Learned counsel,<br \/>\n\tMr.Prajapati, waives service of notice of rule on behalf of the<br \/>\n\trespondents.\n<\/p>\n<p id=\"p_1\">\tThe Civil  Applications<br \/>\n\thave  been  filed by the present applicants for condoning the  delay<br \/>\n\t of 479  days  caused  in  preferring First Appeals.\n<\/p>\n<p id=\"p_2\">\tI have heard learned<br \/>\n\tcounsel for  the  applicants and  also gone through the reasons<br \/>\n\tmentioned in the Civil Applications  on  oath  regarding<br \/>\n\tcondonation of delay. Reasons  as  to why appeals could not be filed<br \/>\n\tin time are  stated in paras 3 and 4 of the applications.\n<\/p>\n<p id=\"p_3\">\tIn  view  of  the fact<br \/>\n\tthat the reasons stated in the  applications  have  not  been<br \/>\n\tcontroverted  by the    otherside  by filing an affidavit and also<br \/>\n\tin view of the principles governing the discretionary exercise of<br \/>\n\tpower under Sec.5 of the Limitation Act, 1963, I am of the view that<br \/>\n\t sufficient cause has been stated for not filing the appeals in time<br \/>\n\tand hence, delay caused in  filing  appeals is to be condoned and<br \/>\n\tcivil applications are required to be allowed.\n<\/p>\n<p id=\"p_4\">\tFor  the  aforesaid<br \/>\n\treasons,   applications are allowed.   Delay of 479  days caused in<br \/>\n\tfiling First Appeals is condoned.
