SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/09\/2005 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p id=\"p_1\">Rule.\n<\/p>\n<p id=\"p_1\">\tShri M.R.Mengdey, learned AGP waives service of Rule on behalf of<br \/>\n\tRespondent No.1 and Shri A.N.Shah, learned advocate waives service<br \/>\n\tof Rule on behalf of respondent No.4.\n<\/p>\n<p id=\"p_2\">In<br \/>\n\tthis petition under Articles 226 and 227 of the Constitution of<br \/>\n\tIndia, the petitioner has challenged the legality and validity of<br \/>\n\tthe  judgment and order passed by the Joint Secretary (Appeals),<br \/>\n\tRevenue Department, State of Gujarat dated 15.7.2005 passed in<br \/>\n\tRevision Application No.13\/2005 in allowing the said Revision<br \/>\n\tApplication and quashing and setting aside the orders passed by the<br \/>\n\tPrant Officer, Gandhinagar dated 17.6.2004 and the order passed by<br \/>\n\tthe Collector, Gandhinagar dated 13.12.2004 with respect to the<br \/>\n\trevenue Entry No.4629 with respect to the land in question.\n<\/p>\n<p id=\"p_3\">The<br \/>\n\tdispute is with regard to the revenue Entry No.4629 with respect to<br \/>\n\tthe land bearing Survey Nos. 461, 462\/1, 462\/2, 474\/1 and 474\/2<br \/>\n\tsituated at village Jundal, Taluka and District Gandhinagar and by<br \/>\n\tvirtue of the aforesaid revenue entry, the  name of respondent No.4<br \/>\n\therein was mutated in the revenue record. The said Entry came to be<br \/>\n\tchallenged by the petitioner herein before the Prant Officer,<br \/>\n\tGandhinagar and the Prant Officer, Gandhinagar set aside the order<br \/>\n\tpassed by the Circle Officer, Gandhinagar dated 2.3.2001 in<br \/>\n\tcertifying revenue Entry No.4629 and passed an order to prepare the<br \/>\n\tEntry afresh after considering the Pedhinama of deceased Mangaji<br \/>\n\tMotiji Thakor and to mutate the names of his heirs. Being aggrieved<br \/>\n\tand dissatisfied with the  order passed by the Prant Officer,<br \/>\n\tGandhinagar the respondent No.4 preferred Revision Application<br \/>\n\tbefore the Collector, Gandhinagar and the Collector, Gandhinagar by<br \/>\n\tits order dated 13.12.2004 dismissed the said Revision Application.<br \/>\n\tBeing aggrieved and dissatisfied with the  order passed by the<br \/>\n\tCollector, Gandhinagar dated 13.12.2004 in dismissing the said<br \/>\n\tRevision Application and confirming the order passed by the Prant<br \/>\n\tOfficer, Gandhinagar dated 17.6.2004 in cancelling revenue Entry<br \/>\n\tNo.4629 the respondent No.4 preferred Revision Application before<br \/>\n\tthe Joint Secretary (Appeals), Revenue Department, State of Gujarat<br \/>\n\tbeing Revision Application No. 13\/2005 and the Revisional Authority<br \/>\n\tby its judgment and order dated 15.7.2005 allowed the said Revision<br \/>\n\tApplication and considering the fact that the Civil Suit is already<br \/>\n\tpending at the instance of the petitioner herein for declaration and<br \/>\n\tpermanent injunction for establishing his rights in the land in<br \/>\n\tquestion as heir of deceased Mangaji Motiji Thakor, the Revisional<br \/>\n\tAuthority allowed the said Revision Application quashing and setting<br \/>\n\taside the order passed by the Prant Officer, Gandhinagar and the<br \/>\n\torder passed by the Collector, Gandhinagar dated 17.6.2004 and<br \/>\n\t13.6.2004 respectively and restoring the revenue Entry No.4629.<br \/>\n\tBeing aggrieved and dissatisfied with the  judgment and order<br \/>\n\tpassed by the Joint Secretary (Appeals), Revenue Department, State<br \/>\n\tof Gujarat dated 15.7.2005 passed in Revision Application<br \/>\n\tNo.13\/2005, the petitioner has preferred the present Special Civil<br \/>\n\tApplication under Articles 226 and 227 of the Constitution of India.\n<\/p>\n<p id=\"p_4\">Number<br \/>\n\tof submissions have been made on merits on behalf of the respective<br \/>\n\tparties. However, it is required to be noted that the dispute is<br \/>\n\twith regard to the mutation entry in the revenue record and as held<br \/>\n\tby the Hon&#8217;ble Supreme Court in case of Durgadas  V\/s.<br \/>\n\tCollector and Others reported in 1996(5) SCC Page-618<br \/>\n\tas well as in case of Sankalchan Jaychandbhai Patel and others<br \/>\n\t V\/s. Vithalbhai Jaychandbhai Patel and others reported in<br \/>\n\t1996(6) SCC Page-433 and by this Court in case of Ratilal<br \/>\n\tChunilal Solanki &amp; ors. V\/s. Shantilal Chunilal<br \/>\n\tSolanki &amp; ors. reported in 1996(1) GLH Page 816<br \/>\n\tas well as in case of LRs. of Popat Khima Ramani &amp; Others<br \/>\n\tV\/s. Collector, Rajkot &amp; Others reported in 2003(1)<br \/>\n\tGLH Page-30 the entries in the revenue record or mutation<br \/>\n\tentries do not confer any right, title or interest to the property<br \/>\n\tand it is only an entry for the fiscal purpose of collection of land<br \/>\n\trevenue and that revenue authority has no jurisdiction to decide the<br \/>\n\tdisputed question of title while considering the RTS proceedings<br \/>\n\twhen there is a dispute with regard to title, parties are required<br \/>\n\tto be relegated to approach the Civil Court for establishing their<br \/>\n\trights and in the present case, the petitioner has already filed<br \/>\n\tRegular Civil Suit No.353 of 1993 in the Court of Civil Judge<br \/>\n\t(J.D.), Gandhinagar for establishing his rights as heir of deceased<br \/>\n\tMangaji Motiji Thakor and therefore, necessary entry can be modified<br \/>\n\tand\/or made on the basis of the judgment and order that may be<br \/>\n\tpassed by the Civil Court (J.D.), Gandhinagar in Regular Civil Suit<br \/>\n\tNo.353\/93 and therefore, it is observed that merely on the basis of<br \/>\n\tthe revenue Entry No.4629 in favour of the respondent No.4, she will<br \/>\n\tnot be having any right in the land in question as the Entry in the<br \/>\n\trevenue record is only for fiscal purpose for the purpose of<br \/>\n\tcollecting the revenue and to show the prima-facie possession and<br \/>\n\tadmittedly the respondent No.4 is in possession of the land in<br \/>\n\tquestion, however, in the revenue record an additional entry can be<br \/>\n\tmade that the Entry in question is subject to the ultimate outcome<br \/>\n\tof the judgment and order that may be passed by the Civil Court<br \/>\n\t(J.D.), Gandhinagar in Regular Civil Suit No.353\/93.\n<\/p>\n<p id=\"p_5\">Accordingly,<br \/>\n\tthe present Special Civil Application is dismissed however, the<br \/>\n\trevenue authority is directed to make an additional entry in the<br \/>\n\trevenue record that the aforesaid Entry No. 4629 is subject to the<br \/>\n\tultimate outcome of Regular Civil Suit No.353\/93 pending in the<br \/>\n\tCourt of Civil Judge (J.D.), Gandhinagar and that necessary entry<br \/>\n\twill be made on the basis of the judgment and decree that may be<br \/>\n\tpassed by the Civil Court (J.D.), Gandhinagar in the aforesaid Civil<br \/>\n\tSuit.\n<\/p>\n<p id=\"p_6\">With<br \/>\n\tthese observations and direction, the present Special Civil<br \/>\n\tApplication is dismissed.
