Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :27\/10\/2010\n\n O R D E R\n<\/pre>\n<p id=\"p_1\">        Thottathil B.Radhakrishnan, J.<\/p>\n<p>= = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>        R.P.668\/2010 in LAA.1343\/2005<\/p>\n<p>             &amp; C.M.Appl.1289\/2010<\/p>\n<p>= = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>    Dated this the 27th day of October, 2010.<\/p>\n<p id=\"p_1\">                     Order<\/p>\n<p>Heard the leaned counsel for parties, including<\/p>\n<p>on the merits of the review petition. The plea<\/p>\n<p>raised in the review petition is that the ground<\/p>\n<p>in  the  appeal  that   the   standing  space   of<\/p>\n<p>improvements was not taken into consideration for<\/p>\n<p>deducting any amount accountable under that head.<\/p>\n<p>The total amount granted by way of enhancement of<\/p>\n<p>value of improvements is Rs.12340.55. With this,<\/p>\n<p>the amount that could have been deducted if at<\/p>\n<p>all, was obviously meagre and it does not merit<\/p>\n<p>consideration on a review petition filed with an<\/p>\n<p>application seeking condonation of delay in 1383<\/p>\n<p>days.  There  is  really   no  legitimate   reason<\/p>\n<p>attributed to the delay in filing the review<\/p>\n<p>petition. That apart, it is also not the case<\/p>\n<p>that such a ground was addressed at the stage of<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">RP668\/10               -: 2 :-<\/span><\/p>\n<p>  admission. Under such circumstances, I find that<\/p>\n<p>  there is no error apparent on the face of the<\/p>\n<p>  judgment calling for exercise of review, that<\/p>\n<p>  too, by condoning the enormous delay of 1363 days<\/p>\n<p>  in filing the review petition.
