{"id":26904,"date":"2011-07-05T00:00:00","date_gmt":"2011-07-04T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/bihar-veterinary-association-vs-shri-anup-mukherjee-ors-on-5-july-2011"},"modified":"2017-06-06T07:17:03","modified_gmt":"2017-06-06T01:47:03","slug":"bihar-veterinary-association-vs-shri-anup-mukherjee-ors-on-5-july-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/bihar-veterinary-association-vs-shri-anup-mukherjee-ors-on-5-july-2011","title":{"rendered":"Bihar Veterinary Association &amp; &#8230; vs Shri Anup Mukherjee &amp; Ors. on 5 July, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Bihar Veterinary Association &amp; &#8230; vs Shri Anup Mukherjee &amp; Ors. on 5 July, 2011<\/div>\n<pre>                 IN THE HIGH COURT OF JUDICATURE AT PATNA\n                                  MJC No.2098 of 2010\n                         Bihar Veterinary Association &amp; Ors.\n                                            Versus\n                              Shri Anup Mukherjee &amp; Ors.\n                                          -----------\n<\/pre>\n<p>7   05-07-2011               Pursuant to our order dated 21-06-2011, the Principal<\/p>\n<p>                 Secretary of Animal Husbandry and Fisheries Department as well as of<\/p>\n<p>                 Finance Department are present in Court along with their show cause.<\/p>\n<p>                             We had made it clear that if the concerned opposite parties<\/p>\n<p>                 do not purge themselves of the contempt by today, it may not be<\/p>\n<p>                 possible to show any leniency in the matter as the contemnors have<\/p>\n<p>                 neither complied with the order of the Division Bench passed in Letters<\/p>\n<p>                 Patent Appeal of 2007 nor with the various orders passed thereafter in<\/p>\n<p>                 the earlier contempt proceeding or in the present contempt proceeding.<\/p>\n<p>                             Learned A.A.G.I submits that a modification application has<\/p>\n<p>                 been filed in L.P.A. 534 of 2007 on the limited point as to whether show<\/p>\n<p>                 cause notice to the petitioner Association of veterinary doctors would be<\/p>\n<p>                 sufficient or notice is required to be given to each and every veterinary<\/p>\n<p>                 doctor in the State of Bihar. In our view, notice in the newspaper<\/p>\n<p>                 would have served the purpose but for the advice like that the legal<\/p>\n<p>                 experts are available with the State. They may pursue any course of<\/p>\n<p>                 action, which they may intend to avail but we do not propose to show<\/p>\n<p>                 any leniency unless the order is complied with within a reasonable time.<\/p>\n<p>                             Learned AAG-I has consulted the secretaries present in<\/p>\n<p>                 court and has taken the stand that the issue of payment of non-practicing<\/p>\n<p>                 allowance on account of order dated 11-7-2007 shall be placed before<\/p>\n<p>                 the Cabinet and decided within one month. The prime concern of the<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>         petitioner association is with the financial benefits and hence we<\/p>\n<p>         adjourn the contempt proceeding for six weeks under the belief that the<\/p>\n<p>         aforesaid assurance shall be carried out.
