Heard learned Counsel appearing for the applicant and<\/p>\n<p>     learned counsel appearing for the respondent\/non-applicant.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                ::: Downloaded on &#8211; 09\/06\/2013 16:30:46 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                          (2)<\/span><\/p>\n<p id=\"p_1\">     2     Rule. Rule made returnable forthwith and heard with the consent<\/p>\n<p>     of the parties.\n<\/p>\n<p id=\"p_2\">     3     This application is filed for transfer of Hindu Marriage Petition No.<\/p>\n<p>     194 of 2009 filed by the respondent under Section 13(1) (ia) of the <a href=\"\/doc\/590166\/\" id=\"a_1\">Hindu<\/p>\n<p>     Marriage Act<\/a>, 1955 before the learned C.J.S.D. Nashik to the Court of<\/p>\n<p>     learned C.J.S.D. Ahmednagar.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">     4<\/span><\/p>\n<p id=\"p_3\">           Learned Counsel appearing for the applicant submitted that the<\/p>\n<p>     marriage of the applicant and the respondent was solemnized at<\/p>\n<p>     Ahmednagar. After the marriage the family members of the respondent<\/p>\n<p>     were demanding money and household articles from the parents of the<\/p>\n<p>     applicant. Since the parents of the applicant could not fulfill their demand,<\/p>\n<p>     the respondent and his family members caused illtreatment to the<\/p>\n<p>     applicant and drove her out from their house. The applicant filed Criminal<\/p>\n<p>     Misc. application No. 175 of 2008 before the learned J.M.F.C. at<\/p>\n<p>     Ahmednagar for maintenance under <a href=\"\/doc\/1056396\/\" id=\"a_1\">section 125<\/a> of Cr.P.C. The learned<\/p>\n<p>     J.M.F.C. after hearing both the parties has granted monthly maintenance<\/p>\n<p>     to the applicant by an order dated 31.3.2009. On behalf of the applicant,<\/p>\n<p>     it is further submitted that Hindu Marriage Petition No. 187 of 2009 is also<\/p>\n<p>     filed by the applicant in the Court of learned C.J.S.D. Ahmednagar under<\/p>\n<p>     <a href=\"\/doc\/322349\/\" id=\"a_2\">Section 9<\/a> of the Hindu Marriage Act, 1955 for restitution of conjugal rights<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                                  ::: Downloaded on &#8211; 09\/06\/2013 16:30:46 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_4\">                                          (3)<\/span><\/p>\n<p>     against the respondent. It is further submitted that since the respondent is<\/p>\n<p>     not paying the regular maintenance, the applicant has filed Criminal<\/p>\n<p>     Inquiry Application No. 396 of 2009 before the learned Chief Judicial<\/p>\n<p>     Magistrate, Ahmednagar for recovery of the maintenance amount as<\/p>\n<p>     respondent did not pay maintenance amount.\n<\/p>\n<p id=\"p_4\">           The learned counsel for the applicant submitted the applicant is<\/p>\n<p>     unable to maintain herself and she has no source of income. Whenever<\/p>\n<p>     she has to attend the Court proceeding at Nashik, she has to travel about<\/p>\n<p>     160 kilometers from Ahmednagar to Nashik. As she is a lady one of her<\/p>\n<p>     family member has to accompany her. The applicant has to spend more<\/p>\n<p>     than Rs.500\/- for travelling and Rs.500\/- for lodging and food for<\/p>\n<p>     attending the Court proceeding pending at Nashik. It is submitted that the<\/p>\n<p>     said expenses is unbearable and inconvenient to the applicant as she<\/p>\n<p>     has no source of income. Learned Counsel further submitted that the<\/p>\n<p>     convenience of wife is to be looked at in the proceeding filed by the<\/p>\n<p>     husband.   Therefore, learned Counsel would submit that the application<\/p>\n<p>     deserves to be allowed. In support of this contentions, learned counsel<\/p>\n<p>     for the applicant has placed reliance on the following judgments of this<\/p>\n<p>     Court as well as the Hon&#8217;ble Supreme Court.\n<\/p>\n<p id=\"p_5\">           i)    Sangmitra Ramakant Royalwar Vs. Ramakant Gangaram<\/p>\n<p><span class=\"hidden_text\" id=\"span_5\">                                                 ::: Downloaded on &#8211; 09\/06\/2013 16:30:46 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_6\">                                          (4)<\/span><\/p>\n<p>                  Royalwar, reported in 2009 (1) Bom.C.R. 316<\/p>\n<p id=\"p_6\">           ii)    Shruti Shriram Jangam Vs. Shriram Balkrushna Jangam,<\/p>\n<p>                  reported in 2009 (6) Bom. C.R. 433<\/p>\n<p id=\"p_7\">           iii)   Smt. Vidya Shankar Iyer Vs. Shankar Nagraj Iyer, reported in<\/p>\n<p>                  2006 (2) All MR 735<\/p>\n<p id=\"p_8\">           iv)    Sandhya w\/o Ananta Mane Vs. Ananta Manohar Mane (Misc.\n<\/p>\n<p id=\"p_9\">                  Civil application No. 37 of 2009 decided on 20.4.2010<br \/>\n                  [Aurangabad Bench])<\/p>\n<p id=\"p_10\">           v)     Rajani Kishor Pardeshi Vs. Kishor Babulal Pardeshi,<\/p>\n<p>                  reported in (2005) 12 SCC 237.\n<\/p>\n<p id=\"p_11\">           vi)    Roopali Saxena Vs. Ait Saxena, reported in (2004) 13 SCC<\/p>\n<p><span class=\"hidden_text\" id=\"span_7\">                  495<\/span><\/p>\n<p>     5     Learned Counsel appearing for the respondent submitted that the<\/p>\n<p>     respondent is serving at Nashik and therefore, it is not possible for him to<\/p>\n<p>     attend the court&#8217;s proceeding at Ahmednagar on each and every date.\n<\/p>\n<p id=\"p_12\">     He therefore, prays that this application deserves to be rejected.\n<\/p>\n<p id=\"p_13\">     6     I have given due consideration to the submissions advanced on<\/p>\n<p>     behalf of the parties. In my opinion, since there is no source of income to<\/p>\n<p><span class=\"hidden_text\" id=\"span_8\">                                                 ::: Downloaded on &#8211; 09\/06\/2013 16:30:46 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_9\">                                          (5)<\/span><\/p>\n<p>     the applicant wife and being a lady it will be very inconvenient for the wife<\/p>\n<p>     to travel from Ahmednagar to Nashik.           On this ground alone this<\/p>\n<p>     application deserves to be allowed.    Counsel appearing for the applicant<\/p>\n<p>     has also placed reliance on reported judgment of the Supreme Court in<\/p>\n<p>     the case of Sumita Singh V\/s. Kumar Sanjay and another, AIR 2002 S.C.\n<\/p>\n<p id=\"p_14\">     396, in para 3 of the said judgment, the Hon&#8217;ble Supreme Court has held<\/p>\n<p>     that in the suit filed by husband it is wife&#8217;s convenience that must be<\/p>\n<p>     looked at. Taking into consideration said judgment, this Court has also in<\/p>\n<p>     the case of Sangamitra Ramakant Royalwar V\/s. Ramakant Gangaram<\/p>\n<p>     Royalwar, 2009 (1) Bom.C.R.316, has taken a same view.                  Therefore,<\/p>\n<p>     taking into consideration peculiar facts and, it would be in the interest of<\/p>\n<p>     justice, if the pending proceedings in H.M.P. No. 194 of 2009 are<\/p>\n<p>     transferred from the Court of Civil Judge, Senior Division, Nashik to the<\/p>\n<p>     learned Civil Judge Senior Division, at Ahmednagar. Therefore, H.M.P.\n<\/p>\n<p id=\"p_15\">     No. 194 of 2009 from the Court of Civil Judge, Senior Division, Nashik, is<\/p>\n<p>     transferred to the Family Court at Ahmednagar.              The application is<\/p>\n<p>     allowed to above extent. Needless to mention that H.M.P. No. 187 of<\/p>\n<p>     2009 filed by wife in the court of learned C.J.S.D. Ahmednagar and also<\/p>\n<p>     transferred H.M.P. No. 194 of 2009 will be heard together by the<\/p>\n<p>     concerned Judge, at Ahmednagar.\n<\/p>\n<p id=\"p_16\">     7     H.M.P. No. 194 of 2009 be transferred from the Court of Civil<\/p>\n<p><span class=\"hidden_text\" id=\"span_10\">                                                  ::: Downloaded on &#8211; 09\/06\/2013 16:30:46 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_11\">                                       (6)<\/span><\/p>\n<p>     Judge, Senior Division, Nashik, to the Court of learned C.J.S.D.\n<\/p>\n<p id=\"p_17\">     Ahmednagar, within one month from today.       The concerned court at<\/p>\n<p>     Ahmednagar will inform the parties the date of hearing. The concerned<\/p>\n<p>     court shall make endeavour to dispose of the proceedings as<\/p>\n<p>     expeditiously as possible and in any event within six months from the<\/p>\n<p>     date of receipt thereof.\n<\/p>\n<p id=\"p_18\">     8     The application is accordingly allowed and disposed of.
