Whether the judgment should be reported in the Digest ?\n<\/p>\n<p id=\"p_8\">                                ***<\/p>\n<p>AJAY TEWARI, J (Oral)<\/p>\n<p>             This order shall dispose of CWP Nos.15697, 20152, 16886,<\/p>\n<p>18401, 17982 of 2008 and 123 of 2009, as common questions of law and<\/p>\n<p>fact are involved therein.\n<\/p>\n<p id=\"p_9\">             The sole dispute in these cases is with regard to the validity of<\/p>\n<p>recovery orders, which have been passed and implemented without any<\/p>\n<p>notice to the pensioners. This fact is not disputed.<\/p>\n<p id=\"p_10\">             A reference in this regard is made to two Division Bench<\/p>\n<p>judgments of this Court in <a href=\"\/doc\/893049\/\" id=\"a_1\">Ram Narain Dua vs Dakshin Haryana Bijli Vitran<\/p>\n<p>Nigam Ltd and others<\/a>, 2007(1) RSJ 402, and CWP No.16997 of 2006, Ram<\/p>\n<p>Dass vs Uttar Haryana Bijli Vitran Nigam Limited and another, decided on<\/p>\n<p>25.2.2008, wherein it has been categorically held that recovery from retiral<\/p>\n<p>dues can only be made after conducting regular inquiry.<\/p>\n<p id=\"p_11\">             In these circumstances, these writ petitions are allowed and the<\/p>\n<p>impugned recovery orders are set aside. The petitioners would be entitled<\/p>\n<p>for refund of amounts withheld\/recovered. However, this disbursal shall be<\/p>\n<p>made after the petitioners give security to the satisfaction of Chief Accounts<\/p>\n<p>Officer (Pension), Uttar Haryana Bijli Vitran Nigam Limited about the<\/p>\n<p>refund of the same in case the amounts are found to be recoverable after the<\/p>\n<p>due procedure.
