Housing Board.\n\n\n18.8.2010\n\n\n       Shri Amit Garg, Counsel for the petitioners.\n       Shri Piyush Dharmadhikari, Counsel for the respondents.<\/pre>\n<p id=\"p_1\">       This petition is directed against the order dated 15.4.2008<br \/>\npassed by learned First Civil Judge, Class-I Sidhi in Civil suit No.5-<br \/>\nA\/2005 by which the trial Court though allowed the application<br \/>\nfiled by the petitioners under Order 9 Rule 7 of the Code of Civil<br \/>\nProcedure but has not granted an opportunity to the petitioners to<br \/>\nfile written statement.       The trial Court while allowing such an<br \/>\napplication permitted the petitioners         to participate in the<br \/>\nproceeding without setting aside the earlier order.\n<\/p>\n<p id=\"p_1\">       Learned counsel appearing for the petitioners submitted<br \/>\nthat though the trial Court set aside the ex parte order but has not<br \/>\ngranted any opportunity to the petitioner to file written statement<br \/>\nand in the absence of written statement, it will futile to participate<br \/>\nin the proceedings.     Submission of the learned counsel for the<br \/>\npetitioners is that on payment of cost one opportunity to the<br \/>\npetitioners be granted for filing written statement.\n<\/p>\n<p id=\"p_2\">       Shri Piyush Dharmadhikari, learned counsel appearing for<br \/>\nthe respondents vehemently opposed the contention raised by the<br \/>\npetitioners. He also drew attention of this Court to the impugned<br \/>\norder in which it is stated that the matter remained pending<br \/>\nbecause of non-appearance of the petitioner since 2005, ex parte<br \/>\norder was passed on 8.9.2005 and till 14.4.2008 the trial court<br \/>\nremained held up because of non-appearance of the petitioners in<br \/>\nspite of service of notice.\n<\/p>\n<p id=\"p_3\">       From the perusal of the impugned order we find that the<br \/>\ntrial Court though allowed the application under Order 9 Rule 7<br \/>\nCPC but has not set aside the order ex parte passed earlier in the<br \/>\nmatter. For this the only reason has been assigned that it will<br \/>\ncause delay in the proceedings. For the delay cause, other party\n<\/p>\n<p id=\"p_4\">                                                                    2&#8230;..<\/p>\n<pre id=\"pre_1\">\n\n\n\n                         W.P. Housing Board.\n\n\n18.8.2010\n\n\n<\/pre>\n<p id=\"p_5\">can be compensated, but in case the petitioners are not allowed<br \/>\nan opportunity to file written statement this may cause a serious<br \/>\nprejudice to the interest of the petitioners.\n<\/p>\n<p id=\"p_6\">        In these circumstances, in the interest of justice, we allow<br \/>\nthis writ petition in part with the following directions ;\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     1. The petitioners shall file written statement on or before<br \/>\n        15.9.2010 before the trial Court along with cost. The cost is<br \/>\n        quantified to Rs.2000\/-[rupees two thousand only] payable<br \/>\n        by the petitioners to the respondents along with written<br \/>\n        statement.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>     2. If the written statement is filed alongwith the aforesaid cost<br \/>\n        the trial Court shall take the written statement on record<br \/>\n        and proceed further in the matter.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>     3. In case of non-deposit of the cost and non-filing of the<br \/>\n        written statemnt on or before the time fixed, the earlier<br \/>\n        order shall stand and the trial Court shall be free to proceed<br \/>\n        in the matter.<\/p><\/blockquote>\n<p id=\"p_7\">        Considering the facts and circumstances of the case, there<br \/>\nshall be no order as to costs to this petition.\n<\/p>\n<p id=\"p_8\">        C.C. as per rules.<\/p>\n<pre id=\"pre_2\">\n\n\n         (Krishn Kumar Lahoti)                    (J.K.
