Accused Shakeel-appellant herein was found<br \/>\nguilty and convicted under <a href=\"\/doc\/619940\/\" id=\"a_1\">Sections 363<\/a>\/<a href=\"\/doc\/796352\/\" id=\"a_1\">366<\/a>\/<a href=\"\/doc\/1279834\/\" id=\"a_2\">376<\/a> of the<br \/>\nIndian Penal Code, vide judgment of conviction dated 5th<br \/>\nNovember, 1990. After hearing the accused on the quantum<br \/>\nof sentence on the same date, the learned Judge sentenced<br \/>\nthe accused to undergo rigorous imprisonment for two years<br \/>\nunder <a href=\"\/doc\/619940\/\" id=\"a_3\">Sections 363<\/a> of the Indian Penal Code, three<br \/>\nyears rigorous imprisonment under <a href=\"\/doc\/796352\/\" id=\"a_4\">Section 366<\/a> of the<br \/>\nIndian Penal Code and seven years rigorous imprisonment<br \/>\nunder <a href=\"\/doc\/1279834\/\" id=\"a_5\">Section 376<\/a> of the Indian Penal Code. All sentences<br \/>\nwere ordered to run concurrently.\n<\/p>\n<p id=\"p_2\">2. Challenge to the said judgment by the accused<br \/>\nin the present appeal is mainly on the ground that the<br \/>\nprosecutrix was a consented party. Her conduct through<br \/>\nthe entire period when she was with the accused shows that<br \/>\nthe basic ingredients of offence of rape and kidnapping<br \/>\nare no satisfied. Both accused and the prosecutrix are<br \/>\nstated to have gone various places and as such prosecutrix<br \/>\nhad ample opportunities to inform any person or even to<br \/>\npolice that she was being forcibly kept by the accused.<br \/>\nIn order to appreciate the contentions raised on behalf of<br \/>\nthe appellant, reference to the case of the prosecution<br \/>\nwould be necessary.\n<\/p>\n<p id=\"p_3\">3. The accused was committed to the Court of<br \/>\nSessions to stand trial for the offences afore-noticed.<br \/>\nThe case of the prosecution has been noticed by the<br \/>\nlearned trial court precisely in the following terms:-\n<\/p>\n<p id=\"p_4\">  &#8220;Briefly stated the facts are that PW.4 Miss<br \/>\nGeeta Devi prosecutrix aged about 14 years had<br \/>\ngone to fetch water from the water tap on<br \/>\n29.1.1990 at about 4.00 P.M. The accused met<br \/>\nher there and enticed her away by saying that<br \/>\nhe would bet her ornaments and good clothes.<br \/>\nhe took her to nearby hut, where he lived and<br \/>\nraped her there. The accused threatened her not<br \/>\nto tell anything to any person, otherwise she<br \/>\nwould be killed.\n<\/p>\n<p id=\"p_5\"> 3. On the same day, the accused took her to<br \/>\nhis village Anwla near Bareli (U.P.) and kept<br \/>\nher there in his uncle&#8217;s house and also raped<br \/>\nher there by threatening her.\n<\/p>\n<p id=\"p_6\"> 4. After village Anwla, he took her to bareli<br \/>\nwhere he kept her at the house of his brother<br \/>\nand also raped her there.\n<\/p>\n<p id=\"p_7\"> 5. After Bareli he brought her back to Delhi<br \/>\nby saying that they would do some work at Delhi<br \/>\nand would also live there. However, at the<br \/>\nRailway Station, Delhi, they were caught by the<br \/>\npolice.\n<\/p>\n<p id=\"p_8\"> 6. PW.5 Malkhan Singh father of the<br \/>\nprosecutrix lodged report Ex. PF in the Police<br \/>\nStation on 1.2.1990, after he failed to trace<br \/>\nher.\n<\/p>\n<p id=\"p_9\"> 7. On 10.2.1990, PW.7 Shanker Lal, Sub<br \/>\nInspector along with Suraj Bhan PW reached<br \/>\nRailway Station, Delhi in search of the accused<br \/>\nand Miss Geeta Devi. they located the accused<br \/>\nand Miss Geeta Devi sitting in the waiting<br \/>\nroom. They apprehended both of them and were<br \/>\nbrought them to Faridabad. He sent Geeta with<br \/>\nlady constable PW.6, Sumitra for her medico<br \/>\nlegal examination.\n<\/p>\n<p id=\"p_10\"> 8. PW.1 Dr. Kusum Chaudhary medico legally<br \/>\nexamined Miss Geeta at about 2.00 P.M. on<br \/>\n10.2.90 and opined that she was habitual to<br \/>\nsexual intercourse and the possibility of her<br \/>\nhaving sex could not be ruled out. She proved<br \/>\nEx. PA carbon copy of her medico legal report<br \/>\nand also opinion Ex. PB\/1 which she had given<br \/>\non the application of police Ex. PB. After<br \/>\nexamination, PW.1 handed over copy of medico<br \/>\nlegal report, one parcel containing Salwar<br \/>\nEx. PA and an envelope which were sealed with<br \/>\nhis seal to PW.6 Sumitra lady constable, who in<br \/>\nturn handed over these articles to PW.7 Shanker<br \/>\nLal. He took these articles into possession<br \/>\nvide recovery memo Ex.PK.\n<\/p>\n<p id=\"p_11\"> 9. The accused was also got medico legally<br \/>\nexamined from PW.2 Dr. G.D. Kalra who opined<br \/>\nthat the accused was fit to perform sexual<br \/>\nintercourse. He proved Ex.PC carbon copy of<br \/>\nhis medico legal report.\n<\/p>\n<p id=\"p_12\">4. Charges were framed upon the accused.<br \/>\nProsecution examined in addition to the afore-noticed,<br \/>\nwitness Dr. Kusum Chaudhary, PW.1, Dr. G.D. Kalra, PW.2,<br \/>\nMrs. Krishna Gera, Headmistress, PW.3 and Miss Geeta<br \/>\nDevi, PW.4 the prosecutrix herself. The report of FSL<br \/>\nMadhuban was placed on record as Ex. PJ and Ex. P7.<br \/>\nAffidavit of Tara Singh Head Constable was tendered in<br \/>\nevidence as exhibit PH. In his statement under <a href=\"\/doc\/767287\/\" id=\"a_6\">Section<br \/>\n313<\/a> Cr.P.C., the accused denied the allegations and pleaded<br \/>\nhis false implication in the case.\n<\/p>\n<p id=\"p_13\">5. The case of the prosecution as emerges from<br \/>\nF.I.R. exhibit PF stands fully proved by the statement of<br \/>\nPW.4 Geeta Devi, who categorically stated that at the<br \/>\nrelevant time, she was 14 years of age and fully supported<br \/>\nthe case of the prosecution. In her cross-examination,<br \/>\nshe did not even impliedly admit that she had accompanied<br \/>\nthe accused out of her free will. She has, in fact,<br \/>\ncategorically stated that she lived with the accused for<br \/>\n10-15 days and it was forcible detention All the previous<br \/>\nacquaintance with the accused were denied by her. Even as<br \/>\nper the medical evidence, the age of the prosecutrix was<br \/>\nstated to be 13-14 years. Upon medical examination, her<br \/>\nhymen was found to be torn. It had also come in evidence<br \/>\nthat she was habitual to sexual intercourse. Exhibit PA<br \/>\nwas the basic evidence to establish this fact. Thus,<br \/>\nversion of the prosecution that she was subjected to<br \/>\nforcible sexual intercourse also stands proved.\n<\/p>\n<p id=\"p_14\">6. Learned counsel for the appellant has not been<br \/>\nable to refer to any evidence on record which could<br \/>\nremotely suggest serious doubt in the prosecution case.<br \/>\nThe mere fact that prosecutrix had been to various public<br \/>\nplaces including Delhi Railway Station per se would not be<br \/>\nsufficient to doubt the prosecution version. She was<br \/>\nunder continuous threat and in fact was sexually abused.<br \/>\nHer conduct at that young age appears to be normal. The<br \/>\nevents happening with her are bound to leave a scar on her<br \/>\nthinking and there is every likelihood of her being<br \/>\napprehensive. Under no circumstances this can be case of<br \/>\nconsent as argued by learned counsel for the accused.<br \/>\nOnce the age of the prosecutrix had been proved on record<br \/>\nto be between 13-14 years, other factors are rendered<br \/>\nirrelevant including her implied or direct consent. Even<br \/>\nif for the sake of arguments it was assumed that she had<br \/>\nconcurred or had gone with the accused of her own accord,<br \/>\nthe result still would be the same and the accused can get<br \/>\nno benefit of this premise.\n<\/p>\n<p id=\"p_15\">7. For the reasons stated above, I find no merit<br \/>\nin this appeal. The same is dismissed. The order of<br \/>\nconviction and sentence awarded by the learned trial court<br \/>\nis sustained.\n<\/p>\n<p id=\"p_16\">8.
