Justice M.SASIDHARAN NAMBIAR\n\n Dated :30\/07\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n               ------------------------------------------\n                W.P.C.NO.31882 OF 2008\n               ------------------------------------------\n\n                Dated         30th      July 2009\n\n\n                           O R D E R\n<\/pre>\n<p id=\"p_1\">           Petitioners are accused and respondent the<\/p>\n<p>complainant in C.C.469\/2008 on the file of Judicial<\/p>\n<p>First Class Magistrate-II, Nedumangad. Ext.P7 protest<\/p>\n<p>complaint    filed      by      respondent             alleging    that<\/p>\n<p>petitioners committed          offence under Section 498 A<\/p>\n<p>read with <a href=\"\/doc\/37788\/\" id=\"a_1\">Section 34<\/a> of Indian Penal Code and the<\/p>\n<p>refer report submitted         after investigation cannot be<\/p>\n<p>accepted  as  there       was       no       proper       investigation.<\/p>\n<p>Judicial First Class Magistrate after recording sworn<\/p>\n<p>statement of the respondent took                     cognizance of the<\/p>\n<p>offence under Section 498 A read with                    <a href=\"\/doc\/37788\/\" id=\"a_1\">Section 34<\/a> and<\/p>\n<p>issued summons to the petitioners.                    Petitioners filed<\/p>\n<p>this  petition       under         <a href=\"\/doc\/1712542\/\" id=\"a_2\">Article          226<\/a>    and  <a href=\"\/doc\/1331149\/\" id=\"a_3\">227<\/a>   of<\/p>\n<p>Constitution of India          for a writ of certiorari or<\/p>\n<p>direction to quash Ext.P7 protest complaint and the<\/p>\n<p>proceedings initiated thereunder.<\/p>\n<p id=\"p_1\">         2.   First       respondent            filed     an   affidavit<\/p>\n<p>stating that the dispute with first petitioner husband<\/p>\n<p>WPC 31882\/08<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              2<\/span><\/p>\n<p>was    settled   amicably    and   Family       court,<\/p>\n<p>Thiruvananthapuram     in  O.P.570\/2006   has  already<\/p>\n<p>dissolved their marriage and under the settlement<\/p>\n<p>parties have agreed to settle all other cases pending<\/p>\n<p>before   Family court as well as  Judicial First Class<\/p>\n<p>Magistrate, Nedumangad and in view of the settlement<\/p>\n<p>respondent   has   no  objection   for  quashing   the<\/p>\n<p>proceedings.\n<\/p>\n<p id=\"p_2\">     2.    Though an offence under <a href=\"\/doc\/1868826\/\" id=\"a_4\">Section 498<\/a> A of<\/p>\n<p>Indian Penal Code is not compoundable, as held by the<\/p>\n<p>Apex court in <a href=\"\/doc\/469138\/\" id=\"a_5\">B.S.Joshi     and others    v. State of<\/p>\n<p>Haryana   and  another<\/a>  (2003(4) SCC   675)   when   a<\/p>\n<p>matrimonial   dispute is settled between the parties,<\/p>\n<p>it is not in the interest of justice to stand on<\/p>\n<p>technicalities and   geopardise the settlement arrived<\/p>\n<p>at by the parties.   When respondent  herself admitted<\/p>\n<p>the settlement and submitted that she has no objection<\/p>\n<p>for quashing the proceedings,  in view of the amicable<\/p>\n<p>settlement   arrived at, the  cognizance taken  by the<\/p>\n<p>learned Magistrate on the protest complaint of the<\/p>\n<p>respondent and that too after a refer report was filed<\/p>\n<p>by the police, it is not in the interest of justice to<\/p>\n<p>continue the proceedings.\n<\/p>\n<p id=\"p_3\">WPC 31882\/08<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             3<\/span><\/p>\n<p>            Petition is allowed.
