promotion  as  SSK-I<br \/>\n     with effect from the date he can be<br \/>\n     deemed to\thave put  in three years<br \/>\n     of regular\t service as  SSK  either<br \/>\n     from 22.8.80  or  on  earlier  date<br \/>\n     with effect  from which  the Review<br \/>\n     DPC recommends his name for regular<br \/>\n     promotion as  per promotion  as per\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>     (b) above.&#8221;<\/p><\/blockquote>\n<p id=\"p_5\">     From the  facts set  out above,  it will  be seen\tthat<br \/>\npromotion was denied to the respondent on the post of Senior<br \/>\nStore keeper  on the ground that he had completed 3 years of<br \/>\nregular service\t as Store  keeper on  7th June,\t 1980 and  ,<br \/>\ntherefore, he  could not  be promoted  earlier than 1980. In<br \/>\ncoming to  this\t conclusion,  the  appellants  excluded\t the<br \/>\nperiod of  service rendered by the respondent in the Central<br \/>\nOrdnance Depot,\t Pune, as a Store Keeper for the period from<br \/>\n27th  April,  1971  to\t6th    June,  1977.  The  appellants<br \/>\ncontended that, since the respondent had been transferred on<br \/>\ncompassionate ground,  on his  own request  to the  post  of<br \/>\nStore Keeper  at Cochin\t and was placed at the bottom of the<br \/>\nSeniority list, the period of 3 years of regular service can<br \/>\nbe treated  to commence\t only from  the date on which he was<br \/>\ntransferred to Cochin. This is obviously fallacious inasmuch<br \/>\nas the\trespondent had\talready acquired  the  status  of  a<br \/>\npermanent employee at Pune where he had rendered more than 3<br \/>\nyears of  service as  a Store Keeper. Even if an employee is<br \/>\ntransferred at\this own\t request, from one place to another,<br \/>\non the\tsame post,  the period of service rendered by him at<br \/>\nthe earlier  place where  he held  a permanent\tpost and had<br \/>\nacquired  permanent   status,  cannot\tbe   excluded\tfrom<br \/>\nconsideration for determining his eligibility for promotion,<br \/>\nthough he  may\thave  been  placed  at\tthe  bottom  of\t the<br \/>\nseniority list\tat the\ttransferred place.  Eligibility\t for<br \/>\npromotion cannot  be confused with seniority as they are two<br \/>\ndifferent and distinct factors.\n<\/p>\n<p id=\"p_6\">     This Court in <a href=\"\/doc\/1170968\/\" id=\"a_1\">Union of India &amp; Ors. vs. C.N. Ponnappan<\/a>,<br \/>\nAIR 1996  SC 764=  1996(1) SCC\t524, has held that, where an<br \/>\nemployee  is   transferred  from  one  unit  to\t another  on<br \/>\ncompassionate ground  and is  placed at\t the bottom  of\t the<br \/>\nseniority list,\t the service  rendered by him at the earlier<br \/>\nplace from  where he  has been\ttransferred,  being  regular<br \/>\nservice has to be counted towards experience and eligibility<br \/>\nfor promotion.\n<\/p>\n<p id=\"p_7\">     In view  of this  decision, with  which we respectfully<br \/>\nagree, the direction of the Tribunal that the respondent may<br \/>\nbe promoted  to the  post of  Senior Store  Keeper  from  an<br \/>\nearlier\t date\tand   the   further   direction\t  concerning<br \/>\nrespondent&#8217;s promotion\tto the\tpost of Senior Store Keeper,<br \/>\nGrade-I, do  not suffer\t from any  infirmity. That being so,<br \/>\nthe appeal  has\t no  merits  and  is  accordingly  dismissed<br \/>\nwithout, however, any order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Scientific Advisor To Raksha &#8230; vs V.
